AN ACT concerning cities and counties; relating to planning and zoning. Be it enacted by the Legislature of the State of Kansas: Section 1. (a) Before any city adopts a comprehensive plan pursuant to K.S.A. 12-741 et seq., and amendments thereto, the governing body shall adopt a resolution stating the governing body's intent to adopt a comprehensive plan. Such resolution shall be published at least once each week for two consecutive weeks in a newspaper of general circulation within the city. If the plan includes provisions relating to land outside the corporate limits of the city, the resolution also shall be published in a newspaper of general circulation within such area. The resolution shall include a notice that if within 30 days following the last publication of the resolution a petition in opposition to the resolution, signed by not less than 5% of the qualified electors of the city and the affected area outside such city, if applicable, is filed with the county election officer, the gov- erning body shall submit the question of adoption of the plan to the qualified electors of the city and the area outside such city, if applicable. If a sufficient petition is filed, the plan shall not be adopted unless the question is submitted to and approved by a majority vote of the qualified electors of the city and the area outside the city, if applicable. Such elec- tion shall be called and held in the manner provided by the general bond law. (b) Before any county adopts a comprehensive plan pursuant to K.S.A. 12-741 et seq., and amendments thereto, the board of county commissioners shall adopt a resolution stating the board's intent to adopt a comprehensive plan. Such resolution shall be published at least once each week for two consecutive weeks in a newspaper of general circula- tion within the county. The resolution shall include a notice that if within 30 days following the last publication of the resolution a petition in op- position to the resolution, signed by not less than 5% of the qualified electors of the unincorporated area of the county is filed with the county election officer, the board shall submit the question of adoption of the plan to the qualified electors of the unincorporated area of the county.  2  called and held in the manner provided by the general bond law.
 3    Sec. 2.  This act shall take effect and be in force from and after its
 4  publication in the statute book.
