 9  AN ACT concerning the Kansas public employees retirement system and
10    systems thereunder; relating to postretirement benefit increase for
11    certain retirants; amending K.S.A. 1996 Supp. 74-4950f and repealing
12    the existing section.

14  Be it enacted by the Legislature of the State of Kansas:
15    Section 1.  K.S.A. 1996 Supp. 74-4950f is hereby amended to read as
16  follows: 74-4950f. (a) (1) Effective July 1, 1993, the retirement benefit,
17  pension or annuity payments accruing after June 30, 1993, to each retirant
18  and each local school annuitant with less than 15 years of service credit
19  from the retirant's retirement system or the local school annuitant's sep-
20  arate retirement system maintained by a local school district, shall be
21  increased by an amount equal to $10 or 5% of the retirement benefit,
22  pension or annuity payment in effect on June 30, 1993, from the retirant's
23  retirement system or the local school annuitant's separate retirement sys-
24  tem maintained by a local school district, whichever is greater, and shall
25  be paid by such retirement system to the retirant or by such separate
26  retirement system maintained by a local school district to the local school
27  annuitant during such period. All such increased payments to local school
28  annuitants shall be paid by the local school district maintaining a separate
29  retirement system and such payments shall be made at no additional cost
30  to any employer other than the local school district.
31    (2)  Effective July 1, 1993, the retirement benefit, pension or annuity
32  payments accruing after June 30, 1993, to each retirant and each local
33  school annuitant with 15 or more years of service credit from the retirant's
34  retirement system or the local school annuitant's separate retirement sys-
35  tem maintained by a local school district, shall be increased by an amount
36  equal to $50 or 15% of the retirement benefit, pension or annuity pay-
37  ment in effect on June 30, 1993 such increase not to exceed $200, from
38  the retirant's retirement system or the local school annuitant's separate
39  retirement system maintained by a local school district, whichever is
40  greater, and shall be paid by such retirement system to the retirant or by
41  such separate retirement system maintained by a local school district to
42  the local school annuitant during such period. All such increased pay-
43  ments to local school annuitants shall be paid by the local school district

 1  maintaining a separate retirement system and such payments shall be
 2  made at no additional cost to any employer other than the local school
 3  district.
 4    (3)  Effective July 1, 1997, the retirement benefit, pension or annuity
 5  payments accruing after June 30, 1997, to each retirant and each local
 6  school annuitant whose benefit increase as provided in subsection (a)(2)
 7  exceeded $200 shall be increased by an amount equal to the difference
 8  between 15% of the retirement benefit, pension or annuity payment in
 9  effect on June 30, 1997, and $200. Any changes in this act which provide
10  an increase in benefits which are effective on July 1, 1997, are a prospec-
11  tive only increase in benefits and shall not be construed as providing a
12  retroactive increase in benefits.
13    (b)  As used in this section:
14    (1)  ``Retirant'' means (A) any person who is a member or special
15  member of a retirement system, who retired prior to July 1, 1993, (B)
16  any person who is a joint annuitant or beneficiary of any member or
17  special member described in clause (A).
18    (2)  ``Retirement system'' means the Kansas public employees retire-
19  ment system, the Kansas police and firemen's retirement system, the state
20  school retirement system and the retirement system for judges.
21    (3)  ``Local school annuitant'' means (A) any person who is an annui-
22  tant with 10 or more years of service, who is receiving an annuity from a
23  school district maintaining a separate retirement system, whose annuity
24  is not included, in whole or in part, in payments made to such school
25  district under K.S.A. 72-5512b and amendments thereto and who is not
26  a member of group I or of group II as defined in K.S.A. 72-5518 and
27  amendments thereto, and (B) any person who is receiving an annuity from
28  a school district maintaining a separate retirement system which is re-
29  ceiving an aggregate payment from the Kansas public employees retire-
30  ment system under K.S.A. 72-5512b and amendments thereto and who
31  retired prior to September 1, 1981.
32    Sec. 2.  K.S.A. 1996 Supp. 74-4950f is hereby repealed.
33    Sec. 3.  This act shall take effect and be in force from and after its
34  publication in the statute book.
