 9  AN ACT prohibiting smoking in certain public places and meetings;
10    amending K.S.A. 21-4010 and repealing the existing section.

12  Be it enacted by the Legislature of the State of Kansas:
13    Section 1.  K.S.A. 21-4010 is hereby amended to read as follows: 21-
14  4010. (a) No person shall smoke in a public place or at a:
15    (1)  In a public place or at a public meeting if such place or meeting
16  is accessible to minors; or (2) in any other public place or at any other
17  public meeting except in designated smoking areas.
18    (b)  Smoking areas may be designated by proprietors or other persons
19  in charge of public places, except in public places accessible to minors,
20  passenger elevators, school buses, public means of mass transportation
21  and any other place in which smoking is prohibited by the fire marshal
22  or by other law, ordinance or regulation.
23    (c)  Where smoking areas are designated, existing physical barriers
24  and ventilation systems shall be used to minimize the toxic effect of smoke
25  in adjacent nonsmoking areas.
26    Sec. 2.  K.S.A. 21-4010 is hereby repealed.
27    Sec. 3.  This act shall take effect and be in force from and after its
28  publication in the statute book.
