9 AN ACT concerning public works projects for state agencies; prescribing
10 payment of minimum wages for work thereon and preferences for
11 certain employees to work thereon.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. (a) Each contract entered into by any state agency for any
15 nonfederal aid, public works project shall be based on bid or contract
16 specifications prescribing and requiring that employees of any contractor
17 or subcontractor shall be paid not less than the hourly wages, including
18 fringe benefits, paid to corresponding classes of laborers and mechanics
19 employed on similar projects in the county where the project is to be
20 performed. Such minimum wage shall be the wage paid to the majority
21 of the laborers or mechanics, unless the same wages are not paid to a
22 majority, in which case the minimum wage shall be the average wages
23 paid, weighted by the total employed in the classification. In the alter-
24 native, the minimum wage shall be that determined under federal law
25 which would be required to be paid on federally funded projects at the
26 location of the public works project.
27 (b) Employees employed by contractors or subcontractors in the ex-
28 ecution of any nonfederal aid, public works project contract with any state
29 agency shall be paid not less than the wages as determined pursuant to
30 subsection (a).
31 (c) All work done on public works projects owned by or built for any
32 state agency shall be done by Kansas resident employees whenever pos-
33 sible. No employees working on such public works projects who have
34 inalienable voting rights in the United States of America shall be displaced
35 from working on such public works projects by any employees who do
36 not have inalienable voting rights in the United States of America.
37 Sec. 2. This act shall take effect and be in force from and after its
38 publication in the statute book.
