 9  AN ACT concerning elections; relating to the withdrawal from nomina-
10    tion; amending K.S.A. 1996 Supp. 25-306b and repealing the existing
11    section.

13  Be it enacted by the Legislature of the State of Kansas:
14    Section 1.  K.S.A. 1996 Supp. 25-306b is hereby amended to read as
15  follows: 25-306b. (a) Any No person who has been nominated by any
16  means whatsoever for any national, state, county or township office may
17  cause such person's name to be withdrawn from nomination by a request
18  in writing, signed by the person and acknowledged before an officer qual-
19  ified to take acknowledgments of deeds. Any such request shall be filed
20  with the secretary of state in the case of national and state offices and
21  with the county election officer in the case of county and township offices.
22  Except as provided in subsection (b) of this section, in the case of national
23  and state offices, any such request shall be filed within seven days, in-
24  cluding Saturdays, Sundays and holidays, after the meeting of the state
25  board of canvassers for the final canvass of primary election provided for
26  in K.S.A. 25-3205 and amendments thereto. Except as provided in sub-
27  section (b) of this section, in the case of county and township offices, any
28  such request shall be filed within 10 days after the meeting of the county
29  board of canvassers to canvass the primary election as provided in K.S.A.
30  25-3104 and amendments thereto. No name withdrawn as provided in
31  this section shall be printed on the ballots for such office for the general
32  election.
33    (b)  Whenever there has been a vacancy which occurred from a with-
34  drawal under this section, and such vacancy was filled according to law,
35  the person filling the vacancy may cause such person's name to be with-
36  drawn from nomination in the manner provided in subsection (a) of this
37  section at any time prior to the 40th day before the general election after
38  the day of the primary election.
39    Sec. 2.  K.S.A. 1996 Supp. 25-306b is hereby repealed.
40    Sec. 3.  This act shall take effect and be in force from and after its
41  publication in the statute book.
