 1  Be it enacted by the Legislature of the State of Kansas:
 2    Section 1.  (a) For the fiscal year ending June 30, 1997, appropria-
 3  tions are hereby made, restrictions and limitations are hereby imposed,
 4  and transfers, [capital improvement projects,] fees, receipts, disburse-
 5  ments and acts incidental to the foregoing are hereby directed or au-
 6  thorized as provided in this act.
 7    Sec. 2.
 8  STATE BOARD OF HEALING ARTS
 9    (a)  On the effective date of this act, the expenditure limitation estab-
10  lished for the fiscal year ending June 30, 1997, by section 82(a) of chapter
11  191 of the 1996 Session Laws of Kansas on the expenditures from the
12  healing arts fee fund is hereby decreased from $1,756,937 to $1,577,418.
13    Sec. 3.
14  STATE BOARD OF VETERINARY EXAMINERS
15    (a)  On the effective date of this act, the expenditure limitation estab-
16  lished for the fiscal year ending June 30, 1997, by section 85(a) of chapter
17  191 of the 1996 Session Laws of Kansas on the veterinary examiners fee
18  fund is hereby increased from $167,517 to $187,269.
19    Sec. 4.
20  KANSAS STATE BOARD OF COSMETOLOGY
21    (a)  On the effective date of this act, the position limitation for the
22  fiscal year ending June 30, 1997, established by section 22 of chapter 224
23  of the 1995 Session Laws of the Kansas for the Kansas state board of
24  cosmetology is hereby increased from 9.0 to 10.0.
25    Sec. 5.
26  BOARD OF NURSING
27    (a)  On the effective date of this act, the expenditure limitation estab-
28  lished for the fiscal year ending June 30, 1997, by section 14(a) of chapter
29  224 of the 1995 Session Laws of Kansas on the board of nursing fee fund
30  is hereby increased from $887,646 to $891,763.
31    Sec. 6.
32  KANSAS DENTAL BOARD
33    (a)  On the effective date of this act, the expenditure limitation estab-
34  lished for the fiscal year ending June 30, 1997, by section 10(a) of chapter
35  224 of the 1995 Session Laws of Kansas on the dental board fee fund is
36  hereby decreased from $206,743 to $184,830.
37    Sec. 7.
38  STATE DEPARTMENT OF CREDIT UNIONS
39    (a)  On the effective date of this act, the expenditure limitation estab-
40  lished for the fiscal year ending June 30, 1997, by section 33(a) of chapter
41  272 of the 1996 Session Laws of Kansas on the credit union fee fund is
42  hereby increased from $705,859 to $723,185.

 1    Sec. 8.
 2  STATE BANK COMMISSIONER
 3    (a)  On the effective date of this act, the expenditure limitation estab-
 4  lished for the fiscal year ending June 30, 1997, by section 30(a) of chapter
 5  272 of the 1996 Session Laws of Kansas on the bank commissioner fee
 6  fund is hereby decreased from $3,643,395 to $3,510,542.
 7    Sec. 9.
 8  CONSUMER CREDIT COMMISSIONER
 9    (a)  On the effective date of this act, the expenditure limitation estab-
10  lished for the fiscal year ending June 30, 1997, by section 31(a) of chapter
11  272 of the 1996 Session Laws of Kansas on the consumer credit fee fund
12  is hereby increased from $362,478 to $368,097.
13    Sec. 10.
14  OFFICE OF THE SECURITIES COMMISSIONER OF KANSAS
15    (a)  On the effective date of this act, the expenditure limitation estab-
16  lished for the fiscal year ending June 30, 1997, by section 19(a) of chapter
17  224 of the 1995 Session Laws of Kansas on the securities act fee fund is
18  hereby increased from $1,594,886 to $1,637,813.
19    (b)  Upon request of the securities commissioner, the director of ac-
20  counts and reports shall transfer one or more amounts of money from
21  the securities act fee fund for the fiscal year ending June 30, 1997, to the
22  appropriate account of the restricted fees fund of Wichita state university
23  pursuant to a contract which is hereby authorized to be entered into by
24  the securities commissioner and the Kansas council on economic edu-
25  cation of Wichita state university to conduct a securities and investment
26  education program: Provided, That any transfer of money from the se-
27  curities act fee fund for the fiscal year ending June 30, 1997, to the ap-
28  propriate account of the restricted fees fund of Wichita state university
29  pursuant to such contract shall be in addition to any expenditure limita-
30  tion imposed on the securities act fee fund for the fiscal year ending June
31  30, 1997: Provided, however, That the total amount of such transfers for
32  the fiscal year ending June 30, 1997, shall not exceed $20,000.
33    Sec. 11.
34  STATE BOARD OF TECHNICAL PROFESSIONS
35    (a)  On the effective date of this act, the expenditure limitation estab-
36  lished for the fiscal year ending June 30, 1997, by section 20(a) of chapter
37  224 of the 1995 Session Laws of Kansas on the technical professions fee
38  fund is hereby decreased from $375,270 to $370,977.
39    Sec. 12.
40  REAL ESTATE APPRAISAL BOARD
41    (a)  On the effective date of this act, the expenditure limitation estab-
42  lished for the fiscal year ending June 30, 1997, by section 17(a) of chapter
43  224 of the 1995 Session Laws of Kansas on the appraiser fee fund is

 1  hereby increased from $129,756 to $144,294.
 2    Sec. 13.
 3  KANSAS REAL ESTATE COMMISSION
 4    (a)  On the effective date of this act, the expenditure limitation estab-
 5  lished for the fiscal year ending June 30, 1997, by section 18(a) of chapter
 6  224 of the 1995 Session Laws of Kansas on the real estate fee fund, is
 7  hereby decreased from $620,402 to $579,810.
 8    Sec. 14.
 9  DEPARTMENT OF ADMINISTRATION
10    (a)  On the effective date of this act, there is appropriated for the
11  above agency from the state general fund the following:
12    Year 2000 computer repair for state agencies...................... $5,000,000
13    State personnel and payroll system upgrade........................ $2,300,000
14    (b)  On the effective date of this act, of the amount appropriated for
15  the above agency for the fiscal year ending June 30, 1997, by section 11(a)
16  of chapter 259 of the 1996 Session Laws of Kansas from the state general
17  fund in the rehabilitation and repair -- statehouse, judicial center and
18  governor's residence account, the sum of $37,025 is hereby lapsed.
19    Sec. 15.
20  KANSAS RACING AND GAMING COMMISSION
21    (a)  On the effective date of this act, the expenditure limitation estab-
22  lished by section 54(g) of chapter 272 of the 1996 Session Laws of Kansas
23  on the state racing fund is hereby decreased from $2,257,186 to
24  $2,051,414.
25    (b)  During the fiscal year ending June 30, 1997, the director of ac-
26  counts and reports shall transfer one or more amounts certified by the
27  executive director of the state gaming agency from the tribal gaming fund
28  to the state general fund: Provided, That all such transfers shall be for
29  the purpose of reimbursing the state general fund for the amount equal
30  to the net amount obtained by subtracting (1) the aggregate of any costs
31  incurred by the state gaming agency for any arbitration or litigation in
32  connection with the administration and enforcement of tribal-state gam-
33  ing compacts or the provisions of the tribal gaming oversight act, from
34    (2) the aggregate of the amounts transferred to the tribal gaming fund of
35  the Kansas racing and gaming commission during fiscal year 1997, for the
36  operating expenditures for the state gaming agency and any other ex-
37  penses incurred in connection with the administration and enforcement
38  of tribal-state gaming compacts or the provisions of the tribal gaming
39  oversight act.
40    Sec. 16.
41  STATE CORPORATION COMMISSION
42    (a)  On the effective date of this act, the expenditure limitation estab-
43  lished by section 59(b) of chapter 272 of the 1996 Session Laws of Kansas

 1  on the aggregate expenditures from the public service regulation fund,
 2  the motor carrier license fees fund and the conservation fee fund is
 3  hereby decreased from $11,867,890 to $11,605,058.
 4    (b)  On the effective date of this act, the position limitation established
 5  by section 59(c) of chapter 272 of the 1996 Session Laws of Kansas for
 6  the above agency is hereby decreased from 213.0 to 212.0.
 7    (c)  On the effective date of this act, the expenditure limitation estab-
 8  lished by section 59(a) of chapter 272 of the 1996 Session Laws of Kansas
 9  on the abandoned oil and gas well fund is hereby increased from
10  $1,200,000 to No limit.
11    Sec. 17.
12  KANSAS PUBLIC EMPLOYEES RETIREMENT SYSTEM
13    (a)  On the effective date of this act, the expenditure limitation estab-
14  lished by section 75(b) of chapter 191 of the 1996 Session Laws of Kansas
15  on the expenditures from the Kansas public employees retirement fund
16  for investment related expenses is hereby increased from $19,231,252 to
17  $19,339,400.
18    Sec. 18.
19  DEPARTMENT OF REVENUE
20    (a)  There is appropriated for the above agency from the state general
21  fund the following:
22    Operating expenditures.................................................. $99,974
23    (b)  On the effective date of this act, the director of accounts and
24  reports shall transfer $500,000 from the state highway fund of the de-
25  partment of transportation to the division of vehicles operating fund of
26  the department of revenue for the purpose of financing the cost of op-
27  eration and general expense of the division of vehicles and related oper-
28  ations of the department of revenue.
29    (c)  On the effective date of this act, the expenditure limitation estab-
30  lished by section 2(b) of chapter 272 of the 1996 Session Laws of Kansas
31  on the division of vehicles operating fund is hereby increased from
32  $28,678,854 to $28,867,837.
33    Sec. 19.
34  INSURANCE DEPARTMENT
35    (a)  There is appropriated for the above agency from the following
36  special revenue fund or funds all moneys now or hereafter lawfully cred-
37  ited to and available in such fund or funds, except that expenditures other
38  than refunds authorized by law shall not exceed the following:
39    Senior health insurance counseling for Kansans fund.................... No limit
40    (b)  On and after December 15, 1996, in addition to the other pur-
41  poses for which expenditures may be made by the above agency from the
42  insurance department service regulation fund for the fiscal year ending
43  June 30, 1997, expenditures shall be made by the above agency from the

 1  insurance department service regulation fund for fiscal year 1997 for an
 2  additional amount of biweekly compensation for the commissioner of in-
 3  surance equal to $60.01 per biweekly pay period: Provided, That expend-
 4  itures for such purpose shall be made in the same manner and at the
 5  same times that biweekly compensation is payable to the commissioner
 6  of insurance for the biweekly pay periods which commence on or after
 7  December 15, 1996, and which are chargeable to fiscal year 1997: Pro-
 8  vided, however, That all additional amounts of biweekly compensation
 9  for biweekly pay periods which commence on or after December 15,
10  1996, which are chargeable to fiscal year 1997 and which end prior to the
11  effective date of this act, shall be paid in the same manner and at the
12  same time that biweekly compensation is payable to the commissioner of
13  insurance for the first biweekly pay period which commences on or after
14  December 15, 1996, and which ends after the effective date of this act.
15    Sec. 20.
16  STATE BOARD OF INDIGENTS' DEFENSE SERVICES
17    (a)  There is appropriated for the above agency from the state general
18  fund the following:
19    Operating expenditures................................................. $988,199
20    Sec. 21.
21  ATTORNEY GENERAL
22    (a)  On the effective date of this act, of the $2,851,625 appropriated
23  for the above agency for the fiscal year ending June 30, 1997, by section
24  56(a) of chapter 191 of the 1996 Session Laws of Kansas from the state
25  general fund in the operating expenditures account, the sum of $250,000
26  is hereby lapsed.
27    Sec. 22.
28  DEPARTMENT OF SOCIAL AND REHABILITATION SERVICES
29    (a)  There is appropriated for the above agency from the state general
30  fund the following:
31    State operations..................................................... $3,848,608
32  Mental health and retardation services aid and assistance and state insti-
33    tutions operations.................................................. $41,726,664
34    Alcohol and drug abuse services grants..................................... $487
35    Youth services aid and assistance................................... $13,743,555
36    Purchase of atypical antipsychotic drugs............................... $680,000
37  Provided, That the $680,000 appropriated in the purchase of atypical antipsychotic drugs
38  account is recommended and included in this account for atypical antipsychotic drug therapy
39  and shall be expended to ensure the continuation of atypical antipsychotic drug therapy for
40  patients who are released from a state mental health institution to reside in a Kansas com-
41  munity so that no such patient, who is receiving atypical antipsychotic drug therapy when
42  released, is denied access to such medications in the community because of the person's
43  financial need: Provided further, That any remaining balance of such $680,000 after the

 1  expenditures for this continuation of atypical antipsychotic drug therapy program have been
 2  made shall be distributed to the community mental health centers for support of patients
 3  who are at great risk of rehospitalization.
 4    (b)  On the effective date of this act, of the $108,338,055 appropriated
 5  for the above agency by section 115(a) of chapter 191 of the 1996 Session
 6  Laws of Kansas from the state general fund in the adult care homes
 7  account, the sum of $8,697,005 is hereby lapsed.
 8    (c)  On the effective date of this act, of the $44,283,041 appropriated
 9  for the above agency by section 115(a) of chapter 191 of the 1996 Session
10  Laws of Kansas from the state general fund in the community based
11  services account, the sum of $33,938,160 is hereby lapsed.
12    (d)  On the effective date of this act, of the $168,485,645 appropriated
13  for the above agency by section 115(a) of chapter 191 of the 1996 Session
14  Laws of Kansas from the state general fund in the other medical assistance
15  account, the sum of $8,070,639 is hereby lapsed.
16    (e)  On the effective date of this act, of the $2,744,962 appropriated
17  for the above agency by section 115(a) of chapter 191 of the 1996 Session
18  Laws of Kansas from the state general fund in the vocational rehabilitation
19  aid and assistance account, the sum of $198,419 is hereby lapsed.
20    (f)  On the effective date of this act, of the $59,788,520 appropriated
21  for the above agency by section 115(a) of chapter 191 of the 1996 Session
22  Laws of Kansas from the state general fund in the cash assistance account,
23  the sum of $10,244,433 is hereby lapsed.
24    (g)  On the effective date of this act, the expenditure limitation estab-
25  lished by section 25(l) of chapter 272 of the 1996 Session Laws of Kansas
26  on the social welfare fund is hereby increased from $41,070,590 to
27  $45,700,370.
28    (h)  On the effective date of this act, the expenditure limitation estab-
29  lished by section 115(b) of chapter 191 of the 1996 Session Laws of Kan-
30  sas on the juvenile detention facilities fund is hereby increased from
31  $2,480,515 to $2,727,830.
32    (i)  On the effective date of this act, the expenditure limitation estab-
33  lished by section 115(b) of chapter 191 of the 1996 Session Laws of Kan-
34  sas on the child care development block grant federal fund is hereby
35  increased from $7,154,420 to $8,126,466.
36    (j)  On the effective date of this act, the expenditure limitation estab-
37  lished by section 115(b) of chapter 191 of the 1996 Session Laws of Kan-
38  sas on the mental health block grant federal fund is hereby increased
39  from $1,872,734 to $1,947,358.
40    (k)  On the effective date of this act, the expenditure limitation estab-
41  lished by section 115(b) of chapter 191 of the 1996 Session Laws of Kan-
42  sas on the rehabilitation services federal fund is hereby increased from
43  $20,380,402 to $21,201,388.

 1    (l)  On the effective date of this act, the expenditure limitation estab-
 2  lished by section 115(b) of chapter 191 of the 1996 Session Laws of Kan-
 3  sas on the Topeka state hospital fee fund is hereby decreased from
 4  $6,573,235 to $3,807,490.
 5    (m)  On the effective date of this act, the expenditure limitation es-
 6  tablished by section 25(k) of chapter 272 of the 1996 Session Laws of
 7  Kansas on the title XIX fund is hereby increased from $69,145,199 to
 8  $73,241,980.
 9    (n)  On or before June 30, 1997, the director of accounts and reports
10  shall transfer any moneys credited to the Topeka state hospital fee fund
11  as certified by the secretary of social and rehabilitation services, in one
12  or more amounts and to one or more fee funds of mental health insti-
13  tutions of the department of social and rehabilitation services as specified
14  by the secretary of social and rehabilitation services. After the closure of
15  Topeka state hospital and before July 1, 1997, the secretary of social and
16  rehabilitation services shall transmit a certification to the director of ac-
17  counts and reports specifying the transfer of any moneys credited to and
18  the amounts of any outstanding obligations of the Topeka state hospital
19  fee fund to one or more fee funds of mental health institutions of the
20  department of social and rehabilitation services as appropriate with re-
21  spect to each such institution or institutions and the closure of Topeka
22  state hospital. After all such transfers of moneys, the amounts of any
23  outstanding obligations of the Topeka state hospital fee fund are hereby
24  transferred as specified by the certification of the secretary of social and
25  rehabilitation services and the Topeka state hospital fee fund is hereby
26  abolished.
27    (o)  On or before June 30, 1997, the director of accounts and reports
28  shall transfer any moneys credited to the Topeka state hospital -- ele-
29  mentary and secondary education fund -- federal as certified by the sec-
30  retary of social and rehabilitation services, in one or more amounts and
31  to one or more federal elementary and secondary education funds of
32  mental health institutions of the department of social and rehabilitation
33  services as specified by the secretary of social and rehabilitation services.
34  After the closure of Topeka state hospital and before July 1, 1997, the
35  secretary of social and rehabilitation services shall transmit a certification
36  to the director of accounts and reports specifying the transfer of any
37  moneys credited to and any outstanding obligations of the Topeka state
38  hospital -- elementary and secondary education fund -- federal to one
39  or more federal elementary and secondary education funds of mental
40  health institutions of the department of social and rehabilitation services
41  as appropriate with respect to such institution or institutions and the
42  closure of Topeka state hospital. After all such transfers of moneys, the
43  amounts of any outstanding obligations of the Topeka state hospital --

 1  elementary and secondary education fund -- federal are hereby trans-
 2  ferred as specified by the certification of the secretary of social and re-
 3  habilitation services and the Topeka state hospital -- elementary and
 4  secondary education fund -- federal is hereby abolished.
 5    (p)  On or before June 30, 1997, the director of accounts and reports
 6  shall transfer any moneys credited to the Topeka state hospital -- canteen
 7  fund, Topeka state hospital -- patient benefit fund and the Topeka state
 8  hospital -- work therapy patient benefit fund as certified by the secretary
 9  of social and rehabilitation services, in one or more amounts to the re-
10  spective canteen fund, patient benefit fund or work therapy patient ben-
11  efit fund of one or more mental health institutions of the department of
12  social and rehabilitation services as specified by the secretary of social
13  and rehabilitation services. After the closure of Topeka state hospital and
14  before July 1, 1997, the secretary of social and rehabilitation services shall
15  transmit a certification to the director of accounts and reports specifying
16  the transfer of any moneys credited to and any outstanding obligations of
17  the Topeka state hospital -- canteen fund, Topeka state hospital -- pa-
18  tient benefit fund and Topeka state hospital -- work therapy patient ben-
19  efit fund to the respective canteen fund, patient benefit fund or work
20  therapy patient benefit fund of one or more mental health institutions of
21  the department of social and rehabilitation services as appropriate with
22  respect to each such institution or institutions and the closure of Topeka
23  state hospital. After all such transfers of moneys, the amounts of any
24  outstanding obligations of the Topeka state hospital -- canteen fund,
25  Topeka state hospital -- patient benefit fund and Topeka state hospital
26  -- work therapy patient benefit fund are hereby transferred as specified
27  by the certification of the secretary of social and rehabilitation services
28  and the Topeka state hospital -- canteen fund, Topeka state hospital --
29  patient benefit fund and Topeka state hospital -- work therapy patient
30  benefit fund are hereby abolished.
31    (q)  On the effective date of this act, or as soon thereafter as moneys
32  are available, the director of accounts and reports shall transfer
33  $1,400,000 from the juvenile detention facilities fund to the social welfare
34  fund.
35    Sec. 23.
36  DEPARTMENT OF HUMAN RESOURCES
37    (a)  On the effective date of this act, the expenditure limitation estab-
38  lished by section 89(b) of chapter 191 of the 1996 Session Laws of Kansas
39  on the occupational health and safety--federal fund is hereby increased
40  from $365,976 to $388,776.
41    Sec. 24.
42  DEPARTMENT OF HEALTH AND ENVIRONMENT
43    (a)  There is appropriated for the above agency from the state general

10    (c)  On the effective date of this act, the expenditure limitation estab-
11  lished by section 91(b) of chapter 191 of the 1996 Session Laws of Kansas
12  on the environmental permit fund is hereby decreased from $300,054 to
13  $232,000.
14    (d)  On the effective date of this act, the expenditure limitation estab-
15  lished by section 91(b) of chapter 191 of the 1996 Session Laws of Kansas
16  on the air quality fee fund is hereby decreased from $3,610,309 to
17  $3,590,784.
18    (e)  On the effective date of this act, the expenditure limitation estab-
19  lished by section 57(k) of chapter 272 of the 1996 Session Laws of Kansas
20  on the title XIX fund is hereby decreased from $3,924,244 to $3,893,498.
21    (f)  On the effective date of this act, the expenditure limitation estab-
22  lished by section 91(b) of chapter 191 of the 1996 Session Laws of Kansas
23  on the national center for health statistics fund--federal is hereby in-
24  creased from $192,406 to $238,406.
25    (g)  On the effective date of this act, the expenditure limitation estab-
26  lished by section 91(b) of chapter 191 of the 1996 Session Laws of Kansas
27  on the solid waste management fund is hereby increased from $4,773,896
28  to $5,713,160.
29    (h)  On the effective date of this act, the expenditure limitation estab-
30  lished by section 57(e) of chapter 272 of the 1996 Session Laws of Kansas
31  on the waste tire management fund is hereby increased from $1,896,647
32  to $2,272,084.

20  Provided, That the pooled money investment board is hereby authorized and directed to
21  loan to Pittsburg state university a principal amount of not more than $750,000 for the
22  purpose of funding the capital improvement project for the construction of the Kansas
23  technology center: Provided further, That all moneys received from such loan shall be cred-
24  ited to the Kansas technology center PMIB loan fund: And provided further, That the pooled
25  money investment board is authorized and directed to use any moneys invested in the pooled
26  money investment portfolio for such loan: And provided further, That the loan shall bear
27  interest at a rate equal to the net earnings rate of the pooled money investment portfolio:
28  And provided further, That such loan shall be exempt from interest from the date of the
29  loan issuance until the date two years after the date of the loan issuance: And provided
30  further, That all other terms of the loan shall be governed by a loan agreement that is hereby
31  authorized to be entered into by Pittsburg state university with the pooled money investment
32  board: And provided further, That the loan shall not be deemed an indebtedness or debt
33  of the state of Kansas within the meaning of section 6 of article 11 of the constitution of
34  the state of Kansas.
35    (c)  On the effective date of this act, the expenditure limitation estab-
36  lished by section 19(c) of chapter 272 of the 1996 Session Laws of Kansas
37  on the general fees fund is hereby decreased from $10,310,512 to
38  $9,998,736.
39    (d)  During the fiscal year ending June 30, 1997, the director of ac-
40  counts and reports shall transfer $50,000 from the equipment reserve
41  fund to the general fees fund.
42    (e)  Expenditures may be made by the above agency for fiscal year
43  1997 from the amount reappropriated in the operating expenditures (in-

18    Sec. 33.
19  KANSAS STATE UNIVERSITY
20    (a)  Notwithstanding the provisions of section 12(f) of chapter 272 of
21  the 1996 Session Laws of Kansas, (1) all amounts of tuition from students
22  who began participating in the midwestern student exchange program
23  prior to July 1, 1996, which are received by Kansas state university during
24  the fiscal year ending June 30, 1997, shall not be deposited to the credit
25  of the midwestern student exchange account of the restricted fees fund,
26  but shall be deposited to the credit of the general fees fund, and (2) all
27  amounts of tuition received from students who began participating in the
28  midwestern student exchange program after July 1, 1996, which are re-
29  ceived by Kansas state university during the fiscal year ending June 30,
30  1997, shall be deposited to the credit of the midwestern student exchange
31  account of the restricted fees fund.
32    Sec. 34.
33  KANSAS STATE UNIVERSITY--SALINA, COLLEGE OF TECHNOLOGY
34    (a)  There is appropriated for the above agency from the state general

37    (b)  On the effective date of this act, the expenditure limitation estab-

41  UNIVERSITY OF KANSAS
42    (a)  The director of accounts and reports shall not make any transfers
43  pursuant to the provisions of section 10(g) of chapter 272 of the 1996

 1  Session Laws of Kansas and any amounts transferred prior to the effective
 2  date of this act pursuant to such provisions shall be transferred from the
 3  tuition accountability fund of the above agency to the general fees fund
 4  of the above agency.
 5    (b)  On or after the effective date of this act, upon a finding by the
 6  director of the budget that the above agency realized an increase in re-
 7  ceipts to the general fees fund in the summer 1996 session, fall 1996
 8  semester or spring 1997 semester above the comparable periods in the
 9  preceding year, which increase in receipts resulted from increases in en-
10  rollment, changes in resident and nonresident student mix, or the im-
11  position of a more restrictive tuition waiver policy, the director of the
12  budget shall certify such amount of increased receipts to the director of
13  accounts and reports. Upon receipt of such certification, the director of
14  accounts and reports shall transfer the amount certified from the general
15  fees fund of the above agency to the tuition accountability fund of the
16  above agency.
17    (c)  Notwithstanding the provisions of section 10(h) of chapter 272 of
18  the 1996 Session Laws of Kansas, (1) all amounts of tuition from students
19  who began participating in the midwestern student exchange program
20  prior to July 1, 1996, which are received by the university of Kansas during
21  the fiscal year ending June 30, 1997, shall not be deposited to the credit
22  of the midwestern student exchange account of the restricted fees fund,
23  but shall be deposited to the credit of the general fees fund, and (2) all
24  amounts of tuition received from students who began participating in the
25  midwestern student exchange program after July 1, 1996, which are re-
26  ceived by the university of Kansas during the fiscal year ending June 30,
27  1997, shall be deposited to the credit of the midwestern student exchange
28  account of the restricted fees fund.
29    Sec. 36.
30  UNIVERSITY OF KANSAS MEDICAL CENTER
31    (a)  There is appropriated for the above agency from the following
32  special revenue fund or funds all moneys now or hereafter lawfully cred-
33  ited to and available in such fund or funds, except that expenditures other
34  than refunds authorized by law shall not exceed the following:
35    Biomedical research building principal and interest sinking fund....... No limit
36    (b)  The director of accounts and reports shall transfer moneys during
37  the fiscal year ending June 30, 1997, from the sponsored research over-

18  WICHITA STATE UNIVERSITY
19    (a)  Notwithstanding the provisions of section 16(e) of chapter 272 of
20  the 1996 Session Laws of Kansas, (1) all amounts of tuition from students
21  who began participating in the midwestern student exchange program
22  prior to July 1, 1996, which are received by Wichita state university during
23  the fiscal year ending June 30, 1997, shall not be deposited to the credit
24  of the midwestern student exchange account of the restricted fees fund,
25  but shall be deposited to the credit of the general fees fund, and (2) all
26  amounts of tuition received from students who began participating in the
27  midwestern student exchange program after July 1, 1996, which are re-
28  ceived by Wichita state university during the fiscal year ending June 30,
29  1997, shall be deposited to the credit of the midwestern student exchange
30  account of the restricted fees fund.
31    Sec. 38.
32  LEGISLATURE
33    (a)  On and after the effective date of this act, in addition to the other
34  purposes for which expenditures may be made by the above agency from
35  the operations (including official hospitality) account of the state general
36  fund for the fiscal year ending June 30, 1997, expenditures shall be made
37  by the above agency from the operations (including official hospitality)
38  account of the state general fund for fiscal year 1997 for an additional
39  amount of biweekly compensation for each biweekly pay period com-
40  mencing on or after December 15, 1996, for the following legislative
41  officers as follows:  The minority leaders of the senate and house of rep-
42  resentatives equal to $8.97 per biweekly pay period for services per-
43  formed in connection with discharging the duties assigned to the respec-

 1  tive positions: Provided, That expenditures for such purpose shall be
 2  made in the same manner and at the same times that biweekly compen-
 3  sation is payable to the legislators eligible for such additional compensa-

 5  15, 1996, and which are chargeable to fiscal year 1997: Provided, however,
 6  That all additional amounts of biweekly compensation for biweekly pay
 7  periods which commence on or after December 15, 1996, which are
 8  chargeable to fiscal year 1997 and which end prior to the effective date
 9  of this act, shall be paid in the same manner and at the same time that
10  biweekly compensation is payable to the legislators eligible for such ad-
11  ditional compensation for the first biweekly pay period which commences
12  on or after December 15, 1996, and which ends after the effective date

10    (a)  Subject to the limitation on total expenditures from the water plan
11  special revenue fund, and in addition to the other purposes for which

13  special revenue fund for fiscal year 1997, expenditures may be made by
14  the above agency from the water plan special revenue fund during fiscal
15  year 1997 for the following specified purposes, subject to the expenditure
16  limitations prescribed therefor:

18    (b)  On the effective date of this act, the expenditure limitation estab-

27  lished by section 142(c) of chapter 191 of the 1996 Session Laws of Kansas
28  on the conservation district aid account of the water plan special revenue
29  fund is hereby increased from $1,008,892 to $1,009,392.
30    Sec. 52.
31  KANSAS LOTTERY
32    (a)  On the effective date of this act, the expenditure limitation estab-
33  lished by section 109(a) of chapter 191 of the 1996 Session Laws of Kansas
34  on the computer systems account of the lottery operating fund is hereby
35  decreased from $500,000 to $0.
36    (b)  On June 15, 1997, or as soon thereafter as moneys are available,
37  the director of accounts and reports shall transfer the sum of $312,761

15  KANSAS COMMISSION ON VETERANS AFFAIRS
16    (a)  There is appropriated for the above agency from the state general
17  fund the following:
18    Operating expenditures--Kansas soldiers' home........................... $20,000
19  [Provided, That, the Kansas commission on veterans affairs is hereby authorized and
20  directed to proceed with negotiations with the United States department of veterans
21  affairs for the operation by the commission on veterans affairs of an existing 60-bed
22  intermediate care nursing facility located adjacent to the United States department
23  of veterans affairs hospital in Wichita, Kansas: Provided, however, That upon con-
24  cluding such agreement with the United States department of veterans affairs, the
25  Kansas commission of veterans affairs shall not seek United States department of
26  veterans affairs certification for the operation of the above nursing facility until
27  expressly authorized by the state legislature.
28    [(b)  There is appropriated for the above agency from the state
29  institutions building fund for the fiscal year ending June 30, 1997,
30  for the capital improvement project or projects specified as follows:

32    Sec. 57.
33  DEPARTMENT OF REVENUE--HOMESTEAD PROPERTY TAX REFUNDS
34    (a)  On the effective date of this act, of the $8,099,700 appropriated
35  for the above agency for the fiscal year ending June 30, 1997, by section
36  88(a) of chapter 191 of the 1996 Session Laws of Kansas from the state
37  general fund in the homestead tax refunds account, the sum of $300,000
38  is hereby lapsed.
39    Sec. 58.  Appeals to exceed position limitations. The limitations im-
40  posed by this act on the number of full-time and regular part-time posi-
41  tions equated to full-time, excluding seasonal and temporary positions,
42  paid from appropriations for fiscal year 1997 made in this act or in any
43  appropriation act of the 1996 regular session of the legislature or in any

 1  other appropriation act of the 1997 regular session of the legislature may
 2  be exceeded upon approval of the state finance council.
 3    Sec. 59.  Appeals to exceed limitations. Upon written application to
 4  the governor and approval of the state finance council, expenditures from
 5  special revenue funds may exceed the amounts specified in this act.
 6    Sec. 60.  Effective date. This act shall take effect and be in force from
 7  and after its publication in the Kansas register.
