10 AN ACT concerning Kansas state university, authorizing the state board
11 of regents to convey title to certain real estate located in Clay and
12 Washington counties; providing for the disposition of proceeds.

14 Be it enacted by the Legislature of the State of Kansas:
15 Section 1. (a) The state board of regents is hereby authorized and
16 empowered, for and on behalf of Kansas state university of agriculture
17 and applied science, to convey by warranty deed all of the right, title and
18 interest in the Clay county tract and in the Washington county tract, which
19 were both bequeathed to Kansas state university of agriculture and ap-
20 plied science from the estate of Della M. Serles, deceased, and which
21 were received by the Kansas state university endowment association, inc.,
22 as recited in the order of final distribution of the estate by the district
23 court of Clay county, Kansas, case no. 8528.
24 (b) The state board of regents shall convey by warranty deed the title
25 to the Clay county tract to the purchaser thereof in accordance with the
26 agreement to sell the Clay county tract which was entered into by Kansas
27 state university foundation prior to the effective date of this act and shall
28 convey by warranty deed the title to the Washington county tract to the
29 purchaser thereof in accordance with the agreement to sell the Washing-
30 ton county tract which was entered into by the Kansas state university
31 foundation prior to the effective date of this act. Prior to execution, each
32 such warranty deed shall be reviewed and approved by the attorney gen-
33 eral as to form and legality. The proceeds from the sales of the Clay county
34 tract and the Washington county tract, and any earnings thereon, shall be
35 transferred and credited to an account in the name of Kansas state uni-
36 versity of agriculture and applied science under an investment agency
37 agreement with the Kansas state university endowment foundation, inc.,
38 pursuant to K.S.A. 76-156a, and amendments thereto.
39 (c) As used in this section,
40 (1) ``Clay county tract'' means: The Northwest Quarter (NW 1/4) of
41 the Northeast Quarter (NE 1/4) of Section Four (4), Township Six (6)
42 South, Range Three (3) East of the 6th P.M., and; the Southwest Quarter
43 (SW 1/4) of the Northeast Quarter (NE 1/4) and forty (40) acres off the East

1 side of the Northwest Quarter (NW 1/4), all in Section Four (4), Township
2 Six (6) South, Range Three (3) East of the 6th P.M., Clay County, Kansas;
3 and
4 (2) ``Washington county tract'' means: The South Half (S 1/2) of the
5 Northeast Quarter (NE 1/4) and the Southeast Quarter (SE 1/4) of Section
6 Thirty-three (33), Township Four (4) South, Range Five (5) East of the
7 6th P.M., containing 240 acres, more or less; and Lots No. One (1) and
8 No. Two (2) in the West Half (W 1/2) of the Northeast Quarter (NE 1/4) of
9 Section Four (4), Township Five (5) South, Range Five (5) East of the
10 6th P.M. described as follows: Lot No. One (1) being a one acre tract of
11 land in the West Half (W 1/2) of the Northeast Quarter (NE 1/4) of said
12 Section Four (4) lying North of Coon Creek, and Lot No. Two (2) being
13 four acres out of the Northwest Quarter (NW 1/4) of the Northeast Quarter
14 (NE 1/4) of said Section Four (4) lying North of Coon Creek, and all five
15 acres, more or less, Washington County, Kansas.
16 Sec. 2. This act shall take effect and be in force from and after its
17 publication in the Kansas register.
