9 AN ACT concerning state officers and employees; relating to establishing 10 smoking rooms in buildings regularly occupied by state officers and 11 employees; amending K.S.A. 21-4016 and repealing the existing 12 section. 13 14 Be it enacted by the Legislature of the State of Kansas: 15 New Section 1. (a) The head of each state agency having control of 16 any building regularly occupied by state officers and employees, may des- 17 ignate one separate, indoor room available for persons to smoke cigarettes 18 or other tobacco products. 19 (b) As soon after the effective date of this act as practicable where 20 smoking rooms are designated, existing physical barriers and ventilation 21 systems shall be used to minimize the toxic effect of smoke in adjacent 22 nonsmoking areas. 23 (c) Each smoking room shall contain a posted notice containing a 24 statement in bold print that smoking of cigarettes and other tobacco prod- 25 ucts are permitted and that the room is designated as a smoking room. 26 The notice shall be posted in a conspicuous place in the designated smok- 27 ing room. Each designated smoking room shall be inspected and ap- 28 proved by the director of architectural services. 29 (d) As used in this section: 30 (1) ``Building'' means any building or enclosed facility that includes 31 offices or other work stations for state officers and employees; 32 (2) ``Cigarettes'' has the meaning ascribed thereto in subsection (a) 33 of K.S.A. 79-3301, and amendments thereto; and 34 (3) ``Tobacco products'' has the meaning ascribed thereto in subsec- 35 tion (b) of K.S.A. 79-3301, and amendments thereto. 36 Sec. 2. K.S.A. 21-4016 is hereby amended to read as follows: 21- 37 4016. Prior to July 1, 1995, No person shall smoke in any area, room or 38 hallway in the state capitol except in offices occupied as office space by 39 state officers and employees which have been designated as smoking areas 40 in accordance with K.S.A. 21-4009 et seq. and amendments thereto. On 41 and after July 1, 1995, no person shall smoke in any area, room, hallway, 42 or other place in the state capitol and no area of the state capitol shall be 43 established as a designated smoking area under K.S.A. 21-4010 and HB 2383

 1  amendments thereto instructions or approval of the legislative coordi-
 2  nating council.
 3    Sec. 3.  K.S.A. 21-4016 is hereby repealed.
 4    Sec. 4.  This act shall take effect and be in force from and after its
 5  publication in the statute book.
