9 AN ACT concerning the Kansas bureau of investigation; relating to crim-
10 inal history record information; authorizing certain fees; establishing
11 the criminal history record check fee fund.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. (a) There is hereby established in the state treasury the
15 criminal history record check fee fund which shall be administered by the
16 director of the Kansas bureau of investigation. All moneys received from
17 fees for checking criminal history record information shall be remitted to
18 the state treasurer at least monthly. Upon receipt of each such remittance,
19 the state treasurer shall deposit the entire amount in the state treasury
20 to the credit of the criminal history record check fee fund. All expendi-
21 tures from the criminal history record check fee fund shall be made in
22 accordance with appropriation acts upon warrants of the director of ac-
23 counts and reports issued pursuant to vouchers approved by the director
24 of the Kansas bureau of investigation or the director's designee.
25 (b) In addition to other fees authorized by statute for checking crim-
26 inal history record information, the director of the Kansas bureau of in-
27 vestigation is hereby authorized to fix, charge and collect fees for criminal
28 history record checks conducted for noncriminal justice entities including
29 governmental agencies and private organizations. All such fees shall be
30 fixed in order to recover all or part of the direct and indirect operating
31 expenses incurred for such record checks.
32 (c) On July 1, 1997, the director of the Kansas bureau of investigation
33 shall certify to the director of accounts the amount of moneys credited
34 to the KBI general fees fund that is attributable to moneys received for
35 fees for checking criminal history record information. Upon receipt of
36 such certification, the director of accounts and reports shall transfer
37 amount certified from the KBI general fees fund to the criminal history
38 record check fee fund. On July 1, 1997, all outstanding liabilities of the
39 KBI general fees fund that are attributable to operating expenditures for
40 conducting criminal history record checks, as determined by the director
41 of the Kansas bureau of investigation, are transferred to and imposed on
42 the criminal history record check fee fund.

1 Sec. 2. This act shall take effect and be in force from and after its
2 publication in the statute book.
