10 AN ACT concerning vehicles; relating to terminal rent adjustment clauses 11 commercial and financial institutions and transactions. 12 13 Be it enacted by the Legislature of the State of Kansas: 14 Section 1. (a) Notwithstanding any other provision of law, an agree- 15 ment involving the leasing of a motor vehicle or trailer does not create a 16 sale or security interest solely because the agreement provides for an 17 increase or decrease adjustment in the rental price of the motor vehicle 18 or trailer based upon the amount realized upon sale or other disposition 19 of the motor vehicle or trailer following the termination of the lease. 20 (b) This section shall be part of and supplemental to the uniform 21 commercial code-leases. 22 Sec. 2. Notwithstanding any other law, pursuant to section 23 44(a)(2) of the federal deposit insurance act, 12 U.S.C. 1831u(a)(2), 24 a Kansas bank may not engage in a merger transaction involving 25 an out-of-state bank. 26 Sec. 3. For the purposes of sections 2 through 4: 27 (a) ``Bank'' means an insured bank as defined in section 3(h) of 28 the federal deposit insurance act, 12 U.S.C. 1813(h); 29 (b) ``Kansas bank'' means any bank, as defined in subsection 30 (a), which, in the case of a state chartered bank, is a bank chartered 31 under the authority of the state of Kansas, and, in the case of a 32 national banking association, is a bank with the bank's main office 33 located in Kansas; 34 (c) ``out-of-state bank'' means a bank that is: 35 (1) A national bank having the bank's main office in a state 36 other than this state; or 37 (2) a state-chartered bank chartered by a state other than this 38 state; 39 (d) ``merger transaction'' has the meaning defined in section 40 44 (f)(7) of the federal deposit insurance act, 12 U.S.C. 1831u(f)(7), 41 and includes 12 U.S.C. 1828(c)(1) and (2). 42 Sec. 4. The provisions of sections 2 and 3 shall be subject to 43 review by the legislature on or after July 1, 2000. SB 118--Am. by H
