9 AN ACT concerning hunting by certain nonresidents; amending K.S.A.
10 32-980 and repealing the existing section.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. K.S.A. 32-980 is hereby amended to read as follows: 32-
14 980. (a) The secretary shall adopt, in accordance with K.S.A. 32-805 and
15 amendments thereto, rules and regulations prescribing:
16 (1) Procedures for, the form and content of and the requirements for
17 applications for licenses, permits, stamps and other issues of the depart-
18 ment, and duplicates thereof; and
19 (2) procedures for issuance of and the form and content of licenses,
20 permits, stamps and other issues of the department, and duplicates
21 thereof.
22 (b) The secretary shall provide for both resident and nonresident li-
23 censes, permits, stamps and other issues of the department, and dupli-
24 cates thereof, except that:
25 (1) A nonresident who is on active duty with any branch or depart-
26 ment of the armed forces of the United States while stationed within this
27 state shall be entitled to obtain a resident hunting or fishing license, or
28 both, but such person is required to may purchase licenses, permits,
29 stamps and other issues of the department, except a lifetime fishing, hunt-
30 ing or combination hunting and fishing license as provided in K.S.A. 32-
31 930 and amendments thereto, and may engage in any activity authorized
32 by such license, permit, stamp or other issue under the same conditions
33 as a resident of this state. Such person shall carry in the person's posses-
34 sion when fishing or hunting such license, permit, stamp or other issue
35 and a card or other evidence identifying such person as being on active
36 duty in the armed forces of the United States;.
37 (2) A person who is on active duty with any branch or department of
38 the armed forces of the United States and who was a resident of this state
39 immediately prior to entry into the armed forces may purchase licenses,
40 permits, stamps and other issues of the department and may engage in
41 any activity authorized by such license, permit, stamp or other issue under
42 the same conditions as a resident of this state; and.
43 (3) A nonresident who is a registered full time student in residence

1 of a public or private secondary, postsecondary or vocational school lo-
2 cated in this state shall be entitled to obtain a resident hunting or fishing
3 license, or both, but such person is required to may purchase licenses,
4 permits, stamps and other issues of the department, except a lifetime fish-
5 ing, hunting or combination hunting and fishing license as provided in
6 K.S.A. 32-930 and amendments thereto, and may engage in any activity
7 authorized by such license, permit, stamp or other issue under the same
8 conditions as a resident of this state. Such person shall carry in the per-
9 son's possession when fishing or hunting such license, permit, stamp or
10 other issue and a card or other evidence identifying such person as a full
11 time student.
12 Sec. 2. K.S.A. 32-980 is hereby repealed.
13 Sec. 3. This act shall take effect and be in force from and after its
14 publication in the statute book.
