12 AN ACT concerning the state board of healing arts; relating to fees paid
13 to the board; concerning compensation paid to review committee
14 members; amending K.S.A. 65-2012, 65-2840c, 65-2896, 65-5409
15 and 65-5509 and K.S.A. 1996 Supp. 65-2852 and 65-6910 and repeal-
16 ing the existing sections.

18 Be it enacted by the Legislature of the State of Kansas:
19 Section 1. K.S.A. 65-2012 is hereby amended to read as follows: 65-
20 2012. The following fees shall be established by rules and regulations
21 adopted by the board and shall be collected by the board:
22 (a) For a license to practice podiatry, issued on the basis of an ex-
23 amination, an amount of not more than $150 $500 $300;
24 (b) for a license to practice podiatry, issued without examination and
25 by endorsement, an amount of not more than $150 $500 $300;
26 (c) for a license to practice podiatry, issued upon request of an ex-
27 empt licensee, an amount of not more than $150 $300;
28 (d) for an exempt license or renewal of an exempt license, an amount
29 of not more than $150 $300;
30 (e) for the annual renewal of a license to practice podiatry, an amount
31 of not more than $150 $300;
32 (f) for late renewal of any license, an amount of not more than $100
33 $200;
34 (g) for reinstatement of a licensee whose license lapsed for failure to
35 renew, an amount of not more than $100 $250 $200;
36 (h) for a temporary permit, an amount of not more than $30 $50 $60;
37 (i) for a temporary license, an amount of not more than $25 $100
38 $50;
39 (j) for any examination given by the board, an amount equal to the
40 cost to the board of the examination and its administration;
41 (k) for a certified statement from the board that a licensee is licensed
42 to practice podiatry in this state, an amount of not more than $15 $100
43 $30; and

1 (l) for any copy of any license issued by the board, an amount of not
2 more than $15. $100 $30; and
3 (m) for written verification of any license issued by the board, in an
4 amount of not more than $25.
5 Sec. 2. K.S.A. 1996 Supp. 65-2852 is hereby amended to read as
6 follows: 65-2852. The following fees shall be established by the board by
7 rules and regulations and collected by the board:
8 (a) For a license, issued upon the basis of an examination given by
9 the board, in a sum of not more than $150 $500 $300;
10 (b) for a license, issued without examination and by endorsement, in
11 a sum of not more than $150 $500 $300;
12 (c) for a license, issued upon a certificate from the national boards,
13 in a sum of not more than $150 $500 $300;
14 (d) for the annual renewal of a license, the sum of not more than
15 $150 $300;
16 (e) for a temporary permit, in a sum of not more than $30 $50 $60;
17 (f) for an institutional license, in a sum of not more than $150 $500
18 $300;
19 (g) for a visiting professor temporary license, in a sum of not more
20 than $25 $50;
21 (h) for a certified statement from the board that a licensee is licensed
22 in this state, the sum of not more than $15 $100 $30;
23 (i) for any copy of any license issued by the board, the sum of not
24 more than $15 $50 $30;
25 (j) for any examination given by the board, a sum in an amount equal
26 to the cost to the board of the examination;
27 (k) for application for and issuance of a special permit under K.S.A.
28 65-2811a and amendments thereto, the sum of not more than $30 $50
29 $60;
30 (l) for an exempt or inactive license or renewal of an exempt or in-
31 active license, the sum of not more than $150;
32 (m) for conversion of an exempt or inactive license to a license to
33 practice the healing arts, the sum of not more than $150 $300;
34 (n) for reinstatement of a revoked license, in a sum of not more than
35 $1,000;
36 (o) for a visiting clinical professor license, or renewal of a visiting
37 clinical professor license, in a sum of not more than $150 $500 $300;
38 (p) for a postgraduate permit in a sum of not more than $30 $100
39 $60;
40 (q) for a limited permit or renewal of a limited permit, the sum of
41 not more than $30. $50 $60; and
42 (r) for a written verification of any license or permit, the sum of not
43 more than $25.

1 Sec. 3. K.S.A. 65-2896 is hereby amended to read as follows: 65-
2 2896. (a) The state board of healing arts shall maintain a register of the
3 names of physicians' assistants registered in accordance with the provi-
4 sions of K.S.A. 65-2896a and amendments thereto.
5 (b) All registrations, except temporary registration, shall expire on the
6 date of expiration established by rules and regulations of the state board
7 of healing arts and may be renewed annually upon request of the regis-
8 trant. The request for renewal shall be on a form provided by the state
9 board of healing arts and shall be accompanied by the renewal fee estab-
10 lished pursuant to this section, which shall be paid not later than the
11 expiration date of the registration.
12 (c) At least 30 days before the expiration of the registration of a phy-
13 sician assistant, except temporary registration, the state board of healing
14 arts shall notify the registrant of the expiration by mail addressed to the
15 registrant's last place of residence as noted upon the office records of the
16 board. If the registrant fails to pay the renewal fee by the date of expi-
17 ration of the registration, the registrant shall be given a second notice
18 that the registrant's registration has expired and the registration may be
19 renewed only if the renewal fee and the late renewal fee are received by
20 the state board of healing arts within the 30-day period following the date
21 of expiration and that, if both fees are not received within the 30-day
22 period, the registration shall be considered to have lapsed for failure to
23 renew and shall be reissued only after the physician assistant has been
24 reinstated under subsection (d).
25 (d) Any registrant who allows the registrant's registration to lapse by
26 failing to renew as herein provided may be reinstated upon recommen-
27 dation of the state board of healing arts and upon payment of the renewal
28 fee and the reinstatement fee and upon submitting evidence of satisfac-
29 tory completion of any applicable continuing education requirements es-
30 tablished by the board. The board shall adopt rules and regulations es-
31 tablishing appropriate continuing education requirements for
32 reinstatement of persons whose registrations have lapsed for failure to
33 renew.
34 (e) The following fees shall be fixed by rules and regulations adopted
35 by the state board of healing arts and shall be collected by the board:
36 (1) For registration as a physician assistant, the sum of not more than
37 $100 $200;
38 (2) for temporary registration as a physician assistant, the sum of not
39 more than $30;
40 (3) for the renewal of registration as a physician assistant, the sum of
41 not more than $75 $200 $150;
42 (4) for the late renewal of registration as a physician assistant, the
43 sum of not more than $250;

1 (5) for reinstatement of a physician assistant whose name has been
2 removed from the register, the sum of not more than $250;
3 (6) for a certified statement from the board that a physician assistant
4 is registered in this state, the sum of not more than $30; and
5 (7) for a copy of the registration certificate of a physician assistant,
6 the sum of not more than $25.; and
7 (8) for written verification of any registration, the sum of not more
8 than $25.
9 (f) The state board of healing arts shall remit all moneys received by
10 or for the board under the provisions of this act to the state treasurer and
11 such money shall be deposited in the state treasury, credited to the state
12 general fund and the healing arts fee fund and expended all in accordance
13 with K.S.A. 65-2855 and amendments thereto.
14 (g) The state board of healing arts may adopt rules and regulations
15 necessary to carry out the provisions of this act and the act of which this
16 section is amendatory.
17 Sec. 4. K.S.A. 65-5409 is hereby amended to read as follows: 65-
18 5409. (a) The board shall charge and collect in advance fees provided for
19 in this act as fixed by the board by rules and regulations, subject to the
20 following limitations:
21 Application fee, not more than$40 $100 $80
22 Temporary registration fee, not more than[nt40

28 (b) The board shall charge and collect in advance fees for any ex-
29 amination administered by the board under the occupational therapy
30 practice act as fixed by the board by rules and regulations in an amount
31 equal to the cost to the board of the examination. If the examination is
32 not administered by the board, the board may require that fees paid for
33 any examination under the occupational therapy practice act be paid di-
34 rectly to the examination service by the person taking the examination.
35 Sec. 5. K.S.A. 65-5509 is hereby amended to read as follows: 65-
36 5509. (a) The board shall charge and collect in advance fees provided for
37 in this act as fixed by the board by rules and regulations, subject to the
38 following limitations:

4 (b) The board shall charge and collect in advance fees for any ex-
5 amination administered by the board under the respiratory therapy prac-
6 tice act as fixed by the board by rules and regulations in an amount equal
7 to the cost to the board of the examination. If the examination is not
8 administered by the board, the board may require that fees paid for any
9 examination under the respiratory therapy practice act be paid directly to
10 the examination service by the person taking the examination.
11 Sec. 6. K.S.A. 1996 Supp. 65-6910 is hereby amended to read as
12 follows: 65-6910. (a) The board shall charge and collect in advance fees
13 provided for in this act as fixed by the board by rules and regulations,
14 subject to the following limitations:
15 Application fee, not more than$50 $100
16 Temporary registration fee, not more than[nt$50
17 Registration renewal fee, not more than[nt$50

22 (b) The board shall charge and collect in advance fees for any ex-
23 amination administered by the board under the athletic trainers registra-
24 tion act as fixed by the board by rules and regulations in an amount equal
25 to the cost to the board of the examination and its administration. If the
26 examination is not administered by the board, the board may require that
27 fees paid for any examination under the athletic trainers registration act
28 be paid directly to the examination service by the person taking the ex-
29 amination.
30 (c) The board shall remit all moneys received from fees, charges or
31 penalties to the state treasurer at least monthly. Upon receipt of any such
32 remittance, the state treasurer shall deposit the entire amount thereof in
33 the state treasury. Twenty percent of each such deposit shall be credited
34 to the state general fund and the balance shall be credited to the healing
35 arts fee fund. All expenditures from such fund shall be made in accor-
36 dance with appropriation acts upon warrants of the director of accounts
37 and reports issued pursuant to vouchers approved by the president of the
38 board or by a person designated by the president of the board.
39 (d) Fees paid are not refundable.
40 Sec. 7. K.S.A. 65-2840c is hereby amended to read as follows:
41 65-2840c. Review committees shall be established and appointed
42 by the state board of healing arts for each branch of the healing
43 arts as necessary to implement advise the board in carrying out the

1 provisions of this act. Each review committee shall be composed
2 of three members and designated alternates. Two Each of the members
3 and their designated alternates shall serve for a period of two
4 years, all of whom shall be members of the same branch of the healing
5 arts as the person whose conduct is being reviewed. The third member
6 of the review committee shall be appointed on an ad hoc basis, and shall
7 be of the same branch of the healing arts and specialty, if any, as the
8 person whose conduct is being reviewed licensed by the board to practice
9 the branch of the healing arts for which the review committee is estab-
10 lished. Members of the state board of healing arts shall not be eli-
11 gible to act as members of the review committee. Members of the
12 review committee who are licensees of the state board of healing arts
13 may be selected from names submitted by the state professional
14 association for the branch of healing arts involved. The board of
15 healing arts shall ensure that no conflict of interest exists by reason of
16 geography, personal or professional relationship, or otherwise, between
17 any of the review committee members and any person whose conduct is
18 being reviewed. The members of such review committees attending
19 meetings of such committees any review committees shall be paid com-
20 pensation, subsistence allowances, mileage and expenses as pro-
21 vided by K.S.A. 75-3223 and amendments thereto. Notwithstanding
22 any other provision of law, the board may compensate review committee
23 members as deemed appropriate by the board to review records relating
24 to matters being investigated by the board.
25 Sec. 7 8. K.S.A. 65-2012, 65-2840c, 65-2896, 65-5409 and 65-5509
26 and K.S.A. 1996 Supp. 65-2852 and 65-6910 are hereby repealed.
27 Sec. 8 9. This act shall take effect and be in force from and after its
28 publication in the Kansas register.
