10 AN ACT concerning crimes and punishments; defining and classifying
11 the crime of aggravated criminal threat[; relating to giving a false
12 alarm; amending K.S.A. 21-4110 and repealing the existing
13 section].

15 Be it enacted by the Legislature of the State of Kansas:
16 Section 1. (a) Aggravated criminal threat is the commission of one
17 or more crimes of criminal threat, as defined in K.S.A. 21-3419 and
18 amendments thereto, when a public, commercial or industrial building[,
19 place of assembly or facility of transportation] is evacuated as a result
20 of the threat or threats.
21 (b) Aggravated criminal threat is a severity level 6, person felony
22 when the loss of productivity measured by the total wages and salaries of
23 all persons evacuated as a result of the threat or threats for the period of
24 evacuation is less than $500.
25 (c) Aggravated criminal threat is a severity level 5, person felony when
26 the loss of productivity measured by the total wages and salaries of all
27 persons evacuated as a result of the threat or threats for the period of
28 evacuation is at least $500 but less than $25,000.
29 (d) Aggravated criminal threat is a severity level 4, person felony
30 when the loss of productivity measured by the total wages and salaries of
31 all persons evacuated as a result of the threat or threats for the period of
32 evacuation equals or exceeds $25,000.
33 [Sec. 2. K.S.A. 21-4110 is hereby amended to read as follows:
34 21-4110. (a) Giving a false alarm is:
35 [(1) Initiating or circulating a report or warning of an impending
36 bombing or other crime or catastrophe, knowing that the report or warn-
37 ing is baseless and under such circumstances that it is likely to cause
38 evacuation of a building, place of assembly or facility of public transport
39 or to cause public inconvenience or alarm;
40 [(2) (1) transmitting in any manner to the fire department of
41 any city, township or other municipality a false alarm of fire, know-
42 ing at the time of such transmission that there is no reasonable
43 ground for believing that such fire exists; or

1 [(3) (2) making a call in any manner for emergency service as-
2 sistance including police, fire, medical or other emergency service
3 provided under K.S.A. 12-5301 et seq., and amendments thereto,
4 knowing at the time of such call that there is no reasonable ground
5 for believing such assistance is needed.
6 [(b) Giving a false alarm is a class A nonperson misdemeanor.
7 [Sec. 3. K.S.A. 21-4110 is hereby repealed.]
8 Sec. 2. [4.] This act shall take effect and be in force from and after
9 its publication in the Kansas register.
