9 AN ACT concerning the director of the division of environment of the
10 department of health and environment; amending K.S.A. 1996 Supp.
11 75-5605 and repealing the existing section.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. K.S.A. 1996 Supp. 75-5605 is hereby amended to read as
15 follows: 75-5605. There is hereby established within and as a part of the
16 department of health and environment a division of environment, the
17 head of which shall be the director of the division of environment. Under
18 the supervision of the secretary of health and environment, the director
19 of the division of environment shall administer the division of environ-
20 ment. The director shall have experience and educational training in the
21 field of environment be licensed, or be qualified to be licensed, in this
22 state as a professional engineer and shall hold a masters degree in envi-
23 ronmental engineering. In addition, the director shall have substantial
24 experience in administering environmental programs. The secretary of
25 health and environment shall appoint the director of the division of en-
26 vironment who shall serve at the pleasure of the secretary. The first person
27 appointed to such office after the effective date of this act shall be ap-
28 pointed subject to confirmation by the senate as provided in K.S.A. 75-
29 4315b and amendments thereto and shall serve for a term of four years
30 from and after the date of appointment, and thereafter at the pleasure of
31 the secretary. In the case of a vacancy in the office of the director of the
32 division of health, the secretary of health and environment shall appoint
33 a successor to fill the vacancy for the unexpired term. The director shall
34 be in the unclassified service and shall receive an annual salary fixed by
35 the secretary and approved by the state finance council. If a director was
36 an employee of the state of Kansas in a regular classified position under
37 the Kansas civil service act at the time of selection as director, such per-
38 son, upon the conclusion of service as director, shall be returned to the
39 regular classified position under the Kansas civil service act such person
40 held at the time of appointment as director, and if such position be filled
41 at that time, a temporary additional position shall be created for such
42 person until such time as a vacancy exists in such position. While serving
43 in such temporary additional position the former director shall continue

1 to be a contributing member of the retirement system under which such
2 person was covered while serving as director.
3 Sec. 2. K.S.A. 1996 Supp. 75-5605 is hereby repealed.
4 Sec. 3. This act shall take effect and be in force from and after its
5 publication in the statute book.
