17 AN ACT relating to motor vehicles; providing for distinctive license plates 18 for United States military veterans of the United States army, navy, 19 air force, marine corps or coast guard; amending K.S.A. 1996 Supp. 20 8-177a and 8-1,142 and repealing the existing sections. 21 22 Be it enacted by the Legislature of the State of Kansas: 23 Section 1. (a) Any On and after January 1, 1998, any owner of 24 one or more passenger vehicles or trucks of a gross weight of 12,000 25 pounds or less, who is a resident of the state of Kansas, and who submits 26 satisfactory proof to the director of vehicles, in accordance with rules and 27 regulations adopted by the secretary of revenue, that such person has 28 proof of having served and is designated as a veteran, and has had an 29 honorable discharge from the United States army, navy, air force, marine 30 corps or coast guard, upon compliance with the provisions of this section, 31 may be issued one distinctive license plate for each such passenger vehicle 32 or truck designating such person as a an United States military veteran 33 of the United States army, navy, air force, marine corps or coast guard. 34 Such license plates shall be issued for the same period of time as other 35 license plates upon proper registration and payment of the regular license 36 fee as provided in K.S.A. 8-143, and amendments thereto. 37 (b) Any person who is a veteran of the United States army, navy, air 38 force, marine corps or coast guard may make application for the such 39 distinctive license plates, not less than 60 days prior to such person's 40 renewal of registration date, on a form prescribed and furnished by the 41 director of vehicles, and any applicant for the distinctive license plates 42 shall furnish the director with proof as the director shall require that the 43 applicant is a veteran of the United States army, navy, air force, marine HB 2170--Am. by S

 1  corps or coast guard. Application for the registration of a passenger ve-
 2  hicle or truck and issuance of the license plates under this section shall
 3  be made by the owner in a manner prescribed by the director of vehicles
 4  upon forms furnished by the director.
 5    (c)  No registration of distinctive license plates issued under the au-
 6  thority of this section shall be transferable to any other person.
 7    (d)  Renewals of registration under this section shall be made an-
 8  nually, upon payment of the fee prescribed in subsection (a), in the man-
 9  ner prescribed in subsection (b) of K.S.A. 8-132, and amendments
10  thereto. No renewal of registration shall be made to any applicant until
11  such applicant has filed with the director a form as provided in subsection
12    (b). If such form is not filed, the applicant shall be required to comply
13  with K.S.A. 8-143, and amendments thereto, and return the distinctive
14  license plates to the county treasurer of such person's residence.
15    Sec. 2.  K.S.A. 1996 Supp. 8-177a is hereby amended to read as
16  follows: 8-177a. (a) Any owner of one or more passenger vehicles
17  or trucks registered for a gross weight of not more than 16,000
18  pounds who is a resident of the state of Kansas, and who is a regu-
19  larly enlisted or retired, warrant or commissioned member of the
20  Kansas national guard, may as certified by the adjutant general, upon
21  compliance with the provisions of this section, may be issued one
22  distinctive license plate for each such motor vehicle or truck that is
23  not required to be registered with the state corporation commission
24  designating the owner of such vehicle as a member or retired mem-
25  ber of the Kansas national guard. Such license plates shall be issued
26  for the same period of time as other license plates upon proper reg-
27  istration and payment of the regular license fee as provided in
28  K.S.A. 8-143, and amendments thereto.
29    (b)  Any such member or retired member of the Kansas national
30  guard may make application for such distinctive license plates, not
31  less than 60 days prior to such member's renewal of registration
32  date, on a form furnished by the director of vehicles, and any ap-
33  plicant for such distinctive license plates shall furnish the director
34  with such applicant's armed forces of the United States identification
35  card as proof as the director requires that the applicant is a member
36  or a retired member of the Kansas national guard, including the cur-
37  rent or previous term of enlistment or service of such applicant. Appli-
38  cation for the registration of passenger vehicles or trucks and is-
39  suance of the distinctive license plates under this section shall be
40  made by the owner in a manner prescribed by the director of ve-
41  hicles upon forms furnished by the director.
42    (c)  No registration or distinctive license plate issued under this
43  section shall be transferable to any other person.

 1    (d)  Renewals of registration under this section shall be made
 2  annually, upon payment of the fee prescribed in subsection (a), in
 3  the manner prescribed in subsection (b) of K.S.A. 8-132, and amend-
 4  ments thereto. No renewal of registration shall be made to any ap-
 5  plicant until such applicant has filed with the director a form as
 6  provided in subsection (b). If such form is not filed, the applicant
 7  shall be required to comply with K.S.A. 8-143, and amendments
 8  thereto, and return the distinctive license plates to the county treas-
 9  urer of such person's residence.
10    (e)  The adjutant general, with the approval of the director of
11  vehicles and subject to the availability of materials and equipment,
12  shall design a distinctive license plate for issuance to members and
13  retired members of the Kansas national guard.
14    Sec. 3.  K.S.A. 1996 Supp. 8-1,142 is hereby amended to read as
15  follows: 8-1,142. (a) As used in this section, ``educational institu-
16  tion'' means:
17    (1)  Any state educational institution under the control and su-
18  pervision of the state board of regents;
19    (2)  any qualified institution as defined in K.S.A. 72-6107, and
20  amendments thereto;
21    (3)  any community college organized and operating under the
22  laws of this state; and
23    (4)  Haskell Indian Nations university.
24    (b)  Any owner of one or more passenger vehicles or trucks reg-
25  istered for a gross weight of not more than 12,000 pounds who is a
26  resident of Kansas, upon compliance with the provisions of this sec-
27  tion, may be issued one educational institution license plate for each
28  such passenger vehicle or truck. Such license plates shall be issued
29  for the same period of time as other license plates upon proper reg-
30  istration and payment of the regular license fee as provided in
31  K.S.A. 8-143, and amendments thereto, plus the payment of an ad-
32  ditional fee of $5 for each plate, and the presentation of the annual
33  emblem use authorization statement provided for in subsection (c).
34    (c)  Any educational institution may authorize through its offi-
35  cially recognized alumni association or foundation the use of such
36  institution's official emblems to be affixed on license plates as pro-
37  vided by this section. Any royalty payment to such alumni associ-
38  ation or foundation derived from this section, except reasonable
39  administrative costs, shall be used for recognition of academic
40  achievement or excellence subject to the approval of the chancellor
41  or president of the educational institution.  Any motor vehicle owner
42  may annually apply to the alumni association or foundation for the
43  use of the institution's emblems. Upon annual application and pay-

 1  ment to the alumni association or foundation in an amount of not
 2  less than $25 nor more than $100 as an emblem use royalty payment
 3  for each educational institution license plate to be issued, the
 4  alumni association or foundation shall issue to the motor vehicle
 5  owner, without further charge, an emblem use authorization state-
 6  ment, which shall be presented by the motor vehicle owner at the
 7  time of registration.
 8    (d)  Each educational institution's alumni association or foundation
 9  shall provide a list of all new approved applicants and total number of
10  educational license plates to be issued to the director by August 31, 1995,
11  and by June 30 of each calendar year thereafter. All new educational
12  license plates shall be issued for the following calendar year following the
13  receipt of the list of new approved applicants by the director. Any appli-
14  cant for an educational institution license plate may make application for
15  such plates not less than 60 days prior to such person's renewal of reg-
16  istration date, on a form prescribed and furnished by the director of ve-
17  hicles, and any applicant for the educational institution license plates shall
18  provide the annual emblem use authorization statement provided for in
19  subsection (c). Application for registration of a passenger vehicle or truck
20  and issuance of the license plates under this section shall be made by the
21  owner in a manner prescribed by the director of vehicles upon forms
22  furnished by the director.
23    (e)  No registration or educational institution license plate is-
24  sued under this section shall be transferable to any other person.
25    (f)  Renewals of registration under this section shall be made
26  annually, upon payment of the fee prescribed in subsection (b), in
27  the manner prescribed in subsection (b) of K.S.A. 8-132, and amend-
28  ments thereto. No renewal of registration shall be made to any ap-
29  plicant until such applicant provides the annual emblem use au-
30  thorization statement provided for in subsection (c). If such emblem
31  use authorization statement is not presented at the time of registra-
32  tion, the applicant shall be required to comply with K.S.A. 8-143,
33  and amendments thereto, and return the educational institution li-
34  cense plates to the county treasurer of such person's residence.
35    (g)  The director of vehicles shall not issue any educational in-
36  stitution license plates for any educational institution, unless such
37  educational institution's alumni association or foundation guaran-
38  tees the initial issuance of at least 500 license plates.
39    (h)  Each educational institution's alumni association or foun-
40  dation shall:
41    (1)  Pay the initial cost of silk-screening for such educational
42  license plates; and
43    (2)  provide to all county treasurers a toll-free telephone number

 1  where applicants can call the alumni association or foundation for
 2  information concerning the application process or the status of their
 3  license plate application.
 4    (i)  Each educational institution's alumni association or foun-
 5  dation, with the approval of the director of vehicles and subject to
 6  the availability of materials and equipment, shall design a license
 7  plate to be issued under the provisions of this section.
 8    Sec. 4.  K.S.A. 1996 Supp. 8-177a and 8-1,142 are hereby re-
 9  pealed.
10    Sec. 2 5.  This act shall take effect and be in force from and after
11  January 1, 1998, and its publication in the statute book.
