 9  AN ACT concerning civil service; relating to personal conduct detrimen-
10    tal to state service; attorneys; amending K.S.A. 75-2949f and repealing
11    the existing section.

13  Be it enacted by the Legislature of the State of Kansas:
14    Section 1.  K.S.A. 75-2949f is hereby amended to read as follows: 75-
15  2949f. Grounds for dismissal, demotion or suspension of a permanent
16  employee for personal conduct detrimental to the state service include,
17  but are not limited to, the following:
18    (a)  Gross misconduct or conduct grossly unbecoming a state officer
19  or employee;
20    (b)  conviction of a criminal act;
21    (c)  immoral conduct;
22    (d)  willful abuse or misappropriation of state funds, materials, prop-
23  erty or equipment;
24    (e)  making a false statement of material fact in the employee's appli-
25  cation for employment or position description;
26    (f)  participation in any action that would in any way seriously disrupt
27  or disturb the normal operation of the agency, institution, department or
28  any other segment of state government;
29    (g)  trespassing on the property of any state official or employee for
30  the purpose of harassing or forcing dialogue or discussion from the oc-
31  cupants or owners of such property;
32    (h)  willful damage to or destruction of state property;
33    (i)  willful endangerment of the lives or property of others, or both;
34    (j)  possession of unauthorized firearms or other lethal weapons while
35  on the job;
36    (k)  performing duties in a brutal manner, or mistreating, neglecting
37  or abusing a patient or resident or other person in the employee's care;
38    (l)  refusal to accept a reasonable and proper assignment from an au-
39  thorized supervisor (insubordination);
40    (m)  being under the influence of alcohol or drugs while on the job;
41    (n)  knowingly releasing confidential information from official re-
42  cords;
43    (o)  use of the employee's state position, use of the employee's time

 1  on the state job or use of state property or facilities by the employee in
 2  connection with a political campaign;
 3    (p)  exhibiting other personal conduct detrimental to state service
 4  which could cause undue disruption of work or endanger the safety of
 5  persons or property of others, as may be determined by the appointing
 6  authority;
 7    (q)  gross carelessness or gross negligence;
 8    (r)  grossly improper use of state property; and
 9    (s)  sexual harassment arising out of or in connection with employ-
10  ment.; and
11    (t)  conduct which would subject the employee's supervising attorney
12  to discipline under the model rules of professional conduct as adopted by
13  the Kansas supreme court.
14    Sec. 2.  K.S.A. 75-2949f is hereby repealed.
15    Sec. 3.  This act shall take effect and be in force from and after its
16  publication in the statute book.
