9 AN ACT concerning criminal procedure; relating to preliminary exami- 10 nations; admissibility of report of forensic examiner; amending K.S.A. 11 1996 Supp. 22-2902a and repealing the existing section. 12 13 Be it enacted by the Legislature of the State of Kansas: 14 Section 1. K.S.A. 1996 Supp. 22-2902a is hereby amended to read 15 as follows: 22-2902a. At any preliminary examination in which the results 16 of a forensic examination, analysis, comparison or identification prepared 17 by the Kansas bureau of investigation, the federal bureau of investigation, 18 the bureau of alcohol, tobacco and firearms of the United States depart- 19 ment of the treasury, the state secretary of health and environment, the 20 sheriff's department of Johnson, Shawnee or Sedgwick county, the police 21 department of the cities of Topeka or, Wichita or Overland Park, the 22 Sedgwick county regional forensic science center, the drug enforcement 23 administration, the air force of the United States, the navy of the United 24 States, the army of the United States or Bethany medical center, inc. 25 located in Kansas City, Kansas are to be introduced as evidence, the 26 report, or a copy of the report, of the findings of the forensic examiner 27 shall be admissible into evidence in the preliminary examination in the 28 same manner and with the same force and effect as if the forensic ex- 29 aminer who performed such examination, analysis, comparison or iden- 30 tification and prepared the report thereon had testified in person. 31 Sec. 2. K.S.A. 1996 Supp. 22-2902a is hereby repealed. 32 Sec. 3. This act shall take effect and be in force from and after its 33 publication in the statute book.
