10 AN ACT concerning the state board of healing arts; relating to temporary
11 permits issued under the occupational therapy practice act and respi-
12 ratory therapy practice act; amending K.S.A. 65-5408 and 65-5508 and
13 repealing the existing sections.

15 Be it enacted by the Legislature of the State of Kansas:
16 Section 1. K.S.A. 65-5408 is hereby amended to read as follows: 65-
17 5408. (a) The board shall waive the examination, education and experi-
18 ence requirements and grant registration to any person who applies for
19 registration on or before July 1, 1987, who pays the application fee and
20 who was certified prior to the effective date of this act as an occupational
21 therapist registered (O.T.R.) or a certified occupational therapy assistant
22 (C.O.T.A.) by the American occupational therapy association (A.O.T.A.)
23 or who has been employed as an occupational therapist for the purpose
24 of providing occupational therapy for at least two years within the three-
25 year period immediately prior to the effective date of this act.
26 (b) The board may waive the examination, education or experience
27 requirements and grant registration to any applicant who shall present
28 proof of current licensure or registration as an occupational therapist or
29 occupational therapy assistant in another state, the District of Columbia
30 or territory of the United States which requires standards for licensure
31 or registration determined by the board to be equivalent to or exceed the
32 requirements for registration under this act.
33 (c) At the time of making an application under this section, the ap-
34 plicant shall pay to the board the application fee as required under K.S.A.
35 65-5409 and amendments thereto.
36 (d) The board may issue a temporary registration to an applicant for
37 registration as an occupational therapist or as an occupational therapy
38 assistant who applies for temporary registration on a form provided by
39 the board, who meets the requirements for registration or who meets all
40 the requirements for registration except examination and who pays to the
41 board the temporary registration fee as required under K.S.A. 65-5409
42 and amendments thereto. Such temporary registration shall expire one
43 year from the date of issue or on the date that the board approves the

1 application for registration, whichever occurs first. No more than one
2 such temporary registration shall be permitted to any one person without
3 the majority approval of the members of the board.
4 Sec. 2. K.S.A. 65-5508 is hereby amended to read as follows: 65-
5 5508. (a) The board shall waive the examination, education and experi-
6 ence requirements and grant registration to any person who applies for
7 registration on or before July 1, 1987, who pays the application fee and
8 who was registered or certified immediately prior to the effective date of
9 this act as a respiratory therapist or respiratory therapy technician by the
10 national board for respiratory care or who has been employed as a res-
11 piratory therapist for the purpose of providing respiratory therapy for at
12 least two years within the three-year period immediately prior to the
13 effective date of this act.
14 (b) The board may waive the examination, education or experience
15 requirements and grant registration to any applicant who presents proof
16 of current licensure or registration as a respiratory therapist in another
17 state, the District of Columbia or territory of the United States which
18 requires standards for licensure or registration determined by the board
19 to be equivalent to or exceed the requirements for registration under this
20 act.
21 (c) At the time of making an application under this section, the ap-
22 plicant shall pay to the board the application fee as required under K.S.A.
23 65-5509 and amendments thereto.
24 (d) The board may issue a special permit to a student enrolled in an
25 approved school of respiratory therapy who applies for such special per-
26 mit on a form provided by the board and who pays to the board the special
27 permit fee as required under K.S.A. 65-5509 and amendments thereto.
28 The special permit shall authorize a student who is enrolled in an ap-
29 proved school of respiratory therapy and who holds such special permit
30 to practice respiratory therapy under the supervision of a registered res-
31 piratory therapist. Such special permit shall expire on the date that the
32 student graduates from an approved school of respiratory therapy or oth-
33 erwise ceases to be enrolled in an approved school of respiratory therapy.
34 (e) The board may issue a temporary registration to an applicant for
35 registration as a respiratory therapist who applies for temporary registra-
36 tion on a form provided by the board, who meets the requirements for
37 registration or who meets all of the requirements for registration except
38 examination and who pays to the board the temporary registration fee as
39 required under K.S.A. 65-5509 and amendments thereto. Such temporary
40 registration shall expire one year from the date of issue or on the date
41 that the board approves the application for registration, whichever occurs
42 first. No more than one such temporary registration shall be permitted
43 to any one person, without the majority approval of the members of the

2 Sec. 3. K.S.A. 65-5408 and 65-5508 are hereby repealed.
3 Sec. 4. This act shall take effect and be in force from and after its
4 publication in the Kansas register statute book.
