9 AN ACT concerning fiscal notes for legislative bills; amending K.S.A.
10 1996 Supp. 75-3715a and repealing the existing section.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. K.S.A. 1996 Supp. 75-3715a is hereby amended to read
14 as follows: 75-3715a. (a) Fiscal notes shall be provided for all bills in-
15 creasing or decreasing state revenues or the revenues of counties, cities
16 and school districts, making state appropriations or increasing or decreas-
17 ing existing appropriations or the fiscal liability of the state, or imposing
18 functions or responsibilities on counties, cities and school districts which
19 will increase their expenditures or fiscal liability. The director of the
20 budget, or the director's designee, shall consult with the League of Kansas
21 municipalities, Kansas association of counties and the Kansas association
22 of school boards, as appropriate, when preparing such fiscal notes. Not
23 more than seven 10 days following the first reading of any such bill, the
24 director of the budget shall furnish to the committee or committees to
25 which such bill was referred a statement explaining the fiscal effect of
26 such bill. Fiscal notes are required for original bills only and not for
27 amendments.
28 (b) Upon the request by the chairperson, vice-chairperson or ranking
29 minority member of a committee which has acted to report any such bill
30 to the senate or house of representatives, as the case may be, with the
31 recommendations that the bill be amended and be passed as amended, the
32 director of the budget shall review the current fiscal note on any such bill
33 with respect to amendments recommended by the committee and shall
34 revise the fiscal note if the amendments would change the fiscal effect of
35 the bill.
36 (c) The Each original or revised fiscal note, if possible, shall include a
37 reliable estimate in dollars of the anticipated change in revenue, expend-
38 itures, or fiscal liability under the provisions of the bill. It also shall include
39 a statement as to the immediate effect and, if determinable or reasonably
40 foreseeable, the long-range effect of the measure. If, after careful inves-
41 tigation, it is determined that no dollar estimate is possible, the note shall
42 contain a statement to that effect, setting forth the reasons why no dollar
43 estimate can be given. Every agency and department of the state is di-

1 rected to cooperate with the division of the budget in preparation of any
2 fiscal note provided for by this act when, and to the extent, requested by
3 the director of the budget.
4 (d) No comment or opinion shall be included in the fiscal note re-
5 garding the merits of the measure for which the note is prepared.
6 Sec. 2. K.S.A. 1996 Supp. 75-3715a is hereby repealed.
7 Sec. 3. This act shall take effect and be in force from and after its
8 publication in the statute book.
