9 A PROPOSITION to amend section 1 of article 5 of the constitution of 10 the state of Kansas, relating to qualifications of electors. 11 12 Be it resolved by the Legislature of the State of Kansas, two-thirds of the 13 members elected (or appointed) and qualified to the House of Represen- 14 tatives and two-thirds of the members elected (or appointed) and qualified 15 to the Senate concurring therein: 16 Section 1. The following proposition to amend the constitution of the 17 state of Kansas shall be submitted to the qualified electors of the state 18 for their approval or rejection: Section 1 of article 5 of the constitution 19 of the state of Kansas is hereby amended to read as follows: 20 ``(section) 1. Qualifications of electors. Every citizen of the United 21 States who has attained the age of eighteen years and who resides 22 in the voting area in which he or she such citizen seeks to vote shall 23 be deemed a qualified elector. In addition thereto, every citizen of 24 the United States who has attained the age of eighteen years on or 25 before the date of any general election, and is otherwise qualified 26 as provided by law, shall be deemed a qualified elector for the pur- 27 pose of voting at the primary election held for the purpose of nom- 28 inating candidates for such general election and for voting upon any 29 proposition submitted at any question submitted election held in 30 conjunction with such primary election. 31 Laws of this state relating to voting for presidential electors and 32 candidates for the office of president and vice-president of the 33 United States shall comply with the laws of the United States re- 34 lating thereto. A citizen of the United States, who is otherwise qual- 35 ified to vote in Kansas for presidential electors and candidates for 36 the offices of president and vice-president of the United States may 37 vote for such officers either in person or by absentee ballot not- 38 withstanding the fact that such person may have become a nonres- 39 ident of this state if his or her such person's removal from this state 40 occurs during a period in accordance with federal law next preced- 41 ing such election. 42 A person who is otherwise a qualified elector may vote in the 43 voting area of his or her such person's former residence either in HCR 5022

 1  person or by absentee ballot notwithstanding the fact that such per-
 2  son may have become a nonresident of such voting area during a
 3  period prescribed by law next preceding the election at which he
 4  or she such person seeks to vote, if his such new residence is in
 5  another voting area in the state of Kansas.''
 6    Sec. 2.  The following statement shall be printed on the ballot with
 7  the amendment as a whole:
 8    ``Explanatory statement. The purpose of this amendment is to au-
 9  thorize persons becoming 18 years of age on or before the date of any
10  general election to vote at the primary election held for the nomination
11  of candidates for such general election even though such person is 17
12  years of age at the time of the primary election and to vote upon any
13  proposition submitted at a question submitted election held in con-
14  junction with such primary election.
15    ``A vote for this amendment would favor authorizing persons becom-
16  ing 18 years of age on or before the date of any general election to
17  vote at the primary election held for the nomination of candidates for
18  such general election and to vote upon any propositions submitted at
19  a question submitted election held in conjunction with such primary
20  election.
21    ``A vote against this amendment would favor making no change in
22  the current law requiring that a person has attained the age of 18 years
23  to become a qualified elector for the purpose of voting.''
24    Sec. 3.  This resolution, if approved by two-thirds of the members
25  elected (or appointed) and qualified to the House of Representatives and
26  two-thirds of the members elected (or appointed) and qualified to the
27  Senate, shall be entered on the journals, together with the yeas and nays.
28  The secretary of state shall cause this resolution to be published as pro-
29  vided by law and shall cause the proposed amendment to be submitted
30  to the electors of the state at the general election in the year 1998 unless
31  a special election is called at a sooner date by concurrent resolution of
32  the legislature, in which case it shall be submitted to the electors of the
33  state at the special election.
