10 AN ACT concerning the Kansas bureau of investigation; relating to the 11 powers, duties and functions thereof; authorizing acceptance of gifts 12 and grants; background investigations; amending K.S.A. 75-712 and 13 repealing the existing section. 14 15 Be it enacted by the Legislature of the State of Kansas: 16 Section 1. K.S.A. 75-712 is hereby amended to read as follows: 75- 17 712. (a) It shall be is the duty of the members of the bureau to make full 18 and complete investigations at the direction of the attorney general. Each 19 member of the bureau shall possess all powers and privileges which are 20 now or may be hereafter given to the sheriffs of the state of Kansas. 21 (b) The bureau shall be vested with the duty of acquiring, collecting, 22 classifying, and preserving acquire, collect, classify and preserve criminal 23 identification and other crime records, and the exchanging of said may 24 exchange such criminal identification records with the duly authorized 25 officials of governmental agencies, of states, cities and penal institutions. 26 (c) For purposes of carrying out the powers and duties of the bureau, 27 the director may request and accept grants or gifts donations from any 28 person, firm, association or corporation or from the federal government 29 or any federal agency and may enter into contracts or other transactions 30 with any federal agency in connection therewith. 31 (d) Members of the bureau, at the direction of the director, may con- 32 duct background investigations at the request of the governor of Kansas. 33 Reports of such background investigations, including criminal history rec- 34 ord information and intelligence information, shall be made to the gov- 35 ernor. of gubernatorial appointees at the request of the governor, 36 subject to the appointee's approval. The bureau shall require the 37 appointee to be fingerprinted. The fingerprints shall be submitted 38 to the bureau and to the federal bureau of investigation for the 39 identification of the appointee and to obtain criminal history rec- 40 ord information, including arrest and nonconviction data. Back- 41 ground reports may include criminal intelligence information and 42 information relating to criminal and background investigations. 43 Information received pursuant to this subsection shall be confi- HB 2484--Am.

 1  dential and shall not be disclosed except to the governor or mem-
 2  bers of the governor's staff as necessary to determine the appoin-
 3  tee's qualifications.
 4    (e)   Reports of all investigations made by the members of the bureau
 5  shall be made to the attorney general of the state of Kansas.
 6    Sec. 2.  K.S.A. 75-712 is hereby repealed.
 7    Sec. 3.  This act shall take effect and be in force from and after its
 8  publication in the Kansas register.
