10 AN ACT concerning the department of health and environment; licensed
11 dietitian continuing education sponsors; amending K.S.A. 65-5902 and
12 K.S.A. 1996 Supp. 65-5913 and repealing the existing sections.

14 Be it enacted by the Legislature of the State of Kansas:
15 Section 1. K.S.A. 65-5902 is hereby amended to read as follows: 65-
16 5902. For the purposes of this act:
17 (a) ``Secretary'' means the secretary of health and environment.
18 (b) ``Department'' means the department of health and environment.
19 (c) ``Licensed dietitian'' means a person licensed under this act.
20 (d) ``Dietetics practice'' means the integration and application of prin-
21 ciples derived from the sciences of nutrition, biochemistry, food, physi-
22 ology, management and behavioral and social sciences to achieve and
23 maintain the health of people through:
24 (1) Assessing the nutritional needs of clients;
25 (2) establishing priorities, goals and objectives that meet nutritional
26 needs of clients; and
27 (3) advising and assisting individuals or groups on appropriate nutri-
28 tional intake by integrating information from a nutritional assessment with
29 information on food and other sources of nutrients and meal preparation.
30 (e) ``Nutritional assessment'' means the evaluation of the nutritional
31 needs of clients based upon appropriate biochemical, anthropometric,
32 physical and dietary data to determine nutrient needs and recommend
33 appropriate nutritional intake including enteral and parenteral nutrition.
34 (f) ``Dietitian'' means a person engaged in dietetics practice.
35 (g) ``Sponsor'' means entities approved by the secretary of health and
36 environment to provide continuing education programs or courses on an
37 ongoing basis under this act and in accordance with any rules and reg-
38 ulations promulgated by the secretary in accordance with this act.
39 Sec. 2. K.S.A. 1996 Supp. 65-5913 is hereby amended to read as
40 follows: 65-5913. The secretary shall fix by rules and regulations fees for
41 applications for and renewal of licenses, temporary licenses, examination
42 fees, late renewal fees and, reinstatement and sponsorship fees under this
43 act. Such fees shall be fixed in an amount to cover the costs of adminis-

1 tering the provisions of this act. No fee shall be more than $200. The
2 secretary shall remit all moneys received from fees, charges or penalties
3 under this act to the state treasurer at least monthly. Upon receipt of each
4 such remittance the state treasurer shall deposit the entire amount
5 thereof in the state treasury and credit the same to the state general fund.
6 Sec. 3. K.S.A. 65-5902 and K.S.A. 1996 Supp. 65-5913 are hereby
7 repealed.
8 Sec. 4. This act shall take effect and be in force from and after its
9 publication in the Kansas register.
