 9  AN ACT concerning school districts; relating to leases and lease-purchase
10    agreements entered into by boards of education; amending K.S.A. 72-
11    8225 and repealing the existing section.

13  Be it enacted by the Legislature of the State of Kansas:
14    Section 1.  K.S.A. 72-8225 is hereby amended to read as follows: 72-
15  8225. The board of education of any school district, as lessee or lessor,
16  may enter into written contracts for the use of real or personal property
17  or and, in addition to the foregoing, the board of education of any school
18  district may enter into lease-purchase agreements as provided by K.S.A.
19  10-1116b, and amendments thereto. No board of education shall enter
20  into any contract under authority of this section as lessor of any school
21  bus, as defined in K.S.A. 72-8301, and amendments thereto. The term of
22  any such lease or lease-purchase agreement entered into under authority
23  of this section may be for not to exceed 10 years. Such lease or lease-
24  purchase agreement may provide for annual or other payment of rent or
25  rental fees and may obligate the school district to payment of maintenance
26  or other expenses. Any contract made under authority of this section shall
27  be subject to change or termination at any time by the legislature. Any
28  assignment of rights in any contract made under this section shall contain
29  a citation of this section and a recitation that the contract and assignment
30  thereof are subject to change or termination by the legislature. The pro-
31  visions of the cash basis law shall not apply to any lease or lease-purchase
32  agreement made entered into under authority of this section in such a
33  manner as to prevent the intention of this section from being made ef-
34  fective. Any lease-purchase agreement which is entered into under au-
35  thority of this section by any school district and which involves the ac-
36  quisition of land or buildings is subject to the provisions of K.S.A.
37  10-1116c, and amendments thereto.
38    Sec. 2.  K.S.A. 72-8225 is hereby repealed.
39    Sec. 3.  This act shall take effect and be in force from and after its
40  publication in the statute book.
