9 AN ACT concerning school districts; prescribing certain restrictions on
10 the use of buildings, facilities, equipment, property, personnel, tele-
11 phone, telecommunications and other services; amending K.S.A. 72-
12 8212 and repealing the existing section.

14 Be it enacted by the Legislature of the State of Kansas:
15 Section 1. K.S.A. 72-8212 is hereby amended to read as follows: 72-
16 8212. (a) (1) Subject to provision (2) of this subsection, every unified
17 school district shall maintain, offer and teach kindergarten and grades
18 one through 12 and shall offer and teach at least 30 units of instruction
19 for pupils enrolled in grades nine through 12 in each high school operated
20 by the board of education. The units of instruction, to qualify for the
21 purpose of this section, shall have the prior approval of the state board
22 of education.
23 (2) Any unified school district which has discontinued kindergarten,
24 any grade or unit of instruction under authority of K.S.A. 72-8233, and
25 amendments thereto, and has entered into an agreement with another
26 unified school district for the provision of kindergarten or any such grade
27 or unit of instruction has complied with the kindergarten, grade and unit
28 of instruction requirements of this section.
29 (b) The board of education shall adopt all necessary rules and regu-
30 lations for the government and conduct of its schools, consistent with the
31 laws of the state.
32 (c) The board of education may divide the district into subdistricts
33 for purposes of attendance by pupils.
34 (d) The board of education shall have the title to and the care and
35 keeping of all school buildings and other school property belonging to the
36 district. Subject to the provisions of subsection (f), the board may open
37 any or all school buildings for community purposes and may adopt rules
38 and regulations governing use of school buildings for those purposes.
39 School buildings and other school properties no longer needed by the
40 school district may be disposed of by the board upon the affirmative
41 recorded vote of not less than a majority of the members of the board at
42 a regular meeting. The board may dispose of the property in such manner
43 and upon such terms and conditions as the board deems to be in the best

1 interest of the school district. Conveyances of school buildings and other
2 school properties shall be executed by the president of the board and
3 attested by the clerk.
4 (e) The board shall have the power to acquire personal and real prop-
5 erty by purchase, gift or the exercise of the power of eminent domain in
6 accordance with K.S.A. 72-8212a, and amendments thereto.
7 (f) The buildings, facilities, equipment and other property of a unified
8 school district, the personal services of the administrative, teaching or
9 support employees of the unified school district, and the telephone, tele-
10 communications and any other services belonging to or purchased by the
11 district shall not be used by any person or other entity to conduct or to
12 assist or support in any manner any private business or other gainful
13 activity.
14 Sec. 2. K.S.A. 72-8212 is hereby repealed.
15 Sec. 3. This act shall take effect and be in force from and after its
16 publication in the statute book.
