9 AN ACT concerning hunting and fishing by persons with certain disabil- 10 ities; amending K.S.A. 32-931 and 32-932 and repealing the existing 11 sections. 12 13 Be it enacted by the Legislature of the State of Kansas: 14 Section 1. K.S.A. 32-931 is hereby amended to read as follows: 32- 15 931. (a) Whenever a disabled person is unable by reason of physical in- 16 firmity to hunt and fish in the normal manner, the secretary may issue a 17 handicapped hunting and fishing permit upon receipt of the fee pre- 18 scribed pursuant to K.S.A. 32-988 and amendments thereto, permitting 19 such person to hunt and fish from land or water vehicles, but such permit 20 shall not authorize any person to shoot from any highway, as defined in 21 K.S.A. 8-1424 and amendments thereto. 22 (b) Any person having a permanent physical or visual disability to 23 the extent that such person cannot safely hold, aim or shoot a firearm, or 24 to the extent that such person cannot hold, operate or safely and appro- 25 priately utilize other equipment involved in hunting or fishing, as certified 26 by a person licensed in this state to practice optometry, ophthalmology 27 or medicine and surgery; shall be eligible to obtain a hunting or fishing 28 license having all privileges and restrictions of such license when issued 29 to a nondisabled person, except that such license shall be clearly marked 30 with the designation ``DISABILITY ASSISTANCE PERMITTED.'' Such 31 marking and designation shall permit another person who holds all valid 32 licenses, permits, stamps or other issues of the department that are re- 33 quired for the activities being engaged in and are issued to such other 34 person, to operate firearms or other hunting or fishing equipment as di- 35 rected by the disability assistance permitted licensee. Such licensee shall 36 have all rights, privileges, responsibilities and restrictions available to 37 other license holders, including those connected with obtaining of stamps 38 and permits, and shall have the right to take game as allowed by such 39 stamps and permits. 40 (c) The secretary may adopt, in accordance with K.S.A. 32-805 and 41 amendments thereto, rules and regulations necessary to implement this 42 section. 43 Sec. 2.  1    (a) Any person having a permanent disability to the extent that such per-
 2  son cannot physically use a conventional long bow or compound bow, as
 3  certified by a person licensed to practice medicine and surgery in this
 4  state, shall be authorized to hunt and take deer or antelope with a cross-
 5  bow.
 6    (b)  Any person having a permanent physical or visual disability to
 7  the extent that such person cannot safely hold, aim or shoot a conventional
 8  long bow or compound bow, as certified by a person licensed in this state
 9  to practice optometry, ophthalmology or medicine and surgery, shall be
10  eligible to receive a hunting license clearly marked with the designation
11  ``DISABILITY ASSISTANCE PERMITTED.'' Such marking and desig-
12  nation shall permit another person who holds a valid hunting license and
13  all required permits, stamps or other issues of the department that are
14  required for the activity being engaged in and that are issued to such
15  other person, to operate a conventional long bow or compound bow, for
16  and on behalf of the disability assistance permitted licensee as the licensee
17  directs. Such licensee shall have all rights and privileges to hunt and take
18  deer or antelope as are afforded to any and all hunters holding licenses
19  and permits for that purpose.
20    (c)  The secretary of wildlife and parks shall adopt, in accordance with
21  K.S.A. 32-805, and amendments thereto, rules and regulations requiring
22  permits to hunt deer or antelope pursuant to subsection (a) and providing
23  for the approval of applicants for such permits and the issuance thereof.
24  In addition, the secretary may adopt rules and regulations limiting the
25  times and areas for hunting and taking deer and antelope and limiting
26  the number of deer and antelope which may be taken pursuant to sub-
27  section (a).
28    (c) (d)  Falsely obtaining or using a permit authorized by this section
29  is a class C misdemeanor.
30    Sec. 3.  K.S.A. 32-931 and 32-932 are hereby repealed.
31    Sec. 4.  This act shall take effect and be in force from and after its
32  publication in the statute book.
