9 A PROPOSITION to amend section 3b of article 15 of the constitution
10 of the state of Kansas, relating to horse and dog racing and parimutuel
11 racing thereon.

13 Be it resolved by the Legislature of the State of Kansas, two-thirds of the
14 members elected (or appointed) and qualified to the House of Repre-
15 sentatives and two-thirds of the members elected (or appointed) and
16 qualified to the Senate concurring therein:
17 Section 1. The following proposition to amend the constitution of the
18 state of Kansas shall be submitted to the qualified electors of the state
19 for their approval or rejection: Section 3b of article 15 of the constitution
20 of the state of Kansas is hereby amended to read as follows:
21 ``(section) 3b. Regulation, licensing and taxation of horse and dog rac-
22 ing and parimutuel wagering thereon. Notwithstanding the provi-
23 sions of section 3 of article 15 of the constitution of the state of Kansas,
24 the legislature may permit, regulate, license and tax, at a rate not less
25 than 3% nor more than 6% of all money wagered, the operation or con-
26 duct, by bona fide nonprofit organizations, of horse and dog racing and
27 parimutuel wagering thereon in any county in which: (a) A majority of
28 the qualified electors of the county voting thereon approve this proposed
29 amendment; or (b) the qualified electors of the county approve a prop-
30 osition, by a majority vote of those voting thereon at an election held
31 within the county, to permit such racing and wagering within the bound-
32 aries of the county. No off-track betting shall be permitted in connection
33 with horse and dog racing permitted pursuant to this section.'' to read as
34 follows:
35 Sec. 2. The following statement shall be printed on the ballot with
36 the amendment as a whole:
37 ``Explanatory statement. The purpose of this amendment is to
38 remove the prohibition against off-track betting.
39 ``A vote for this proposition would remove the prohibition against
40 off-track betting.
41 ``A vote against this proposition favors retaining the current pro-
42 hibition against off-track betting.''
43 Sec. 3. This resolution, if approved by two-thirds of the members

1 elected (or appointed) and qualified to the House of Representatives and
2 two-thirds of the members elected (or appointed) and qualified to the
3 Senate, shall be entered on the journals, together with the yeas and nays.
4 The secretary of state shall cause this resolution to be published as pro-
5 vided by law and shall cause the proposed amendment to be submitted
6 to the electors of the state at the general election in the year 1998 unless
7 a special election is called at a sooner date by concurrent resolution of
8 the legislature, in which case it shall be submitted to the electors of the
9 state at the special election.
