9 AN ACT concerning the Kansas industries for the blind; transfer of assets; 10 operation after transfer of assets. 11 12 Be it enacted by the Legislature of the State of Kansas: 13 Section 1. (a) At the request of the secretary of social and rehabili- 14 tation services, the director of accounts and reports, or a person desig- 15 nated by the director, shall make a detailed inventory and appraisal of 16 the assets and liabilities of the Kansas industries for the blind, including, 17 but not limited to, the following: 18 (1) Accounts receivable; 19 (2) accounts payable; 20 (3) raw materials (on hand or on order); 21 (4) supplies; 22 (5) inventories of finished goods and work in progress; 23 (6) machinery and equipment; 24 (7) furniture, pictures and office equipment; and 25 (8) tools. 26 (b) The director of the division of services for the blind of the de- 27 partment of social and rehabilitation services, and all other personnel of 28 the department shall provide such assistance, records and information as 29 is requested by the director of accounts and reports in carrying out the 30 responsibilities under this act. 31 (c) The secretary of social and rehabilitation services shall cooperate 32 in expediting the action mandated by this act by issuing such orders as 33 may be necessary or useful in synchronizing activities affected by this act 34 to the end that the Kansas industries for the blind may be privatized 35 according to law. 36 Sec. 2. (a) The secretary of social and rehabilitation services may sell 37 and dispose of the assets of the Kansas industries for the blind in the 38 manner authorized by this act. The secretary shall advertise for bids in 39 the Kansas register and such other publications as the secretary deems 40 appropriate for an agreement to operate the Kansas industry for the blind 41 as a workshop for the blind. Any such agreement shall contemplate that 42 the assets listed pursuant to section 1 will be transferred to the successful 43 bidder as an incident of such agreement.  1  specify such additional conditions or undertakings as the secretary deems
 2  relevant.
 3    (b)  Bidding procedures which are not in conflict with K.S.A. 75-3739,
 4  and amendments thereto, may be used before awarding any contract un-
 5  der this act.
 6    (c)  Only organizations which are charitable not-for-profit organiza-
 7  tions which are exempt from federal income taxation pursuant to section
 8  501 (c)(3) the federal Internal Revenue Code of 1986 are qualified to bid
 9  on a contract under this act. Only such an organization shall be authorized
10  to operate a workshop for the blind as provided by this act.
11    (d)  As used in this act a workshop for the blind is a facility in which
12  persons who are blind as defined in K.S.A. 39-702 and amendments
13  thereto, and subsection (a) of Kansas Administrative Regulation 30-13-
14  17 perform at least 75% of the hours of work spent in production of goods.
15    (e)  The provisions of K.S.A. 1996 Supp. 75-7101 to 75-7107, and
16  amendments thereto, shall not apply to actions under this act.
17    Sec. 3.  This act shall take effect and be in force from and after its
18  publication in the Kansas register.
