10 AN ACT concerning state governmental ethics; relating to expenditure 11 reports of lobbyists; amending K.S.A. 46-269 and repealing the existing 12 section. 13 14 Be it enacted by the Legislature of the State of Kansas: 15 Section 1. K.S.A. 46-269 is hereby amended to read as follows: 46- 16 269. Each report under K.S.A. 46-268, and amendments thereto, shall 17 disclose the following: 18 (a) The full name and address of each person who has paid compen- 19 sation for lobbying to the lobbyist or has paid for expenses of lobbying by 20 the lobbyist during the period reported. 21 (b) The aggregate amount or value of all expenditures made, except 22 for expenses of general office overhead, by the lobbyist or by the lobbyist's 23 employer for or in direct relation to lobbying during the reporting period, 24 if such expenditures exceed $100. Individual expenditures of less than $2 25 shall not be required to be reported under this subsection. Such expend- 26 itures shall be reported according to the following categories of expend- 27 itures: 28 (1) Food and beverages provided as hospitality; 29 (2) entertainment, gifts, honoraria or payments; 30 (3) mass media communications; 31 (4) recreation provided as hospitality; 32 (5) communications for the purpose of influencing legislative or ex- 33 ecutive action; and 34 (6) all other reportable expenditures made in the performance of 35 services as a lobbyist. 36 With regard to expenditures for entertainment or hospitality which is 37 primarily recreation, food and beverages, only amounts expended on a 38 state officer or employee or on such officer or employee's spouse shall 39 be considered to be for or in direct relation to lobbying. Notwithstanding 40 the requirements of this subsection and subsection (c) (d), no lobbyist 41 shall be responsible to report any expenditure by the lobbyist's employer 42 of which such person has no knowledge. 43 (c) The name of each recipient of hospitality in the form of recreation SB 344

 1  and the amount of each expenditure for such purpose upon such individ-
 2  ual.
 3    (c) (d)  Whenever an individual lobbyist contributes to a single special
 4  event, such lobbyist shall report only the aggregate amount or value of
 5  the expenditure contributed by such lobbyist.
 6    (d) (e)  Whenever more than one lobbyist is employed by a single
 7  employer, the reports required by this section relating to such employer
 8  shall be made by only one such lobbyist and that lobbyist shall be the
 9  lobbyist who is most directly connected with the particular expenditure
10  or gift, honoraria or payment. No expenditure or gift, honoraria or pay-
11  ment required to be reported by this section shall be reported by more
12  than one lobbyist.
13    (e) (f)  Records in support of every report or statement filed shall be
14  maintained and preserved by the lobbyist for a period of five years from
15  the date of the filing of such report or statement and may be inspected
16  under conditions determined by the commission.
17    Sec. 2.  K.S.A. 46-269 is hereby repealed.
18    Sec. 3.  This act shall take effect and be in force from and after its
19  publication in the statute book.
