12 AN ACT concerning health care data; concerning the health care
13 data governing board; concerning legislative post audit; relating to
14 the performance audit of the health care database; amending K.S.A.
15 1996 Supp. 65-6803 and 65-6808 and repealing the existing section
16 sections.

18 Be it enacted by the Legislature of the State of Kansas:
19 Section 1. K.S.A. 1996 Supp. 65-6803 is hereby amended to
20 read as follows: 65-6803. (a) There is hereby created a health care
21 data governing board.
22 (b) The board shall consist of seven nine members appointed as
23 follows: One member shall be appointed by the Kansas medical
24 society, one member shall be appointed by the Kansas hospital
25 association, one member shall be appointed by the executive vice
26 chancellor of the university of Kansas school of medicine, one mem-
27 ber who is a licensed professional nurse appointed by the Kansas state
28 nurses association, one member representing health care insurers
29 or other commercial payors shall be appointed by the governor,
30 one member representing adult care homes shall be appointed by
31 the governor, one member representing the institute associated with
32 the university of Kansas department of health services administration
33 Kansas health institute, one member appointed by the state board of re-
34 gents representing the health services research community and one
35 member representing consumers of health care shall be appointed
36 by the governor. The secretary of health and environment, or the
37 designee of the secretary, shall be a nonvoting member who shall
38 serve as chairperson of the board. The secretary of social and re-
39 habilitation services and the insurance commissioner, or their des-
40 ignees, shall be nonvoting members of the board. Board members
41 and task force members shall not be paid compensation, subsis-
42 tence allowances, mileage or other expenses as otherwise may be
43 authorized by law for attending meetings, or subcommittee meet-

1 ings, of the board. The members appointed to the board shall serve
2 for three-year terms, or until their successors are appointed and
3 qualified.
4 (c) The chairperson of the health care data governing board
5 may appoint a task force or task forces of interested citizens and
6 providers of health care for the purpose of studying technical is-
7 sues relating to the collection of health care data. At least one
8 member of the health care data governing board shall be a mem-
9 ber of any task force appointed under this subsection.
10 (d) The board shall meet at least quarterly and at such other
11 times deemed necessary by the chairperson.
12 (e) The board shall develop policy regarding the collection of
13 health care data and procedures for ensuring the confidentiality
14 and security of these data.
15 Section 1. 2. K.S.A. 1996 Supp. 65-6808 is hereby amended to read
16 as follows: 65-6808. (a) Three years after enactment of this act A per-
17 formance audit shall be conducted either by the legislative post auditor
18 or by a firm, as defined by K.S.A. 46-1112, and amendments thereto,
19 under contract with the legislative post auditor in accordance with the
20 provisions of the legislative post audit act to identify total costs to the
21 state and providers of data and the benefits of the program. The audit
22 report shall be submitted to the legislature at the commencement of the
23 regular session of the legislature held during 1997 1998 [1999].
24 (b) The auditor to conduct the audit work required under this section
25 shall be specified in accordance with K.S.A. 46-1122, and amendments
26 thereto. If the legislative post audit committee specifies under such stat-
27 ute that a firm is to perform such audit, such firm shall be selected and
28 shall perform such audit as provided in K.S.A. 46-1123, and amendments
29 thereto, and K.S.A. 46-1125 through 46-1127, and amendments thereto.
30 If the audit work is conducted under contract with a firm, the contract
31 cost of the audit shall be paid by the department of health and environ-
32 ment.
33 Sec. 2. 3. K.S.A. 1996 Supp. 65-6803 and 65-6808 is are hereby
34 repealed.
35 Sec. 3. 4. This act shall take effect and be in force from and after its
36 publication in the statute book Kansas register.
