10 AN ACT relating to school buses; concerning exemptions from certain
11 requirements; amending K.S.A. 1996 Supp. 8-2009a and repealing the
12 existing section.

14 Be it enacted by the Legislature of the State of Kansas:
15 Section 1. K.S.A. 1996 Supp. 8-2009a is hereby amended to read as
16 follows: 8-2009a. (a) Every school bus, as defined in K.S.A. 8-1461, and
17 amendments thereto, shall be governed by the requirements of law and
18 rules and regulations of the state board of education applicable to design,
19 lighting equipment, distinctive markings, special warning devices, and any
20 other equipment which are in effect on the date any such school bus is
21 purchased or otherwise acquired, and shall be exempt from the require-
22 ments of law and rules and regulations which become effective at any
23 time during a period of 12 20 years from the date of manufacture of such
24 school bus, except that:
25 (1) Any any school bus which was in operation on the effective date
26 of this act July 1, 1994, and exceeds such 12-year 20-year period shall
27 be exempt until July 1, 1998;
28 (2) any school bus which has been operated for less than 100,000
29 miles and which passes an annual inspection, as provided in subsection
30 (b), shall be exempt for a period of 16 years from the date of manufacture
31 of such school bus; and
32 (3) any school bus which meets the definition of a spare school bus
33 and which passes an annual inspection as provided in subsection (b), shall
34 be exempt for a period of 16 years from the date of manufacture of such
35 school bus.
36 The state board of education is hereby required to approve any such
37 school bus as to design, and as to lighting equipment, special warning
38 devices, distinctive markings, and any other equipment required by law
39 and rules and regulations, for operation as a school bus during such ex-
40 emption period upon submission of a request for such approval.
41 (b) In addition to the annual inspection conducted by the Kansas
42 highway patrol, school buses under paragraphs (2) and (3) of subsection
43 (a) shall pass an annual inspection conducted by an authorized new ve-

1 hicle dealer, as defined in K.S.A. 8-2401, and amendments thereto. The
2 state board of education shall develop and establish the procedure for and
3 the items to be included in such inspection. Such items shall include,
4 inspection of the school bus chassis, fuel tank and braking system.
5 (b) (c) (b) The state board of education is authorized to establish the
6 procedure to be followed when request for approval of any such school
7 bus is submitted under this section. The approval shall be in writing and
8 a copy of the written approval shall be carried in the school bus at all
9 times, but failure to carry such copy of the written approval shall not
10 affect the status of the school bus as an approved school bus. The state
11 board of education shall maintain a list of all such school buses which
12 have been approved by the board.
13 (d) As used in this section, ``spare school bus'' means any school bus
14 which is not used on a regular basis on any regular route, established
15 under K.S.A. 72-8303, and amendments thereto, and is used only on a
16 temporary basis as a replacement for a regular route school bus.
17 Sec. 2. K.S.A. 1996 Supp. 8-2009a is hereby repealed.
18 Sec. 3. This act shall take effect and be in force from and after its
19 publication in the statute book.
