9 AN ACT concerning the state board of regents; relating to the scope of
10 certain comprehensive rehabilitation and repair capital improvement
11 projects for state educational institutions; amending section 13 of chap-
12 ter 259 of the 1996 Session Laws of Kansas and repealing the existing
13 section.

15 Be it enacted by the Legislature of the State of Kansas:
16 Section 1. Section 13 of chapter 259 of the 1996 Session laws of
17 Kansas is hereby amended to read as follows: Sec. 13.
18 STATE BOARD OF REGENTS
19 (a) There is appropriated for the above agency from the Kansas ed-
20 ucational building fund for the fiscal year or fiscal years and for the capital
21 improvement project or projects specified as follows:
22 Rehabilitation and repair projects, Americans with disabilities act compliance projects, state
23 fire marshal code compliance projects, and improvements to classroom projects for in-
24 stitutions of higher education
25 For the fiscal year ending June 30, 1997$4,000,000
26 For the fiscal year ending June 30, 1998[nt$5,000,000
27 For the fiscal year ending June 30, 1999[nt$5,000,000
28 For the fiscal year ending June 30, 2000[nt$5,000,000
29 For the fiscal year ending June 30, 2001[nt$5,000,000
30 Provided, That the state board of regents is hereby authorized to transfer moneys from the
31 rehabilitation and repair projects, Americans with disabilities act compliance projects, state
32 fire marshal code compliance projects, and improvements to classroom projects for insti-
33 tutions of higher education account to an account or accounts of the Kansas educational
34 building fund of any institution under the control and supervision of the state board of
35 regents to be expended by the institution for projects approved by the state board of regents:
36 Provided, however, That no expenditures shall be made from any such account until the
37 proposed projects have been reviewed by the joint committee on state building construction.
38 (b) On July 15, 1996, or as soon thereafter as moneys are available,
39 the director of accounts and reports shall transfer $138,736 from the state
40 general fund to the Kansas educational building fund.
41 (c) There is appropriated for the above agency from the following
42 special revenue fund or funds for the fiscal year or fiscal years specified,
43 all moneys now or hereafter lawfully credited to and available in such

1 fund or funds, except that expenditures shall not exceed the following:
2 Comprehensive rehabilitation and repair fund For the fiscal year ending June 30, 1997No limit

6 Provided, That the state board of regents is hereby authorized to transfer moneys from the
7 comprehensive rehabilitation and repair fund of the state board of regents to any account
8 or accounts of a comprehensive rehabilitation and repair fund of any state educational
9 institution under the control and supervision of the state board of regents for expenditure
10 by the institutions for one or more capital improvement projects for major remodeling and
11 new construction, including acquisition of computers and other information technology
12 equipment associated with such projects, approved by the state board of regents or for
13 payment of debt service on revenue bonds issued to finance such projects: Provided further,
14 That the state board of regents may make expenditures from this fund for the payment of
15 debt service on revenue bonds issued to finance such projects: And provided further, That
16 the state board of regents shall first advise and consult with the joint committee on state
17 building construction as required by subsection (b) of K.S.A. 75-3717b and amendments
18 thereto regarding each such capital improvement project which has been approved by the
19 state board of regents for an institution before making the first transfer from this fund to
20 any account or accounts of a comprehensive rehabilitation and repair fund of such institution
21 for such project: And provided further, That such capital improvement projects are hereby
22 approved for the state board of regents and for such state educational institutions for the
23 purposes of subsection (b) of K.S.A. 74-8905 and amendments thereto and the authorization
24 of one or more series of revenue bonds by the Kansas development finance authority in
25 accordance with that statute: And provided further, That the aggregate amount of all such
26 revenue bonds issued shall not exceed the amount that may be repaid with amounts appro-
27 priated for the fiscal years during the period from July 1, 1997, through June 30, 2012, that
28 do not exceed the amount of $14,000,000 for the fiscal year ending June 30, 1998, and the
29 amount of $15,000,000 for any fiscal year thereafter during such period, excluding any
30 reappropriation of any such amount: And provided further, That all moneys received from
31 issuance of any such bonds shall be deposited in the state treasury and credited to this fund.
32 (d) There is appropriated for the above agency from the Kansas ed-
33 ucational building fund for the fiscal year or fiscal years specified and for
34 the capital improvement project or projects specified as follows:
35 Debt service--revenue bonds issued for major remodeling and new construction projects
36 at state educational institutions
37 For the fiscal year ending June 30, 1998$14,000,000
38 For the fiscal year ending June 30, 1999[nt$15,000,000
39 For the fiscal year ending June 30, 2000[nt$15,000,000
40 (e) The appropriations made by this section shall not be subject to
41 the provisions of K.S.A. 46-155 and amendments thereto.
42 Sec. 2. Section 13 of chapter 259 of the 1996 Session Laws of Kansas

1 is hereby repealed.
2 Sec. 3. This act shall take effect and be in force from and after its
3 publication in the Kansas register.
