12 AN ACT concerning school district finance; revising certain definitions;
13 affecting the determination of low enrollment and correlation weight-
14 ings; amending K.S.A. 1996 Supp. 72-6407, 72-6412, 72-6412a, 72-
15 6442 and 72-6442a and repealing the existing sections.

17 Be it enacted by the Legislature of the State of Kansas:
18 Section 1. K.S.A. 1996 Supp. 72-6407 is hereby amended to read as
19 follows: 72-6407. (a) ``Pupil'' means any person who is regularly enrolled
20 in a district and attending kindergarten or any of the grades one through
21 12 maintained by the district or who is regularly enrolled in a district and
22 attending kindergarten or any of the grades one through 12 in another
23 district in accordance with an agreement entered into under authority of
24 K.S.A. 72-8233, and amendments thereto, or who is regularly enrolled in
25 a district and attending special education services provided for preschool-
26 aged exceptional children by the district. Except as otherwise provided
27 in this subsection, a pupil in attendance full time shall be counted as one
28 pupil. A pupil in attendance part time shall be counted as that proportion
29 of one pupil (to the nearest 1/10) that the pupil's attendance bears to full-
30 time attendance. A pupil attending kindergarten shall be counted as 1/2
31 pupil. A pupil enrolled in and attending an institution of postsecondary
32 education which is authorized under the laws of this state to award aca-
33 demic degrees shall be counted as one pupil if the pupil's postsecondary
34 education enrollment and attendance together with the pupil's atten-
35 dance in either of the grades 11 or 12 is at least 5/6 time, otherwise the
36 pupil shall be counted as that proportion of one pupil (to the nearest 1/10)
37 that the total time of the pupil's postsecondary education attendance and
38 attendance in grade 11 or 12, as applicable, bears to full-time attendance.
39 A pupil enrolled in and attending an area vocational school, area voca-
40 tional-technical school or approved vocational education program shall be
41 counted as one pupil if the pupil's vocational education enrollment and
42 attendance together with the pupil's attendance in any of grades nine
43 through 12 is at least 5/6 time, otherwise the pupil shall be counted as that

1 proportion of one pupil (to the nearest 1/10) that the total time of the
2 pupil's vocational education attendance and attendance in any of grades
3 nine through 12 bears to full-time attendance. A pupil enrolled in a dis-
4 trict and attending special education services, except special education
5 services for preschool-aged exceptional children, provided for by the dis-
6 trict shall be counted as one pupil. A pupil enrolled in a district and
7 attending special education services for preschool-aged exceptional chil-
8 dren provided for by the district shall be counted as 1/2 pupil. A pupil in
9 the custody of the secretary of social and rehabilitation services and en-
10 rolled in unified school district No. 259, Sedgwick county, Kansas, but
11 housed, maintained, and receiving educational services at the Judge James
12 V. Riddel Boys Ranch, shall be counted as two pupils. A pupil residing at
13 the Flint Hills job corps center shall not be counted. A pupil confined in
14 and receiving educational services provided for by a district at a juvenile
15 detention facility shall not be counted. A pupil enrolled in a district but
16 housed, maintained, and receiving educational services at a state institu-
17 tion shall not be counted.
18 (b) ``Preschool-aged exceptional children'' means exceptional chil-
19 dren, except gifted children, who have attained the age of three years but
20 are under the age of eligibility for attendance at kindergarten.
21 (c) ``At-risk pupils'' means pupils who are eligible for free meals un-
22 der the national school lunch act and for whom a district maintains an
23 approved at-risk pupil assistance plan.
24 (d) ``Enrollment'' means, for districts scheduling the school days or
25 school hours of the school term on a trimestral or quarterly basis, the
26 number of pupils regularly enrolled in the district on September 20 plus
27 the number of pupils regularly enrolled in the district on February 20
28 less the number of pupils regularly enrolled on February 20 who were
29 counted in the enrollment of the district on September 20; and for dis-
30 tricts not hereinbefore specified, the number of pupils regularly enrolled
31 in the district on September 20. Notwithstanding the foregoing, if en-
32 rollment in a district in any school year has decreased from enrollment
33 in the preceding school year, enrollment of the district in the current
34 school year may be computed by adding one-half the number of pupils
35 by which enrollment in the current school year has decreased from en-
36 rollment in the preceding school year to enrollment in the current school
37 year, except that such computation shall not be applied to decreases in
38 enrollment in the current school year that are in excess of 4% of enroll-
39 ment in the preceding school year.
40 (e) ``Adjusted enrollment'' means enrollment adjusted by adding at-
41 risk pupil weighting, program weighting, low enrollment weighting, if any,
42 correlation weighting, if any, school facilities weighting, if any, and trans-
43 portation weighting to enrollment.

1 (f) ``At-risk pupil weighting'' means an addend component assigned
2 to enrollment of districts on the basis of enrollment of at-risk pupils.
3 (g) ``Program weighting'' means an addend component assigned to
4 enrollment of districts on the basis of pupil attendance in educational
5 programs which differ in cost from regular educational programs.
6 (h) ``Low enrollment weighting'' means, for any school year in which
7 the provisions of K.S.A. 1996 Supp. 72-6442a, and amendments thereto,
8 are operational, an addend component assigned to enrollment of districts
9 having 1,800-1,899 1,700-1,799 or under enrollment on the basis of costs
10 attributable to maintenance of educational programs by such districts in
11 comparison with costs attributable to maintenance of educational pro-
12 grams by districts having 1,800-1,899 1,700-1,799 or over enrollment, for
13 the school year in which the provisions of K.S.A. 1996 Supp. 72-6442,
14 and amendments thereto, become operational and each school year there-
15 after, an addend component assigned to enrollment of districts having
16 under 1,800 1,700 enrollment on the basis of costs attributable to main-
17 tenance of educational programs by such districts in comparison with
18 costs attributable to maintenance of educational programs by districts
19 having 1,800 1,700 or over enrollment.
20 (i) ``School facilities weighting'' means an addend component as-
21 signed to enrollment of districts on the basis of costs attributable to com-
22 mencing operation of new school facilities. School facilities weighting may
23 be assigned to enrollment of a district only if the district has adopted a
24 local option budget and budgeted therein the total amount authorized for
25 the school year. School facilities weighting may be assigned to enrollment
26 of the district only in the school year in which operation of a new school
27 facility is commenced and in the next succeeding school year.
28 (j) ``Transportation weighting'' means an addend component assigned
29 to enrollment of districts on the basis of costs attributable to the provision
30 or furnishing of transportation.
31 (k) ``Correlation weighting'' means, for any school year in which the
32 provisions of K.S.A. 1996 Supp. 72-6442a, and amendments thereto, are
33 operational, an addend component assigned to enrollment of districts
34 having 1,800-1,899 1,700-1,799 or over enrollment on the basis of costs
35 attributable to maintenance of educational programs by such districts as
36 a correlate to low enrollment weighting assigned to enrollment of districts
37 having 1,800-1,899 1,700-1,799 or under enrollment, for the school year
38 in which the provisions of K.S.A. 1996 Supp. 72-6442, and amendments
39 thereto, become operational and each school year thereafter, an addend
40 component assigned to enrollment of districts having 1,800 1,700 or over
41 enrollment on the basis of costs attributable to maintenance of educa-
42 tional programs by such districts as a correlate to low enrollment weight-
43 ing assigned to enrollment of districts having under 1,800 1,700 enroll-

1 ment.
2 Sec. 2. K.S.A. 1996 Supp. 72-6412 is hereby amended to read as
3 follows: 72-6412. For the 2001-02 school year in which the provisions of
4 K.S.A. 1996 Supp. 72-6442 become operational and each school year
5 thereafter, the low enrollment weighting of each district with under 1,800
6 1,700 enrollment shall be determined by the state board as follows:
7 (a) Determine the amount of the median budget per pupil for the
8 1991-92 school year of districts with 75-125 enrollment in such school
9 year;
10 (b) determine the amount of the median budget per pupil for the
11 1991-92 school year of districts with 200-399 enrollment in such school
12 year;
13 (c) determine the amount of the median budget per pupil for the
14 1991-92 school year of districts with 1,900 or over enrollment;
15 (d) prescribe a schedule amount for each of the districts by preparing
16 a schedule based upon an accepted mathematical formula and derived
17 from a linear transition between (1) the median budgets per pupil deter-
18 mined under (a) and (b), and (2) the median budgets per pupil deter-
19 mined under (b) and (c). The schedule amount for districts with 0-99
20 enrollment is an amount equal to the amount of the median budget per
21 pupil determined under (a). The schedule amount for districts with 100-
22 299 enrollment is the amount derived from the linear transition under
23 (1). The schedule amount for districts with 300-1,899 enrollment is the
24 amount derived from the linear transition under (2);
25 (e) for districts with 0-99 enrollment:
26 (1) Subtract the amount determined under (c) from the amount de-
27 termined under (a);
28 (2) divide the remainder obtained under (1) by the amount deter-
29 mined under (c);
30 (3) multiply the quotient obtained under (2) by the enrollment of the
31 district in the current school year. The product is the low enrollment
32 weighting of the district;
33 (f) for districts with 100-299 enrollment:
34 (1) Subtract the amount determined under (c) from the schedule
35 amount of the district;
36 (2) divide the remainder obtained under (1) by the amount deter-
37 mined under (c);
38 (3) multiply the quotient obtained under (2) by the enrollment of the
39 district in the current school year. The product is the low enrollment
40 weighting of the district;
41 (g) for districts with 300-1,799 300-1,699 enrollment:
42 (1) Subtract the amount determined under (c) from the schedule
43 amount of the district;

1 (2) divide the remainder obtained under (1) by the amount deter-
2 mined under (c);
3 (3) multiply the quotient obtained under (2) by the enrollment of the
4 district in the current school year. The product is the low enrollment
5 weighting of the district.
6 Sec. 3. K.S.A. 1996 Supp. 72-6412a is hereby amended to read as
7 follows: 72-6412a. (a) For any the school year years in which the provi-
8 sions of K.S.A. 1996 Supp. 72-6442a, and amendments thereto, are op-
9 erational, the state board shall determine the districts having 1,800-1,899
10 1,700-1,799 or under enrollment that are entitled to assignment of low
11 enrollment weighting and shall determine the low enrollment weighting
12 of each such district as follows:
13 (1) Determine the amount of the median budget per pupil for the
14 1991-92 school year of districts with 75-125 enrollment in such school
15 year;
16 (2) determine the amount of the median budget per pupil for the
17 1991-92 school year of districts with 200-399 enrollment in such school
18 year;
19 (3) determine the amount of the median budget per pupil for the
20 1991-92 school year of districts with 1,900 or over enrollment;
21 (4) prescribe a schedule amount for each of the districts by preparing
22 a schedule based upon an accepted mathematical formula and derived
23 from a linear transition between (A) the median budgets per pupil de-
24 termined under (1) and (2), and (B) the median budgets per pupil de-
25 termined under (2) and (3). The schedule amount for districts with 0-99
26 enrollment is an amount equal to the amount of the median budget per
27 pupil determined under (1). The schedule amount for districts with 100-
28 299 enrollment is the amount derived from the linear transition under
29 (A). The schedule amount for districts with 300-1,899 enrollment is the
30 amount derived from the linear transition under (B);
31 (5) for districts with 0-99 enrollment:
32 (A) Subtract the amount determined under (3) from the amount de-
33 termined under (1);
34 (B) divide the remainder obtained under (A) by the amount deter-
35 mined under (3);
36 (C) multiply the quotient obtained under (B) by the enrollment of
37 the district in the current school year. The product is the low enrollment
38 weighting of the district;
39 (6) for districts with 100-299 enrollment:
40 (A) Subtract the amount determined under (3) from the schedule
41 amount of the district;
42 (B) divide the remainder obtained under (A) by the amount deter-
43 mined under (3);

1 (C) multiply the quotient obtained under (B) by the enrollment of
2 the district in the current school year. The product is the low enrollment
3 weighting of the district;
4 (7) for districts with 300 enrollment to districts within the 1,800-1,899
5 1,700-1,799 enrollment interval that are determined to be entitled to
6 assignment of low enrollment weighting:
7 (A) Subtract the amount determined under (3) from the schedule
8 amount of the district;
9 (B) divide the remainder obtained under (A) by the amount deter-
10 mined under (3);
11 (C) multiply the quotient obtained under (B) by the enrollment of
12 the district in the current school year. The product is the low enrollment
13 weighting of the district.
14 (b) For the purpose of determining the districts within the 1,800-
15 1,899 1,700-1,799 enrollment interval that are entitled to assignment of
16 low enrollment weighting, the state board shall determine the lowest en-
17 rollment district that is entitled to assignment of correlation weighting
18 and subtract one. Districts with enrollment equal to or under the re-
19 mainder are entitled to assignment of low enrollment weighting.
20 (c) The provisions of this section shall take effect on July 1, 1995, and
21 shall be in force until the provisions of K.S.A. 1996 Supp. 72-6442 become
22 operational expire on June 30, 2001.
23 Sec. 4. K.S.A. 1996 Supp. 72-6442 is hereby amended to read as
24 follows: 72-6442. (a) In any each school year commencing after any school
25 year in which the provisions of K.S.A. 1996 Supp. 72-6442a are opera-
26 tional, if the state board determines that the amount of appropriations
27 for general state aid, inclusive of the amount determined necessary for
28 effectuation of this section, is sufficient to pay in full the amount each
29 district is entitled to receive for the 2000-01 school year, the provisions
30 of this section shall become operational and the correlation weighting of
31 each district with 1,800 1,700 or over enrollment shall be determined by
32 the state board as follows:
33 (1) (a) Determine the schedule amount for a district with 1,800 1,700
34 enrollment as derived from the linear transition under (d) of K.S.A. 72-
35 6412, and amendments thereto, and subtract the amount determined
36 under (c) of K.S.A. 72-6412, and amendments thereto, from the schedule
37 amount so determined;
38 (2) (b) divide the remainder obtained under (1) (a) by the amount
39 determined under (c) of K.S.A. 72-6412, and amendments thereto, and
40 multiply the quotient by the enrollment of the district in the current
41 school year. The product is the correlation weighting of the district.
42 (b) The provisions of this section shall take effect and be in force
43 from and after July 1, 1995.

1 Sec. 5. K.S.A. 1996 Supp. 72-6442a is hereby amended to read as
2 follows: 72-6442a. (a) In any the 1997-98 through 2000-01 school year
3 commencing after June 30, 1995, if the state board determines that the
4 amount of appropriations for general state aid, inclusive of the amount
5 determined necessary for total or incremental effectuation of this section,
6 is sufficient to pay in full the amount each district is entitled to receive
7 for the school year, the provisions of this section shall become operational
8 years, the state board shall determine the districts having 1,800-1,899
9 1,700-1,799 or over enrollment that are entitled to assignment of corre-
10 lation weighting and shall determine the correlation weighting of each
11 such district as follows:
12 (1) Determine the schedule amount as derived from the linear tran-
13 sition under (a)(4) of K.S.A. 1996 Supp. 72-6412a for the district with the
14 lowest enrollment, within the 1,800-1,899 1,700-1,799 enrollment inter-
15 val, that is determined to be entitled to assignment of correlation weight-
16 ing and subtract the amount determined under (a)(3) of K.S.A. 1996
17 Supp. 72-6412a, and amendments thereto, from the schedule amount so
18 determined;
19 (2) divide the remainder obtained under (1) by the amount deter-
20 mined under (a)(3) of K.S.A. 1996 Supp. 72-6412a, and amendments
21 thereto, and multiply the quotient by the enrollment of each district en-
22 titled to assignment of correlation weighting in the current school year.
23 The product is the correlation weighting of each such district.
24 (b) Total Effectuation in the first 1997-98 school year in which of the
25 provisions of this section are operational means assignment of correlation
26 weighting to enrollment of districts with 1,875 1,800 or over enrollment.
27 Incremental effectuation in the first school year in which the provisions
28 of this section are operational means assignment of correlation weighting
29 to enrollment of districts with 1,875-1,899 or over enrollment as deter-
30 mined by the state board. The lowest enrollment district within the 1,875-
31 1,899 enrollment interval that is entitled to assignment of correlation
32 weighting shall be determined by the state board on the basis of and
33 commensurate with the amount of appropriations available for effectua-
34 tion of the provisions of this section. Total Effectuation in school years
35 subsequent to the first school year in which of the provisions of this sec-
36 tion are operational in the 1998-99, 1999-2000 and 2000-01 school years
37 means assignment of correlation weighting to enrollment of districts with
38 enrollment equal to or over the district with the lowest enrollment to
39 which correlation weighting was assigned in the preceding school year
40 minus 25. Incremental effectuation in school years subsequent to the first
41 school year in which the provisions of this section are operational means
42 assignment of correlation weighting to enrollment of districts with en-
43 rollment equal to or over the district with the lowest enrollment to which

1 correlation weighting was assigned in the preceding school year minus a
2 number to be determined by the state board on the basis of and com-
3 mensurate with the amount of appropriations available for effectuation
4 of the provisions of this section.
5 (c) The provisions of this section shall take effect on July 1, 1995, and
6 shall be in force until the provisions of K.S.A. 1996 Supp. 72-6442 become
7 operational expire on June 30, 2001.
8 Sec. 6. K.S.A. 1996 Supp. 72-6407, 72-6412, 72-6412a, 72-6442 and
9 72-6442a are hereby repealed.
10 Sec. 7. This act shall take effect and be in force from and after its
11 publication in the statute book.
