9 AN ACT concerning the state of Kansas sports hall of fame; providing for 10 separation from the state historical society; amending K.S.A. 74-2906a 11 and K.S.A. 1996 Supp. 74-2912 and repealing the existing sections. 12 13 Be it enacted by the Legislature of the State of Kansas: 14 Section 1. K.S.A. 74-2906a is hereby amended to read as follows: 74- 15 2906a. (a) There is hereby created the state of Kansas sports hall of fame 16 board of trustees, hereinafter referred to as the board of trustees, which 17 board shall be composed of seven members appointed by the governor. 18 (b) Upon the expiration of the term of office of any member, a suc- 19 cessor shall be appointed for a term of four years. All vacancies in office 20 of members so appointed shall be filled by appointment for the unexpired 21 term of the member creating the vacancy. Members of the Kansas all- 22 sports hall of fame board of trustees immediately prior to the effective 23 date of this act shall become members of the state of Kansas sports hall 24 of fame and shall serve as such members until the expiration of their term 25 of office established as members of the Kansas all-sports hall of fame 26 board of trustees. 27 (c) The board of trustees shall organize annually by electing one of 28 its members as chairperson and one as vice-chairperson. Meetings of the 29 board of trustees shall be held upon call of the chairperson, or may be 30 called by a majority of the board of trustees. 31 (d) The board of trustees shall have such powers and duties as are 32 provided by law. Members of the board of trustees attending meetings 33 of such board of trustees, or attending a subcommittee meeting thereof 34 authorized by such board of trustees, shall be paid amounts provided in 35 subsection (e) of K.S.A. 75-3223 and amendments thereto. 36 (e) The board of trustees may employ such professional and clerical 37 personnel, on a part-time or full-time basis, as may be necessary in its 38 judgment, and all such personnel shall be in the classified service under 39 the Kansas civil service act. 40 (f) The state of Kansas sports hall of fame board of trustees is hereby 41 attached to the state historical society as a part thereof. All budgeting, 42 purchasing and related management functions of the board of trustees 43 shall be administered under the direction and supervision of the state HB 2498

 1  historical society. The state historical society shall provide office space
 2  and such clerical and other staff assistance as may be necessary to assist
 3  the board of trustees in carrying out its functions, powers and duties.
 4    (g) (f)  Whenever the Kansas all-sports hall of fame board of trustees,
 5  or words of like effect, is referred to or designated by any appropriations
 6  act or other act of the legislature, or any statute, contract or other doc-
 7  ument, such reference or designation shall be deemed to apply to the
 8  state of Kansas sports hall of fame board of trustees which is created by
 9  this act.
10    Sec. 2.  K.S.A. 1996 Supp. 74-2912 is hereby amended to read as
11  follows: 74-2912. (a) There is hereby created in the state treasury the
12  state of Kansas sports hall of fame fund. The board of trustees shall remit
13  all moneys received by the board of trustees, including all moneys re-
14  ceived as gifts, grants, bequests and gratuities as provided in K.S.A. 74-
15  2909 and amendments thereto, to the state treasurer at least monthly.
16  Upon receipt of each such remittance the state treasurer shall deposit the
17  entire amount thereof in the state treasury and the same shall be credited
18  to the state of Kansas sports hall of fame fund.
19    (b)  In accordance with and subject to the provisions of this act and
20  of appropriation acts, (a) The board of trustees may make expenditures
21  from the state of Kansas sports hall of fame fund for contracts entered
22  into with private entities, for the maintenance and operating expenditures
23  of the state of Kansas sports hall of fame and the board of trustees, for
24  the expenses of state of Kansas sports hall of fame induction ceremonies,
25  including the actual and necessary expenses of speakers and persons being
26  inducted into the state of Kansas sports hall of fame for their attendance
27  at such induction ceremonies, for official hospitality, for capital improve-
28  ment projects for remodeling of or for additions or repairs to the state of
29  Kansas sports hall of fame and for such other purposes as may be au-
30  thorized by law.
31    (c) (b)  All expenditures from by the board of trustees of the state of
32  Kansas sports hall of fame fund shall be exempt from competitive bid
33  procedures under K.S.A. 75-3739 and amendments thereto and shall be
34  made in accordance with appropriation acts upon warrants of the director
35  of accounts and reports issued pursuant to vouchers approved by the
36  board of trustees or by a person or persons designated by the board of
37  trustees.
38    (d) (c)  On the effective date of this act July 1, 1997, the director of
39  accounts and reports shall transfer all moneys in the all-sports hall of fame
40  fund to the state of Kansas sports hall of fame fund to the bank account
41  established under this section in accordance with the procedures pre-
42  scribed by this section therefor. On the effective date of this act July 1,
43  1997, all liabilities of the all-sports hall of fame state of Kansas sports hall

 1  of fame fund are hereby transferred to and imposed upon the state of
 2  Kansas sports hall of fame fund such bank account. On the effective date
 3  of this act July 1, 1997, the all-sports hall of fame state of Kansas sports
 4  hall of fame fund is hereby abolished.
 5    (e)  On or before the 10th of each month, the director of accounts
 6  and reports shall transfer from the state general fund to the state of Kan-
 7  sas sports hall of fame fund interest earnings based on:
 8    (1)  The average daily balance of moneys in the state of Kansas sports
 9  hall of fame fund for the preceding month; and
10    (2)  the net earnings rate of the pooled money investment portfolio
11  for the preceding month.
12    (f) (d)  Upon the request of The state of Kansas sports hall of fame
13  board of trustees and in accordance with the provisions of appropriations
14  acts, the state historical society may transfer moneys in the state of Kansas
15  sports hall of fame fund to shall deposit all moneys of the state of Kansas
16  sports hall of fame in a bank to the account of the state of Kansas sports
17  hall of fame. Such bank account shall be awarded to a bank located in
18  the county in which the state of Kansas sports hall of fame is located by
19  the pooled money investment board under a written agreement in ac-
20  cordance with procedures for state bank accounts under K.S.A. 75-4217
21  and amendments thereto and shall be secured by pledge of securities in
22  the manner prescribed for state bank accounts under K.S.A. 75-4218 and
23  amendments thereto and in the amount prescribed for fee agency ac-
24  counts under that statute. Each such transfer shall be made upon vouch-
25  ers of the state historical society, which the director of accounts and re-
26  ports and the state treasurer are hereby authorized and directed to honor
27  by making such transfers, and the moneys so transferred shall be for use
28  All moneys in such bank account shall be used by the board of trustees
29  of the state of Kansas sports hall of fame in operating and conducting the
30  activities of the state of Kansas sports hall of fame. The board of trustees
31  of the state of Kansas sports hall of fame shall make a full and complete
32  report on a monthly basis and by object classification to the state historical
33  society of all expenditures for each fiscal year from such bank account
34  keep and maintain accounting records of receipts, expenditures and other
35  disbursements in accordance with procedures and guidelines approved by
36  the director of accounts and reports therefor. All receipts, accounts, ex-
37  penditures and other disbursements from the moneys of the state of Kan-
38  sas sports hall of fame shall be subject to audit in accordance with the
39  legislative post audit act.
40    Sec. 3.  K.S.A. 74-2906a and K.S.A. 1996 Supp. 74-2912 are hereby
41  repealed.
42    Sec. 4.  This act shall take effect and be in force from and after its
43  publication in the statute book.
