9 A CONCURRENT RESOLUTION approving the creation of a Butler
10 County Port Authority.

12 WHEREAS, The State of Kansas encourages economic development
13 and cooperation to maintain and foster the economic stability and con-
14 tinued growth needed for a prosperous economy; and
15 WHEREAS, The economic prosperity and well-being of Butler
16 County, Kansas, will be enhanced and improved by the creation of a port
17 authority; and
18 WHEREAS, The Commission of Butler County, Kansas, believes it is
19 in the best interests of the citizens and residents of Butler County, Kansas,
20 that a port authority be created to preserve, enhance and improve the
21 economic prosperity of Butler County; and
22 WHEREAS, The Commission of Butler, Kansas, believes it should
23 take the initiative to create a port authority and that the governmental
24 units in the counties of Wilson, Elk, Greenwood and Sedgwick, as elected
25 by appropriate resolution or ordinance, or both, join the port authority
26 by cooperative agreement; and
27 WHEREAS, The legislature of the state of Kansas agrees with the
28 Commission of Butler County's assertions: Now, therefore,
29 Be it resolved by the House of Representatives of the State of Kansas,
30 the Senate concurring therein: That the legislature of the State of Kan-
31 sas, in accordance with the provisions of K.S.A. 12-3402 and amendments
32 thereto, hereby approves the creation of a port authority with all the
33 powers, duties, limitations and obligations stated in article 34 of chapter
34 12 of the Kansas Statutes Annotated as the Commission of Butler County,
35 may, by appropriate resolutions or ordinances, create and that such other
36 governmental units in the counties of Wilson, Elk, Greenwood and Sedg-
37 wick, as elected by appropriate resolution or ordinance, or both, may join
38 such port authority by cooperative agreement.
