8 AN ACT concerning the state board of pharmacy; civil fines; amending 9 K.S.A. 1996 Supp. 65-1658 and repealing the existing section. 10 11 Be it enacted by the Legislature of the State of Kansas: 12 Section 1. K.S.A. 1996 Supp. 65-1658 is hereby amended to read as 13 follows: 65-1658. The state board of pharmacy, in addition to any other 14 penalty prescribed under the pharmacy act of the state of Kansas, may 15 assess a civil fine, after notice and an opportunity to be heard in accor- 16 dance with the Kansas administrative procedure act, against any licensee 17 or registrant under subsections (a), (c), (d) and (e) of K.S.A. 65-1627 and 18 amendments thereto for violation of the pharmacy act of the state of 19 Kansas or rules and regulations of the state board of pharmacy adopted 20 under the pharmacy act of the state of Kansas or for violation of the 21 uniform controlled substances act or rules and regulations of the state 22 board of pharmacy adopted under the uniform controlled substances act, 23 in an amount not to exceed $500 $5,000 for each violation. All fines as- 24 sessed and collected under this section shall be remitted to the state 25 treasurer. Upon receipt thereof, the state treasurer shall deposit the en- 26 tire amount in the state treasury and credit such amount to the state 27 general fund. 28 Sec. 2. K.S.A. 1996 Supp. 65-1658 is hereby repealed. 29 Sec. 3. This act shall take effect and be in force from and after its 30 publication in the statute book.
