 9  AN ACT concerning controlled shooting areas; relating to the total li-
10    censed acreage in any county; amending K.S.A. 32-945 and repealing
11    the existing section.

13  Be it enacted by the Legislature of the State of Kansas:
14    Section 1.  K.S.A. 32-945 is hereby amended to read as follows: 32-
15  945. (a) Upon receipt of an application for a license to operate a controlled
16  shooting area, the secretary shall cause an inspection to be made of:
17    (1)  The proposed licensed area described in such application;
18    (2)  the premises and facilities where game birds are to be propagated,
19  raised and liberated;
20    (3)  the cover for game birds on such area; and
21    (4)  the ability of the applicants to operate a controlled shooting area.
22    (b)  If the secretary finds that the area contains not less nor more than
23  the number of acres required by K.S.A. 32-944 and amendments thereto,
24  is contiguous and has the proper requirements and facilities for the op-
25  eration of a controlled shooting area and that the issuing of the license
26  will otherwise be in the public interest, the secretary may approve the
27  application and issue the controlled shooting area license.
28    (c)  A controlled shooting area license expires on June 30 of the op-
29  erational year for which issued.
30    (d)  The secretary shall limit controlled shooting areas so that the total
31  acreage licensed as controlled shooting areas in a county does not exceed
32  2% 3% of the total acreage of such county.
33    Sec. 2.  K.S.A. 32-945 is hereby repealed.
34    Sec. 3.  This act shall take effect and be in force from and after its
35  publication in the statute book.
