9 AN ACT regulating traffic; concerning alteration of maximum speed lim- 10 its by local authorities; amending K.S.A. 1996 Supp. 8-1560 and re- 11 pealing the existing section. 12 13 Be it enacted by the Legislature of the State of Kansas: 14 Section 1. K.S.A. 1996 Supp. 8-1560 is hereby amended to read as 15 follows: 8-1560. (a) Whenever local authorities in their respective juris- 16 dictions determine on the basis of an engineering and traffic investigation 17 that the maximum speed permitted is greater or less than is reasonable 18 and safe under the conditions found to exist upon a highway or part of a 19 highway, the local authority may determine and declare a reasonable and 20 safe maximum limit thereon which: 21 (1) Decreases the limit at intersections; 22 (2) increases the limit within an urban district but not to exceed the 23 maximum speed of 65 miles per hour; 24 (3) decreases the limit outside an urban district, but not to less than 25 20 miles per hour, except as authorized by K.S.A. 1996 Supp. 8-1560a, 26 and amendments thereto; 27 (4) decreases the limit within an urban district in a school zone to 28 not less than 20 miles per hour, except that any such decreased limit shall 29 apply only during the hours in which students are normally en route to 30 or from school, such zones and hours to be determined by ordinance or 31 resolution of such local authority; or 32 (5) decreases the limit within any residence district, but not to less 33 than 20 miles per hour. 34 (b) Local authorities in their respective jurisdictions may determine 35 by based on an engineering and traffic investigation or without an engi- 36 neering and traffic investigation the proper maximum speed for all ar- 37 terial streets and shall declare a reasonable and safe maximum limit 38 thereon which may be greater or less than the maximum speed permitted 39 under this act for an urban district or other location in which the arterial 40 street is situated, except that in no event shall any local authority establish 41 any such maximum limit in excess of 65 miles per hour. 42 (c) Except as otherwise provided in paragraph (4) of subsection (a), 43 any altered limit established as authorized shall be effective at all times HB 2426

 1  or during hours of darkness or at other times as may be determined when
 2  appropriate signs giving notice thereof are erected upon such street or
 3  highway.
 4    (d)  Any alteration of maximum limits on city connecting links shall
 5  not be effective until such alteration has been approved by the secretary
 6  of transportation.
 7    (e)  If local authorities in their respective jurisdictions have estab-
 8  lished a speed limit within any residence district which is less than 30
 9  miles per hour, prior to the effective date of this act, such speed limit
10  shall be deemed valid and shall not require an engineering and traffic
11  investigation.
12    (f)  Local authorities in their respective jurisdictions may establish the
13  speed limit within a road construction zone, as defined in K.S.A. 1996
14  Supp. 8-1458a, and amendments thereto, upon any highway under the
15  jurisdiction of such local authorities.
16    (g)  The provisions of K.S.A. 1996 Supp. 8-1560b, and amendments
17  thereto, shall apply to the limitations on speed limits provided by subsec-
18  tion (a) of this section.
19    Sec. 2.  K.S.A. 1996 Supp. 8-1560 is hereby repealed.
20    Sec. 3.  This act shall take effect and be in force from and after its
21  publication in the Kansas register.
