AN ACT concerning mixing strips and road material storage areas; reg-
ulating the location thereof.
Be it enacted by the Legislature of the State of Kansas:
Section 1. (a) Any mixing strip or road material storage area having
an area of at least 100,000 square feet or more and used for any highway
project, shall be located at least 1/2 mile from any residential structure or
dwelling or any farmstead.
(b) Any mixing strip or road material storage area having an area of
less than 100,000 square feet and used for any highway project, shall be
located at least 1/4 mile from any residential structure or dwelling or any
farmstead.
(c) Any existing mixing strip or road material storage area located
within 600 feet or less of any residential structure or dwelling or any
farmstead shall be relocated in accordance with the provisions of this
section within one year from the effective date of this act.
(d) The provisions of this section shall not apply to any mixing strip
or road material storage area in existence prior to the establishment of
any residential structure or dwelling or any farmstead.
(e) As used in this section:
(1) ``Residential structure'' or ``dwelling'' means any building, or
structure, or part thereof, used and occupied for human habitation or
intended to be so used and includes any appurtenances belonging thereto;
or
(2) ``farmstead'' means the buildings and adjacent service areas of a
farm.
Sec. 2. This act shall take effect and be in force from and after its
publication in the statute book.
