 9  AN ACT authorizing the secretary of state to grant an easement to Finney
10    county for the purpose of construction and maintenance of a stream
11    crossing.

13  Be it enacted by the Legislature of the State of Kansas:
14    Section 1.  (a) The secretary of state is hereby authorized to grant a
15  construction and maintenance easement to Finney county in, along and
16  across the Arkansas river at a location in the Southeast 1/4 of the Northeast
17   1/4 of the Northwest 1/4 of Section 23, Township 24 South, Range 33 West,
18  in Finney county, Kansas, for the purpose of constructing and maintaining
19  a stream crossing.
20    (b)  The easement authorized by this section shall be conditioned on
21  Finney county's assuming full responsibility for the use of such easement
22  and holding the state of Kansas harmless therefor. The easement shall
23  terminate if the land is no longer used for the purpose for which the
24  easement was granted.
25    (c)  Finney county is hereby authorized to acquire the easement de-
26  scribed in subsection (a) and to use the easement for the purpose of
27  constructing and maintaining a stream crossing and to assume full re-
28  sponsibility for such use and hold the state of Kansas harmless therefor.
29    Sec. 2.  This act shall take effect and be in force from and after its
30  publication in the Kansas register.
