10 AN ACT concerning state governmental ethics; relating to lobbying and
11 lobbyists; amending K.S.A. 46-232 and 46-267 and repealing the ex-
12 isting sections.

14 Be it enacted by the Legislature of the State of Kansas:
15 Section 1. K.S.A. 46-232 is hereby amended to read as follows: 46-
16 232. (a) No state officer or employee shall engage in lobbying his such
17 officer's or employee's own state agency, if he such officer or employee
18 accepts compensation specifically attributable to such lobbying, other
19 than that provided for the performance of his such officer's or employee's
20 official duties. Nothing in this section shall prohibit a state officer or
21 employee from lobbying without compensation other than that which he
22 such officer or employee is entitled to receive for performance of his such
23 officer's or employee's official duties.
24 (b) From and after January 1, 1998, no individual shall engage in
25 lobbying or be employed as a lobbyist within one year following: (1) The
26 date of resignation from or the expiration of a term of any state office to
27 which the individual was appointed by the governor; or (2) the date of
28 resignation from office or the expiration of a term of office for which such
29 individual was elected or appointed to membership in the state legislature.
30 Sec. 2. K.S.A. 46-267 is hereby amended to read as follows: 46-267.
31 (a) No person shall pay or accept or agree to pay or accept or arrange
32 for a third party to pay or agree to pay present, future, promised or
33 contingent compensation, or any part thereof, for lobbying which is con-
34 tingent upon the result achieved or attained.
35 (b) No person shall pay or accept or agree to pay or accept present,
36 future, promised or contingent compensation, or any part thereof, for the
37 referral of a person or persons to a lobbyist for lobbying services.
38 (c) No lobbying contract or agreement shall be valid or enforceable
39 in a court of law unless it is in writing, signed by all parties thereto and
40 was executed prior to the lobbyist's commencement of lobbying for the
41 represented person under such contract or agreement. Any such lobbying
42 contract or agreement shall be invalid and unenforceable unless such lob-
43 byist complies with all lobbying laws and lobbyist reporting requirements

1 of this act.
2 Sec. 3. K.S.A. 46-232 and 46-267 are hereby repealed.
3 Sec. 4. This act shall take effect and be in force from and after its
4 publication in the statute book.
