9 AN ACT concerning lotteries; relating to the privilege tax imposed on
10 bingo games; disposition of tax revenues; amending K.S.A. 1996 Supp.
11 79-4710 and repealing the existing section.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. K.S.A. 1996 Supp. 79-4710 is hereby amended to read as
15 follows: 79-4710. (a) All amounts received by or for the secretary of rev-
16 enue from license and registration fees pursuant to this act shall be re-
17 mitted to the state treasurer and the state treasurer shall deposit all of
18 such moneys in the state treasury and, except as otherwise provided by
19 K.S.A. 79-4711 and amendments thereto for maintenance of the bingo
20 refund fund, shall credit the same to the state bingo regulation fund.
21 (b) All amounts received by or for the secretary of revenue from the
22 tax levied pursuant to K.S.A. 79-4704 and amendments thereto shall be
23 remitted to the state treasurer and the state treasurer shall deposit all of
24 such moneys in the state treasury. There is hereby created, in the state
25 treasury, the state bingo regulation fund and the county and city bingo
26 tax fund. Subject to the maintenance requirements of the bingo refund
27 fund under K.S.A. 79-4711 and amendments thereto, 1/3 57% of each
28 deposit shall be credited to the state general fund, 1/3 33% of each deposit
29 to the state bingo regulation fund and the remaining 1/3 10% of such
30 deposit shall be credited to the county and city bingo tax fund. Moneys
31 in the state bingo regulation fund shall be expended for the enforcement
32 of the bingo statutes in article 47 of chapter 79 of Kansas Statutes An-
33 notated and rules and regulations adopted pursuant thereto. Such ex-
34 penditures shall be made upon vouchers approved by the secretary of
35 revenue or a person designated by the secretary.
36 (c) All moneys deposited in the county and city bingo tax fund shall
37 be returned to the counties and cities in which the locations and regis-
38 tered premises are located at a time or times fixed by the secretary but
39 not less than once each year. If the locations and registered premises are
40 located within the corporate limits of a city, all taxes collected therefrom
41 shall be remitted to the city treasurer of such city and credited to the city
42 general fund. If the locations and registered premises are located within
43 the unincorporated area of any county, all taxes collected therefrom shall

1 be remitted to the county treasurer of such county and credited to the
2 county general fund. Moneys distributed to cities and counties under this
3 section shall be used to assist in the enforcement of the bingo laws of this
4 state.
5 Sec. 2. K.S.A. 1996 Supp. 79-4710 is hereby repealed.
6 Sec. 3. This act shall take effect and be in force from and after its
7 publication in the statute book.
