9 AN ACT changing the chief information architect into the chief infor- 10 mation officer; providing for appointment; powers, duties and func- 11 tions; amending K.S.A. 1996 Supp. 75-4706, 75-4707, 75-4740, 75- 12 4742, 75-4743 and 75-4744 and repealing the existing sections. 13 14 Be it enacted by the Legislature of the State of Kansas: 15 Section 1. K.S.A. 1996 Supp. 75-4706 is hereby amended to read as 16 follows: 75-4706. (a) No state agency, as defined in K.S.A. 75-3701 and 17 amendments thereto, shall lease, cause to be leased, purchase, contract 18 for, issue a letter of intent to contract for or cause to be installed, any 19 information processing equipment, including auxiliary equipment or any 20 information processing programs or systems, or maintenance thereon 21 without the prior approval of the Kansas information resources council 22 or specific legislative authorization. The director of accounts and reports 23 shall not issue any warrant in payment for any lease or purchase contract 24 for any information processing equipment, programs and systems ac- 25 quired without such prior approval or authorization. 26 (b) All specifications for bids for acquisition of the information pro- 27 [chcessing equipment, including auxiliary equipment and information pro- 28 [chcessing programs and systems, or maintenance thereof shall be reviewed 29 by the chief information architect, under the supervision of the Kansas 30 information resources council officer. This subsection shall not apply to 31 the information network of Kansas. 32 Sec. 2. K.S.A. 1996 Supp. 75-4707 is hereby amended to read as 33 follows: 75-4707. Notwithstanding the provisions of K.S.A. 75-3738 and 34 75-3739 and amendments thereto, state agencies using information pro- 35 [chcessing equipment under lease are hereby authorized to enter into con- 36 tracts with leasing service companies for purchase by the agency of such 37 equipment with nonstate funds furnished by such leasing service com- 38 panies and transfer of title to such equipment by the agency to such 39 leasing service company for lease back to the agency. Any such contract 40 shall first be approved by the chief information architect under the su- 41 pervision of the Kansas information resources council officer. 42 Sec. 3. K.S.A. 1996 Supp. 75-4740 is hereby amended to read as 43 follows: 75-4740. (a) There is hereby established the Kansas information HB 2540

 1  resources council which shall be attached to the department of admin-
 2  istration for purposes of administrative functions.
 3    (b)  The council shall be composed of 20 members as follows:   The
 4  secretary of administration; the secretary of health and environment; the
 5  secretary of human resources; the secretary of revenue; the secretary of
 6  social and rehabilitation services; the secretary of transportation; the ju-
 7  dicial administrator of the Kansas supreme court; the executive director
 8  of the Kansas board of regents; the chairperson of the joint committee
 9  on computers and telecommunications; the commissioner of education;
10  four additional chief administrative officers of various state agencies; and
11  three representatives from the private sector, the chief information ar-
12  chitect officer and the director of the budget to serve as advisory, non-
13  voting members. In addition, during those periods of time when the chair-
14  person of the joint committee on computers and telecommunications is
15  a member of the senate, one member of the council shall be a member
16  of the house of representatives appointed by the chairperson of the com-
17  mittee on appropriations of the house of representatives and during those
18  periods of time when the chairperson of the joint committee on com-
19  puters and telecommunications is a member of the house of represen-
20  tatives, one member of the council shall be a member of the senate ap-
21  pointed by the chairperson of the committee on ways and means of the
22  senate. The four chief administrative officers and representatives from
23  the private sector shall be appointed by the governor for a term not to
24  exceed 18 months. Members, other than members appointed to the coun-
25  cil, shall be permanent members on the council. Upon expiration of a
26  member's term, the member shall continue to hold office until the ap-
27  pointment of a successor.
28    (c)  The secretary of administration shall serve as the interim chair-
29  person until such time as a permanent chair is determined by the council.
30    (d)  The council shall hold meetings and hearings in the city of Topeka
31  or at such times and places as it designates, on call of the chairperson or
32  on request of four or more members.
33    (e)  Members of the council may not appoint an individual to repre-
34  sent them on the council.
35    (f)  Members of the council shall not be eligible for compensation,
36  subsistence allowances, mileage or other expenses as provided in K.S.A.
37  75-3223 and amendments thereto for attendance at any meeting of the
38  council or any subcommittee meeting authorized by the council, except
39  that (1) agencies may pay subsistence, mileage and other expenses to their
40  representatives on the council, and (2) legislators serving as members of
41  the council shall receive compensation and travel expenses and subsis-
42  tence expenses or allowances as provided by K.S.A. 75-3212 and amend-
43  ments thereto.

 1    Sec. 4.  K.S.A. 1996 Supp. 75-4742 is hereby amended to read as
 2  follows: 75-4742. (a) There is hereby established, within and as a part of
 3  the department of administration, an office of the chief information ar-
 4  chitect officer, the head of which shall be the chief information architect
 5  officer. Under the supervision of the Kansas information resources coun-
 6  cil governor, the chief information architect officer shall administer the
 7  office of the chief information architect officer.  The chief information
 8  architect officer shall be in the unclassified service under the Kansas civil
 9  service act and shall be appointed by the Kansas information resources
10  council governor, subject to confirmation by the senate, as provided in
11  K.S.A. 75-4315b and amendments thereto, and shall serve at the pleasure
12  of the governor. The chief information officer shall receive an annual
13  salary fixed by the governor. The person serving as the chief information
14  architect on the day preceding the effective date of this act shall continue
15  in such office as the chief information officer and shall serve at the pleas-
16  ure of the governor. Such continuation in office as the chief information
17  officer shall not be subject to confirmation by the senate, as provided in
18  K.S.A. 75-4315b and amendments thereto.
19    (b) (1)  The name of the office of the chief information architect is
20  hereby changed to the office of the chief information officer. All properties,
21  moneys, appropriations, rights and authorities now vested in the office of
22  the chief information architect shall be vested in the office of the chief
23  information officer. Whenever the office of the chief information architect,
24  or words of like effect, is referred to or designated by any statute, contract
25  or other document, such reference or designation shall be deemed to apply
26  to the office of the chief information officer.
27    (2)  The title of the chief information architect is hereby changed to
28  the chief information officer. All properties, moneys, appropriations,
29  rights and authorities now vested in the chief information architect shall
30  be vested in the chief information officer. Whenever the chief information
31  architect, or words of like effect, is referred to or designated by any stat-
32  ute, contract or other document, such reference or designation shall be
33  deemed to apply to the chief information officer.
34    Sec. 5.  K.S.A. 1996 Supp. 75-4743 is hereby amended to read as
35  follows: 75-4743. The chief information architect officer shall:
36    (a)  Initiate and publish the strategic information management plan
37  for the state;
38    (b)  develop and maintain an information infrastructure and standards
39  for data management;
40    (c)  serve as secretary to the Kansas information resources council;
41    (d)  propose information resource policies and procedures for ap-
42  proval by the Kansas information resources council;
43    (e)  coordinate implementation of new computer and telecommuni-

 1  cation technologies;
 2    (f)  coordinate the integration of the state strategic plan and business
 3  processes and information technology where appropriate;
 4    (g)  audit compliance with infrastructure standards and review find-
 5  ings with the organization for appropriate action; and
 6    (h)  serve as counsel to agency executives for information technology
 7  investment management.
 8    Sec. 6.  K.S.A. 1996 Supp. 75-4744 is hereby amended to read as
 9  follows: 75-4744. The chief information architect, under the supervision
10  of the Kansas information resources council, officer shall review the in-
11  formation processing budget requests submitted by all divisions, depart-
12  ments and agencies annually and submit recommendations to the division
13  of the budget as to the technical and management merit of the requests.
14  In making such recommendations the chief information architect officer
15  shall consider the following factors:
16    (a)  Whether the request is consistent with the comprehensive plan
17  approved by the Kansas information resources council;
18    (b)  whether the request is consistent with present and future needs
19  of the state;
20    (c)  the current ability of the state or agency thereof to meet the sys-
21  tem demands intended to be satisfied by the request;
22    (d)  the reasonably foreseeable future demands on the current system,
23  if any, affected by the request;
24    (e)  the economic benefits or adverse impact of recommending the
25  request;
26    (f)  alternate methods of meeting the system demands intended to be
27  satisfied by the request;
28    (g)  the adequacy of the plan for integration of the requested project
29  into the current system;
30    (h)  the availability of resources necessary to finance the request; and
31    (i)  such other factors as the chief information architect officer deems
32  relevant.
33    Sec. 7.  K.S.A. 1996 Supp. 75-4706, 75-4707, 75-4740, 75-4742, 75-
34  4743 and 75-4744 are hereby repealed.
35    Sec. 8.  This act shall take effect and be in force from and after its
36  publication in the statute book.
