9 AN ACT relating to funding and administration of death benefits for
10 certain state officers or employees; authorizing the secretary of ad-
11 ministration to provide such benefits.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. (a) The secretary of administration is authorized to pro-
15 vide the following from the closure term life insurance fund:
16 (1) The death benefits authorized by K.S.A. 1996 Supp. 75-4373, and
17 amendments thereto, on a self-insured basis; and
18 (2) the costs of self-administering such benefits or of contracting with
19 a third party for administration of the benefits.
20 (b) Upon request of the secretary of administration, the director of
21 accounts and reports shall make periodic transfers during fiscal year 1997
22 and fiscal year 1998 in amounts specified by the secretary of administra-
23 tion from the state hospital closure account of the state general fund at
24 the department of social and rehabilitation services to the closure term
25 life insurance fund of the department of administration.
26 (c) Upon certification by the secretary of administration to the direc-
27 tor of accounts and reports that the unencumbered balance in the closure
28 term life insurance fund is insufficient to pay an amount for which the
29 fund is liable and that there are insufficient funds in the state hospital
30 closure account to transfer pursuant to subsection (b), the director of
31 accounts and reports shall transfer an amount equal to the insufficiency
32 from the state general fund to the closure term life insurance fund.
33 (d) If the death benefits authorized by K.S.A. 1996 Supp. 75-4373,
34 and amendments thereto, are provided on a self-insured basis pursuant
35 to subsection (a), the net amount of the death benefit shall be equal to
36 150% of the annual rate of compensation of the covered state officer or
37 employee, as of the date the covered state officer or employee is laid off.
38 Sec. 2. This act shall take effect and be in force from and after its
39 publication in the statute book.
