 9  AN ACT permitting the state corporation commission to conduct a pilot
10    project through Midwest Electric, Inc.

12  Be it enacted by the Legislature of the State of Kansas:
13    Section 1.  The state corporation commission may permit electric and
14  natural gas unbundling and open access demonstration projects within
15  the Midwest Energy, Inc. certificated service territory. Such projects shall
16  include all classes of retail customers (residential, commercial, industrial,
17  oil field and irrigation), and participation by each customer shall be on a
18  voluntary basis. Such projects should result in market place competition
19  for commodity supply while maintaining state corporation commission
20  regulation over delivery, service quality and safety issues. The utility shall
21  propose methods of load aggregation for small customers, strategies for
22  the mitigation of stranded costs and strategies to minimize tax impacts
23  on local governments. The utility shall solicit customer suggestions in the
24  design of the pilot project.
25    Sec. 2.  This act shall take effect and be in force from and after its
26  publication in the statute book.
