8 AN ACT concerning the uniform controlled substances act; substances
9 included in schedule IV; amending K.S.A. 1996 Supp. 65-4111 and
10 repealing the existing section.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. K.S.A. 1996 Supp. 65-4111 is hereby amended to read as
14 follows: 65-4111. (a) The controlled substances listed in this section are
15 included in schedule IV and the number set forth opposite each drug or
16 substance is the DEA controlled substances code which has been assigned
17 to it.
18 (b) Any material, compound, mixture or preparation which contains
19 any quantity of the following substances including its salts, isomers and
20 salts of isomers whenever the existence of such salts, isomers and salts of
21 isomers is possible within the specific chemical designation and having a
22 potential for abuse associated with a depressant effect on the central
23 nervous system:

32 (c) Any material, compound, mixture, or preparation which contains
33 any quantity of fenfluramine (1670), including its salts, isomers (whether
34 optical, position or geometric) and salts of such isomers, whenever the
35 existence of such salts, isomers and salts of isomers is possible. The pro-
36 visions of this subsection (c) shall expire on the date fenfluramine and its
37 salts and isomers are removed from schedule IV of the federal controlled
38 substances act (21 United States code 812; 21 code of federal regulations
39 1308.14).
40 (d) Unless specifically excepted or unless listed in another schedule,
41 any material, compound, mixture or preparation which contains any quan-
42 tity of the following substances having a stimulant effect on the central
43 nervous system, including its salts, isomers (whether optical, position or
44 geometric) and salts of such isomers whenever the existence of such salts,

2 -isomers and salts of isomers is possible within the specific chemical des-
3 ignation:
4 (1) Cathine (( + )-norpseudoephedrine) 1230

9 (6) Mefenorex 1580
10 (7) Pemoline (including organometallic complexes and chelates thereof)

12 The provisions of this subsection (d)(8) shall expire on the date phen-
13 termine and its salts and isomers are removed from schedule IV of the
14 federal controlled substances act (21 United States code 812; 21 code of
15 federal regulations 1308.14).

18 (e) Unless specifically excepted or unless listed in another schedule,
19 any material, compound, mixture or preparation which contains any quan-
20 tity of the following, including salts thereof:
21 (1) Butorphanol
22 (2) Pentazocine 9709
23 (3) Tramadol
24 (f) Unless specifically excepted or unless listed in another schedule,
25 any material, compound, mixture or preparation containing any of the
26 following narcotic drugs, or their salts calculated as the free anhydrous
27 base or alkaloid, in limited quantities as set forth below:
28 (1) Not more than 1 milligram of difenoxin and not less than 25
micrograms of atropine sulfate per dosage unit 9167
29 (2) Dextropropoxyphene (alpha-( +)-4-dimethylamino-1,2-diphenyl-
3-methyl-2-propionoxybutane) 9278
30 (g) Butyl nitrite and its salts, isomers, esters, ethers or their salts.
31 (h) The board may except by rule and regulation any compound, mix-
32 ture or preparation containing any depressant substance listed in subsec-
33 tion (b) from the application of all or any part of this act if the
compound,
34 mixture or preparation contains one or more active medicinal ingredients
35 not having a depressant effect on the central nervous system, and if the
36 admixtures are included therein in combinations, quantity, proportion or
37 concentration that vitiate the potential for abuse of the substances which
38 have a depressant effect on the central nervous system.
39 Sec. 2. K.S.A. 1996 Supp. 65-4111 is hereby repealed.
40 Sec. 3. This act shall take effect and be in force from and after its
41 publication in the statute book.
