9 AN ACT concerning state officers and employees; relating to salaries and
10 compensation of certain state officers and employees; amending K.S.A.
11 40-110 and 75-3111 and repealing the existing sections.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. K.S.A. 40-110 is hereby amended to read as follows: 40-
15 110. The commissioner of insurance is hereby authorized to appoint an
16 assistant commissioner of insurance, actuaries, two (2) special attorneys
17 who shall have been regularly admitted to practice be admitted to practice
18 law in the state of Kansas, an executive secretary, policy examiners, two
19 (2) field representatives, and a secretary to the commissioner. Such ap-
20 pointees shall each receive an annual salary to be determined by the
21 commissioner of insurance, within the limits of available appropriations,
22 but in no case shall such annual salary exceed the salary of the commis-
23 sioner of insurance as established by law. He The commissioner is also
24 authorized to appoint, within the provisions of the civil service law, and
25 available appropriations, such other employees as shall be necessary to
26 administer the provisions of this act. The field representatives authorized
27 by this section may be empowered to conduct inquiries, investigations,
28 or to receive complaints: Provided, however, That. Such field represen-
29 tatives shall not be empowered to make, or direct to be made, an exam-
30 ination of the affairs and financial condition of any insurance company in
31 the process of organization, or applying for admission or doing business
32 in this state.
33 The appointees herein provided for shall take the proper official oath
34 and shall be in no way interested have no financial interest, except as
35 policyholders, in any insurance company. In the absence of the commis-
36 sioner of insurance the assistant commissioner shall perform the duties
37 of the commissioner of insurance, but shall in all cases execute papers in
38 the name of the commissioner of insurance, by himself as assistant. The
39 commissioner of insurance shall be responsible for all acts of an official
40 nature done and performed by his the commissioners assistant or any
41 person employed in his the office. All the appointees authorized by this
42 section shall hold their office at the will and pleasure of the commissioner
43 of insurance.

1 Sec. 2. K.S.A. 75-3111 is hereby amended to read as follows: 75-
2 3111. The attorney general is hereby authorized to appoint such deputy
3 and assistant attorneys general as the attorney general may deem neces-
4 sary, who shall each receive an annual salary to be established by the
5 attorney general within the limits of available appropriations. The annual
6 salary of any deputy or assistant attorney general shall not exceed the
7 annual salary of the attorney general as established by law. The attorney
8 general is also authorized to appoint investigators who shall have and
9 exercise law enforcement powers to the same extent as other law enforce-
10 ment officers, and such other employees as may be necessary to discharge
11 the duties of the office of attorney general. All of said such employees
12 shall be within the unclassified service under the Kansas civil service act.
13 Sec. 3. K.S.A. 40-110 and 75-3111 are hereby repealed.
14 Sec. 4. This act shall take effect and be in force from and after its
15 publication in the statute book.
