15 AN ACT concerning campaign finance; relating to the use of public funds;
16 amending K.S.A. 25-4169a and repealing the existing section.

18 Be it enacted by the Legislature of the State of Kansas:
19 Section 1. K.S.A. 25-4169a is hereby amended to read as follows: 25-
20 4169a. (a) No officer or employee of the state of Kansas, any county, any
21 unified school district having 35,000 or more pupils regularly enrolled
22 having 35,000 or more pupils regularly enrolled, any city of the first
23 class or the board of public utilities of the city of Kansas City, Kansas,
24 shall use or authorize the use of public funds or public vehicles, machin-
25 ery, equipment or supplies or other property of any such governmental
26 agency or the time of any officer or employee of any such governmental
27 agency, for which the officer or employee is compensated by such gov-
28 ernmental agency, for the purpose of influencing the nomination or elec-
29 tion of any candidate to state office or local office. The provisions of this
30 section prohibiting the use of time of any officer or employee for such
31 purposes shall not apply to an incumbent officer campaigning for nomi-
32 nation or reelection to a succeeding term to such office or to members
33 of the personal staff of any elected officer. The provisions of this section
34 prohibiting the use of property of any such governmental agency
35 shall not apply to the use of facilities of any such governmental
36 agency for the holding of public forums or[,] debates at which all
37 opposing candidates for an office are invited [or events to which all
38 candidates have equal access].
39 (b) Any person violating the provisions of this section shall be guilty
40 of a class C misdemeanor.
41 New Sec. 2. (a) No officer or employee of any unified school district,
42 having less than 35,000 pupils enrolled in the preceding school year, shall
43 use or authorize the use of public funds or public vehicles, machinery,

1 equipment, supplies or other property of such district or the time of any
2 officer or employee of any such district, for which the officer of employee
3 is compensated by such district, for the purpose of influencing the nom-
4 ination or election of any candidate to a school district office or other
5 local office or state office. The provisions of this section prohibiting the
6 use of school property shall not apply to the use of school facilities for
7 the holding of public forums or[,] debates at which all opposing candi-
8 dates for an office are invited [or events to which all candidates have
9 equal access].
10 (b) Any person violating the provisions of this section shall be guilty
11 of a class C misdemeanor.
12 Sec. 2 [3]. K.S.A. 25-4169a is hereby repealed.
13 Sec. 3 [4]. This act shall take effect and be in force from and after
14 its publication in the statute book.
