12  AN ACT concerning the Kansas public employees retirement system and
13    systems thereunder; relating to postretirement benefit increase.

15  Be it enacted by the Legislature of the State of Kansas:
16    Section 1.  (a) The retirement benefit, pension or annuity payments
17  accruing after June 30, 1997, to each retirant and each local school an-
18  nuitant from the retirant's retirement system, shall be increased by an
19  amount equal to the greater of:  (1) 3.5% of the retirement benefit, pen-
20  sion or annuity payment in effect on July 1, 1997; or (2) $.50 for each
21  year of credited service and $.50 for each year since the retirant's or local
22  school annuitant's retirement or, if a disability recipient, $.50 for each
23  year of disability from the retirant's retirement system. For the purpose
24  of determining years of credited service and years of retirement and dis-
25  ability, as provided in this section, a remainder of six months or more will
26  be rounded to a whole year and a remainder of less than six months will
27  be disregarded. Such payments shall be paid by such retirement system
28  to the retirant or to the local school annuitant during such period.
29    (b)  As used in this section:
30    (1)  ``Retirant'' means (A) any person who is a member of a retirement
31  system and who retired prior to July 1, 1997, (B) any person who is a
32  special member of a retirement system and who retired prior to July 1,
33  1997, (C) any person who is a joint annuitant or beneficiary of any mem-
34  ber described in clause (A) or any special member described in clause
35  (B), and (D) any insured disability benefit recipient.
36    (2)  ``Retirement system'' means the Kansas public employees retire-
37  ment system, the Kansas police and firemen's retirement system, the state
38  school retirement system and the retirement system for judges.
39    (3)  ``Local school annuitant'' means (A) any person who is an annui-
40  tant with 10 or more years of service, who is receiving an annuity, whose
41  annuity is not included, in whole or in part, in payments made to such
42  school district under K.S.A. 72-5512b, and amendments thereto, and who
43  is not a member of a group I or of group II as defined in K.S.A. 72-5518,

 1  and amendments thereto, and (B) any person who is receiving an annuity
 2  and who retired prior to September 1, 1981.
 3    (4)  ``Insured disability benefit recipient'' means any person receiving
 4  an insured disability benefit under K.S.A. 74-4927, and amendments
 5  thereto, prior to July 1, 1997.
 6    Sec. 2.  This act shall take effect and be in force from and after its
 7  publication in the statute book.
