9 AN ACT concerning certain water districts; relating to the organization
10 and establishment thereof; amending K.S.A. 19-3502 and repealing the
11 existing section.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. K.S.A. 19-3502 is hereby amended to read as follows: 19-
15 3502. One or more water districts, for the purpose of this act, may be
16 organized, created and established in the manner hereinafter provided in
17 any territory located in Miami, Franklin, Johnson and Wyandotte coun-
18 ties. Such water district or districts shall be located in territory outside
19 the limits of any territory served by or included within the limits of any
20 previously organized municipally-owned and operated public water sup-
21 ply and distribution system. Such water district or districts shall be or-
22 ganized, created and established without regard to county, township or
23 city boundaries and no such counties, townships or cities in any territory
24 in which a duly organized water district is located shall have or exercise
25 any jurisdiction or control over the administration of such water district,
26 except as specifically provided herein. Nor shall any such No city, town-
27 ship, or county shall create, organize or establish any municipally-owned
28 and operated water supply and distribution system in any territory actually
29 served, supplied or serviced by within the boundaries of any water district
30 created under this act. No other water utility operating within or without
31 the state shall serve or supply water for use within the boundaries of any
32 water district created under this act without the approval of the governing
33 body of such water district.
34 Each of such water districts shall be quasi-municipal body corporate
35 with the power of eminent domain, which shall be exercised in the man-
36 ner provided in K.S.A. 26-501 to 26-517, inclusive;, and amendments
37 thereto. Such districts shall have power to enter into contracts; to sue and
38 be sued; to establish, construct, purchase, operate and maintain a water
39 supply and distribution system; to fix water rates; and to issue revenue
40 bonds in the manner hereinafter provided to pay for the establishment,
41 construction, purchase and operation of a water supply and distribution
42 system or systems.
43 Sec. 2. K.S.A. 19-3502 is hereby repealed.

1 Sec. 3. This act shall take effect and be in force from and after its
2 publication in the statute book.
