11 AN ACT making and concerning appropriations for the fiscal years ending
12 June 30, 1997, June 30, 1998, and June 30, 1999, and authorizing
13 certain financing, for certain capital improvement projects for the state
14 fair board, department of social and rehabilitation services, Kansas
15 state school for the blind, Kansas state school for the deaf, department
16 of corrections, state historical society, insurance department, depart-
17 ment of administration, department of commerce and housing, Fort
18 Hays state university, Kansas state university, Kansas state university--
19 extension systems and agriculture research programs, Emporia state
20 university, Pittsburg state university, university of Kansas, university of
21 Kansas medical center, Wichita state university, department of human
22 resources, Kansas commission on veterans affairs, attorney general--
23 Kansas bureau of investigation, Kansas highway patrol, adjutant gen-
24 eral and department of wildlife and parks; authorizing the initiation
25 and completion of certain capital improvement projects; and directing
26 or authorizing certain disbursements and acts incidental to the
27 foregoing.

29 Be it enacted by the Legislature of the State of Kansas:
30 Section 1. (a) For the fiscal years ending June 30, 1997, June 30,
31 1998, June 30, 1999, appropriations are hereby made, restrictions and
32 limitations are hereby imposed, and transfers, disbursements and acts
33 incidental to the foregoing are hereby directed or authorized to initiate
34 and complete capital improvement projects as provided in this act.
35 (b) The agencies named in this act are hereby authorized to initiate
36 and complete the capital improvement projects specified and authorized
37 by this act or for which appropriations are made by this act, subject to
38 the restrictions and limitations imposed by this act.
39 (c) This act shall not be subject to the provisions of subsection (a) of
40 K.S.A. 1996 Supp. 75-6702 and amendments thereto.

1 Sec. 2.
2 STATE FAIR BOARD
3 (a) In addition to the other purposes for which expenditures may be
4 made from the state budget stabilization fund for fiscal year 1998, ex-
5 penditures may be made by the above agency from the state budget sta-
6 bilization fund for fiscal year 1998 for the following specified purpose
7 subject to the expenditure limitation prescribed therefor:
8 ADA/EPA projects........................................................ $30,000
9 Provided, That all expenditures by the above agency from the state budget stabilization fund
10 for fiscal year 1998 for the ADA/EPA projects shall be in addition to any expenditure lim-
11 itation imposed on the state budget stabilization fund for fiscal year 1998.
12 (b) There is appropriated for the above agency from the following
13 special revenue fund or funds for the fiscal year ending June 30, 1998,
14 all moneys now or hereafter lawfully credited to and available in such
15 fund or funds, except that expenditures other than refunds authorized by
16 law shall not exceed the following:
17 State fair capital improvements fund................................... No limit
18 Grandstand renovation project fund..................................... No limit
19 Grandstand cost of issuance fund....................................... No limit
20 Grandstand principal and interest fund................................. No limit
21 Grandstand renovation reserve fund..................................... No limit

25 SBSF--encampment building renovation fund.............................. No limit
26 EDIF--encampment renovation fund....................................... No limit
27 (c) Any unencumbered balance in excess of $100 as of June 30, 1997,
28 in the encampment building renovation account of the state general fund
29 is hereby reappropriated for fiscal year 1998:
30 Provided, That the director of accounts and reports shall release moneys in the encampment
31 building renovation account as amounts of private funding are certified by the secretary of
32 the state fair board as available for the renovation of the 4-H encampment building: Provided
33 further, That the director of accounts and reports shall release the funding at the rate of $8
34 from the state general fund for every $1 of private funding certified as available from other
35 sources.
36 Sec. 3.
37 DEPARTMENT OF SOCIAL AND REHABILITATION SERVICES
38 (a) There is appropriated for the above agency from the state insti-
39 tutions building fund for the fiscal year ending June 30, 1998, for the
40 capital improvement project or projects specified as follows:
41 Rehabilitation and repair projects................................... $3,965,000
42 Provided, That the secretary of social and rehabilitation services is hereby authorized to
43 transfer moneys during fiscal year 1998 from the rehabilitation and repair projects account

1 to a rehabilitation and repair account for any institution, as defined by K.S.A. 76-12a01 or
2 76-12a18 and amendments thereto, for projects approved by the secretary of social and
3 rehabilitation services: Provided further, That expenditures also may be made from this
4 account during fiscal year 1998 for the purposes of rehabilitation and repair for facilities of
5 the department of social and rehabilitation services other than any institution, as defined by
6 K.S.A. 76-12a01 or 76-12a18 and amendments thereto.
7 (b) In addition to the purposes for which expenditures may be made
8 by the above agency from the other state fees fund for the fiscal year
9 ending June 30, 1998, expenditures may be made by the above agency
10 from the other state fees fund for fiscal year 1998 for the following capital
11 improvement project or projects, subject to the expenditure limitations
12 prescribed therefor:
13 Area office rehabilitation and repair.................................. $278,488
14 Provided, That expenditures from the area office rehabilitation and repair account shall be
15 in addition to any expenditure limitation imposed on the other state fees fund for fiscal year
16 1998.
17 Sec. 4.
18 KANSAS STATE SCHOOL FOR THE BLIND
19 (a) There is appropriated for the above agency from the state insti-
20 tutions building fund for the fiscal year ending June 30, 1998, for the
21 capital improvement project or projects specified as follows:

23 Sec. 5.
24 KANSAS STATE SCHOOL FOR THE DEAF
25 (a) There is appropriated for the above agency from the state insti-
26 tutions building fund for the fiscal year ending June 30, 1998, for the
27 capital improvement project or projects specified as follows:
28 Rehabilitation and repair projects..................................... $175,000
29 Install air conditioning in Roth dormitories and Roberts academic
30 building............................................................... $446,900
31 Sec. 6.
32 DEPARTMENT OF CORRECTIONS
33 (a) There is appropriated for the above agency from the state general
34 fund for the fiscal year ending June 30, 1997, for the capital improvement
35 project specified as follows:
36 Capacity expansion planning fund....................................... $676,956
37 Provided, That no expenditures may be made from the above account except upon approval
38 of the state finance council acting on this matter which is hereby characterized as a matter
39 of legislative delegation and subject to the guidelines prescribed by subsection (c) of K.S.A.
40 75-3711c and amendments thereto after the review of the recommendations of the joint
41 committee on state building construction: Provided further, That the department of cor-
42 rections shall issue a request for proposal for the designing, construction and operation of
43 a 400-bed medium custody adult male correctional facility: And provided further, That,

1 upon receipt of the responses to the department of corrections' request for proposals, the
2 department shall review its recommendations with the joint committee on state building
3 construction: And provided further, That any unencumbered balance in excess of $100 as
4 of June 30, 1997, is hereby reappropriated for fiscal year 1998.
5 (b) There is appropriated for the above agency from the state general
6 fund for the fiscal year ending June 30, 1998, for the capital improvement
7 project or projects specified as follows:
8 Debt service payment for the revenue refunding bond issue............ $6,544,000
9 Debt service payment for the Wichita work release facility bond issue . $163,000
10 Debt service payment for the Ellsworth correctional facility at Ellsworth,
11 Kansas............................................................... $1,674,000
12 (c) There is appropriated for the above agency from the correctional
13 institutions building fund for the fiscal year ending June 30, 1998, for the
14 capital improvement project or projects specified as follows:
15 Capital improvements=mrehabilitation, remodeling, renovation and repair
16 of correctional institutions......................................... $4,227,497
17 Provided, That the secretary of corrections is hereby authorized to transfer moneys during
18 fiscal year 1998 from the capital improvements--rehabilitation, remodeling, renovation and
19 repair of correctional institutions account of the correctional institutions building fund to
20 an account or accounts of the correctional institutions building fund of any institution or
21 facility under the jurisdiction of the secretary of corrections to be expended during fiscal
22 year 1998 by the institution or facility for capital improvement projects, including security
23 improvement projects, approved by the secretary of corrections: Provided further, That
24 $227,497 is authorized for the construction of a 32-bed minimum custody housing unit
25 located on the grounds of the south unit of Hutchinson correctional facility.

27 (d) There is appropriated for the above agency from the following
28 special revenue fund or funds for the fiscal year ending June 30, 1998,
29 all moneys now or hereafter lawfully credited to and available in such

43 of correctional facilities at, Hutchinson and Norton: Provided further, That the capital im-

1 provement projects for expansion of correctional facilities at Hutchinson and Norton are
2 hereby approved for the department of corrections for the purposes of subsection (b) of
3 K.S.A. 74-8905 and amendments thereto and the authorization of the issuance of bonds by
4 the Kansas development finance authority in accordance with that statute: And provided
5 further, That all moneys received from the issuance of any such bonds shall be deposited
6 in the state treasury to the credit of this fund: And provided further, That no bonds shall
7 be issued for expansion of correctional facilities except upon approval of the state finance
8 council acting on this matter which is hereby characterized as a matter of legislative dele-
9 gation and subject to the guidelines prescribed by subsection (c) of K.S.A. 75-3711c and
10 amendments thereto.
11 Sec. 7.
12 STATE HISTORICAL SOCIETY
13 (a) There is appropriated for the above agency from the state general
14 fund for the fiscal year ending June 30, 1998, for the capital improvement
15 project or projects specified as follows:
16 Rehabilitation and repair projects..................................... $125,000
17 (b) There is appropriated for the above agency from the following
18 special revenue fund or funds for the fiscal year ending June 30, 1998,
19 all moneys now or hereafter lawfully credited to and available in such
20 fund or funds, except that expenditures shall not exceed the following:
21 EDIF cyclical maintenance projects fund................................. $50,000
22 (c) On July 15, 1997, or as soon thereafter as moneys are available,
23 the director of accounts and reports shall transfer $50,000 from the Kan-
24 sas economic development endowment account of the state economic
25 development initiatives fund of the department of commerce and housing
26 to the EDIF cyclical maintenance projects fund of the state historical
27 society.
28 Sec. 8.
29 INSURANCE DEPARTMENT
30 (a) There is appropriated for the above agency from the following
31 special revenue fund or funds for the fiscal year ending June 30, 1998,
32 all moneys now or hereafter lawfully credited to and available in such
33 fund or funds, except that expenditures shall not exceed the following:

9 (b) There is appropriated for the above agency from the state general
10 fund for the fiscal year ending June 30, 1999, for the capital improvement
11 project or projects specified as follows:
12 Cedar Crest renovation................................................. $500,000
13 Any unencumbered balance as of June 30, 1998, in the following capital improvement ac-
14 count is hereby reappropriated for fiscal year 1999: Cedar Crest renovation.
15 (c) There is appropriated for the above agency from the following
16 special revenue fund or funds for the fiscal year ending June 30, 1998,
17 all moneys now or hereafter lawfully credited to and available in such
18 fund or funds, except that expenditures shall not exceed the following:
19 Energy conservation improvements fund.................................. No limit
20 State buildings depreciation fund............................................ $0
21 (d) In addition to the other purposes for which expenditures may be
22 made from the state budget stabilization fund for fiscal year 1998, ex-
23 penditures may be made by the above agency from the unencumbered
24 balance as of June 30, 1997, in each of the following capital improvement
25 accounts of the state budget stabilization fund: ADA capital improve-
26 ment projects--department of administration; fire and safety alarms--
27 statehouse: Provided, That expenditures for fiscal year 1998 from the
28 unencumbered balance in any such account shall not exceed the amount
29 of the unencumbered balance in such account as of June 30, 1997: Pro-
30 vided further, That all expenditures for fiscal year 1998 from such unen-
31 cumbered balance of any such account shall be in addition to any ex-
32 penditure limitation imposed on total expenditures from the state budget
33 stabilization fund for fiscal year 1998.
34 (e) In addition to the other purposes for which expenditures may be
35 made by the above agency from the building and ground fund for fiscal
36 year 1998, expenditures may be made by the above agency from any
37 unencumbered balance as of June 30, 1997, in each of the following
38 capital improvement accounts of the building and ground fund: Parking
39 lot rehabilitation and repair: Provided, That expenditures for fiscal year
40 1998 from the unencumbered balance in any such account shall not ex-
41 ceed the amount of the unencumbered balance in such account on June
42 30, 1997: Provided further, That all expenditures for fiscal year 1998 from
43 such unencumbered balance in any such account of the building and

1 ground fund shall be in addition to any expenditure limitation imposed
2 on the building and ground fund for fiscal year 1998.
3 (f) In addition to the other purposes for which expenditures may be
4 made by the above agency from the state buildings depreciation fund for
5 fiscal year 1998, expenditures may be made by the above agency from
6 the following capital improvement account or accounts of the state build-
7 ings depreciation fund during fiscal year 1998 for the following capital
8 improvement project or projects, subject to the expenditure limitations
9 prescribed therefor:

20 made by the above agency from the state buildings depreciation fund for
21 fiscal year 1998, expenditures may be made by the above agency from
22 the state buildings depreciation fund from the unencumbered balance as
23 of June 30, 1997, in each capital improvement account of the state build-
24 ings depreciation fund for one or more projects approved for prior fiscal
25 years: Provided, That expenditures from the unencumbered balance in
26 any such account shall not exceed the amount of the unencumbered bal-
27 ance in such account on June 30, 1997: Provided further, That all ex-
28 penditures from any such account shall be in addition to any expenditure
29 limitation imposed on the state buildings depreciation fund for fiscal year
30 1998.
31 (h) In addition to the other purposes for which expenditures may be
32 made by the above agency from the state buildings operating fund for
33 fiscal year 1998, expenditures may be made by the above agency from
34 the following capital improvement account or accounts of the state build-
35 ings operating fund during fiscal year 1998 for the following capital im-
36 provement project or projects, subject to the expenditure limitations pre-
37 scribed therefor:
38 Landon state office building debt service............................ $1,408,300
39 Provided, That all expenditures by the above agency from the state buildings operating fund
40 for fiscal year 1998 for Landon state office building debt service shall be in addition to any
41 expenditure limitation imposed on the state buildings operating fund for fiscal year 1998.
42 (i) In addition to the other purposes for which expenditures may be
43 made by the above agency from the motor pool service fund for fiscal

2 following capital improvement account or accounts of the motor pool
3 service fund during fiscal year 1998 for the following capital improvement

7 Provided, That all expenditures by the above agency from the motor pool service fund for
8 fiscal year 1998 for police garage debt service shall be in addition to any expenditure limi-

11 DEPARTMENT OF COMMERCE AND HOUSING
12 (a) In addition to the other purposes for which expenditures may be
13 made from the Kansas economic development endowment account of the
14 state economic development initiatives fund for fiscal year 1998, moneys
15 may be expended by the above agency from the Kansas economic devel-
16 opment endowment account of the state economic development initia-
17 tives fund during the fiscal year 1998 for the following capital improve-
18 ment project or projects, subject to the expenditure limitations prescribed
19 therefor:
20 Rehabilitation and repair--travel information centers................... $35,000
21 (b) Expenditures may be made from the construct Olathe travel in-
22 formation center subaccount of the Kansas economic development en-
23 dowment account of the state economic development initiatives fund dur-
24 ing the fiscal year ending June 30, 1998:
25 Provided, That such expenditures shall not exceed the amount of the
26 unencumbered balance in such subaccount on June 30, 1997: Provided
27 further, That all expenditures from the unencumbered balance of such
28 subaccount shall be in addition to any expenditure limitation imposed on
29 the total expenditures from the Kansas economic development endow-
30 ment account of the state economic development initiatives fund for fiscal
31 year 1998.

33 FORT HAYS STATE UNIVERSITY
34 (a) There is appropriated for the above agency from the following
35 special revenue fund or funds for the fiscal year ending June 30, 1998,
36 all moneys now or hereafter lawfully credited to and available in such
37 fund or funds, except that expenditures shall not exceed the following:

29 cost of bond issuance, cost of interest on the bonds during the construction of the project
30 and required reserves for the payment of principal and interest on the bonds: Provided
31 further, That such capital improvement project is hereby approved for Kansas state univer-
32 sity for the purposes of subsection (b) of K.S.A. 74-8905 and amendments thereto and the
33 authorization of the issuance of bonds by the Kansas development finance authority in
34 accordance with that statute: And provided further, That all moneys received from the
35 issuance of any such bonds shall be deposited in the state treasury to the credit of this fund.
36 Student coliseum bond fee fund......................................... No limit

38 Student and staff parking garage--special revenue fund................. No limit
39 Provided, That Kansas state university may make expenditures from the student and staff
40 parking garage--special revenue fund for the capital improvement project to construct a
41 parking garage in addition to the expenditure of other moneys appropriated therefor: Pro-
42 vided, however, That expenditures from this fund for such capital improvement project shall
43 not exceed $10,500,000 plus all amounts required for costs of any bond issuance, costs of

1 interest on any bond issued or obtained for such capital improvement project and any
2 required reserves for payment of principal and interest on any bond: Provided further, That
3 such capital improvement project is hereby approved for Kansas state university for the
4 purposes of subsection (b) of K.S.A. 74-8905 and amendments thereto and the authorization
5 of the issuance of bonds by the Kansas development finance authority in accordance with
6 that statute: And provided further, That all moneys received from the issuance of any such
7 bonds shall be deposited in the state treasury to the credit of this fund.
8 (c) On or before July 10, 1997, and on or before the 10th day of each
9 month thereafter during fiscal year 1998, the director of accounts and
10 reports shall transfer from the state general fund to the student coliseum
11 bond fee fund interest earnings based on: (1) The average daily balance
12 of moneys in the student coliseum bond fee fund for the preceding
13 month, and (2) the net earnings rate of the pooled money investment
14 portfolio for the preceding month.
15 (d) In addition to the other purposes for which expenditures may be
16 made by the above agency from the restricted fees fund for the fiscal year
17 ending June 30, 1998, expenditures may be made by the above agency
18 from the appropriate account or accounts of the restricted fees fund dur-
19 ing fiscal year 1998 for the following capital improvement projects, sub-
20 ject to the expenditure limitations prescribed therefor:
21 Biological and agricultural engineering research storage building...... No limit
22 (e) In addition to the other purposes for which expenditures may be
23 made by the above agency from the student union renovation and expan-
24 sion fund for the fiscal year ending June 30, 1998, expenditures may be
25 made by the above agency from the student union renovation and expan-
26 sion fund during fiscal year 1998 for costs associated with roof repair on
27 an existing portion of the student union building.
28 (f) In addition to the other purposes for which expenditures may be
29 made by the above agency from the sponsored research overhead fund
30 for the fiscal year ending June 30, 1998, expenditures may be made by
31 the above agency from the sponsored research overhead fund for the
32 following capital improvement projects, subject to the expenditure limi-
33 tation prescribed therefor:

37 (g) During the fiscal year ending June 30, 1998, Kansas state univer-

42 (a) In addition to the other purposes for which expenditures may be
43 made by the above agency from the restricted fees fund for the fiscal year

1 ending June 30, 1998, expenditures may be made by the above agency

32 capital improvement accounts of the special employment security fund

14 (a) In addition to the other purposes for which expenditures may be
15 made from the highway patrol training center fund for fiscal year 1998,
16 expenditures may be made by the above agency from the highway patrol
17 training center fund for fiscal year 1998 to make debt service payments
18 for the Kansas highway patrol training center at Salina for the bonds
19 issued for such project pursuant to subsection (b) of section 6 of chapter
20 326 of the 1992 Session Laws of Kansas.
21 (b) In addition to the other purposes for which expenditures may be
22 made from the highway patrol training center fund for the fiscal year
23 ending June 30, 1998, moneys may be expended by the above agency
24 from the highway patrol training center fund for fiscal year 1998 for the
25 following capital improvement project or projects, subject to the expend-
26 iture limitation prescribed therefor:
27 Training center--remodeling, rehabilitation and repair projects......... $35,000
28 Provided, That all expenditures from each such capital improvement account shall be in
29 addition to any expenditure limitation imposed on the highway patrol training center fund
30 for fiscal year 1998.
31 (c) In addition to other purposes for which expenditures may be
32 made by the above agency from the motor carrier inspection fund for the
33 fiscal year ending June 30, 1998, moneys may be expended by the above
34 agency from the motor carrier inspection fund during fiscal year 1998 for
35 the following capital improvement project or projects, subject to the ex-
36 penditure limitations prescribed therefor:
37 Remodeling, rehabilitation and repair projects.......................... $50,000
38 Replacement of scales................................................... $85,176
39 Provided, That all expenditures from each such capital improvement account shall be in
40 addition to any expenditure limitation imposed on the motor carrier inspection fund for

42 (d) In addition to the other purposes for which expenditures may be
43 made by the above agency from the motor carrier inspection fund for

1 fiscal year 1998, expenditures may be made by the above agency from
2 the unencumbered balance as of June 30, 1997, in each of the following
3 capital improvement accounts of the motor carrier inspection fund for
4 fiscal year 1998: Replacement of Caney Trailer: Provided, That ex-
5 penditures for fiscal year 1998 from the unencumbered balance in any
6 such account shall not exceed the unencumbered balance in such account
7 on June 30, 1997: Provided further, That all expenditures for fiscal year
8 1998 from the unencumbered balance in any such account shall be in
9 addition to any expenditure limitation imposed on the motor carrier in-
10 spection fund for fiscal year 1998.

13 (a) There is appropriated for the above agency from the state general

23 (a) There is appropriated for the above agency from the state general

33 (b) There is appropriated for the above agency from the following
34 special revenue fund or funds for the fiscal year ending June 30, 1998,
35 all moneys now or hereafter lawfully credited to and available in such
36 fund or funds, except that expenditures shall not exceed the following:

20 (c) On July 1, 1997, or as soon thereafter as moneys are available, the
21 director of accounts and reports shall transfer $1,350,000 from the state
22 highway fund of the department of transportation to the department ac-
23 cess road fund of the department of wildlife and parks.
24 (d) Subject to the limitation on total expenditures from the boating
25 fee fund, except as hereinafter specifically provided, expenditures may be
26 made by the above agency from the boating fee fund for fiscal year 1998
27 for the following specified [In addition to the other purposes for which
28 expenditures may be made by the above agency from the boating
29 fee fund for fiscal year 1998, expenditures may be made by the
30 above agency from the following capital improvement account or
31 accounts of the boating fee fund during fiscal year 1998 for the
32 following] capital improvement project or projects and other specified
33 purposes, subject to the expenditure limitations prescribed therefor:

6 limitation imposed on any such account of the boating fee fund for fiscal

8 (f) In addition to the other purposes for which expenditures may be
9 made from the state budget stabilization fund for fiscal year 1998, ex-
10 penditures may be made by the above agency from the state budget sta-
11 bilization fund for fiscal year 1998 for the following specified purpose
12 subject to the expenditure limitation prescribed therefor:
13 State budget stabilization fund ADA accessibility....................... $90,000
14 Provided, That all expenditures by the above agency from the state budget stabilization fund
15 for fiscal year 1998 for the state budget stabilization fund ADA accessibility projects shall
16 be in addition to any expenditure limitation imposed on the state budget stabilization fund
17 for fiscal year 1998.
18 (g) In addition to the other purposes for which expenditures may be
19 made by the above agency from the state budget stabilization fund for
20 fiscal year 1998, expenditures may be made by the above agency for fiscal
21 year 1998 from the unencumbered balance as of June 30, 1997, in each
22 existing capital improvement account of the above agency in the state
23 budget stabilization fund: Provided, That expenditures from the unen-
24 cumbered balance of any such existing capital improvement account shall
25 not exceed the amount of the unencumbered balance in such account on
26 June 30, 1997: Provided further, That all expenditures from the unen-
27 cumbered balance of any such account shall be in addition to any ex-
28 penditure limitation imposed on the state budget stabilization fund for
29 fiscal year 1998.
30 (h) In addition to the other purposes for which expenditures may be
31 made by the above agency from the wildlife fee fund for fiscal year 1998,

6 provement account shall not exceed the amount of the unencumbered
7 balance in such account on June 30, 1997: Provided further, That all
8 expenditures from the unencumbered balance of any such account shall
9 be in addition to any expenditure limitation imposed on the wildlife fee
10 fund for fiscal year 1998: And provided further, That, on July 1, 1997,
11 any unencumbered balance as of June 30, 1997, in each of the following
12 capital improvement accounts of the wildlife fee fund is hereby
13 lapsed: Ford county lake renovation; repair outlet--McPherson county
14 state fishing lake; McPherson wetland development; Barber state fishing
15 lake dam.
16 (j) In addition to the other purposes for which expenditures may be
17 made by the above agency from the water plan special revenue fund for
18 fiscal year 1998, expenditures may be made by the above agency for fiscal
19 year 1998 from the unencumbered balance as of June 30, 1997, in each
20 existing capital improvement account of the water plan special revenue
21 fund: Provided, That expenditures from the unencumbered balance of
22 any such existing capital improvement account shall not exceed the
23 amount of the unencumbered balance in such account on June 30, 1997:
24 Provided further, That all expenditures from the unencumbered balance
25 of any such account shall be in addition to any expenditure limitation
26 imposed on the water plan special revenue fund for fiscal year 1998.
27 (k) In addition to the other purposes for which expenditures may be
28 made by the above agency from the wildlife conservation fund for fiscal
29 year 1998, expenditures may be made by the above agency for fiscal year
30 1998 from the unencumbered balance as of June 30, 1997, in each existing
31 capital improvement account of the wildlife conservation fund: Provided,
32 That expenditures from the unencumbered balance of any such existing
33 capital improvement account shall not exceed the amount of the unen-
34 cumbered balance in such account on June 30, 1997: Provided further,
35 That all expenditures from the unencumbered balance of any such ac-
36 count shall be in addition to any expenditure limitation imposed on the
37 wildlife conservation fund for fiscal year 1998 and shall be in addition to
38 any other expenditure limitation imposed on any such account of the
39 wildlife conservation fund for fiscal year 1998.
40 (l) In addition to the other purposes for which expenditures may be
41 made by the above agency from the parks fee fund for fiscal year 1998,
42 expenditures may be made by the above agency for fiscal year 1998 from
43 the unencumbered balance as of June 30, 1997, in each existing capital

1 improvement account of the parks fee fund: Provided, That expenditures
2 from the unencumbered balance of any such existing capital improvement
3 account shall not exceed the amount of the unencumbered balance in
4 such account on June 30, 1997: Provided further, That all expenditures
5 from the unencumbered balance of any such account shall be in addition
6 to any expenditure limitation imposed on the parks fee fund for fiscal
7 year 1998.
8 (m) In addition to the other purposes for which expenditures may be
9 made by the above agency from the nongame wildlife improvement fund
10 for fiscal year 1998, expenditures may be made by the above agency for
11 fiscal year 1998 from the unencumbered balance as of June 30, 1997, in
12 each existing capital improvement account of the nongame wildlife im-
13 provement fund: Provided, That expenditures from the unencumbered
14 balance of any such existing capital improvement account shall not exceed
15 the amount of the unencumbered balance in such account on June 30,
16 1997: Provided further, That all expenditures from the unencumbered
17 balance of any such account shall be in addition to any expenditure lim-
18 itation imposed on the nongame wildlife improvement fund for fiscal year
19 1998 and shall be in addition to any other expenditure limitation imposed
20 on any such account of the nongame wildlife improvement fund for fiscal
21 year 1998.
22 (n) On July 1, 1997, the director of accounts and reports shall transfer
23 any unencumbered balance in the clean lakes fund--federal to the wild-
24 life fee fund.
25 (o) On July 1, 1997, the director of accounts and reports shall transfer
26 any unencumbered balance in the construct Milford conservation edu-
27 cation center gift fund of the department of wildlife and parks to the
28 department of wildlife and parks private gift and donations fund. On July
29 1, 1997, the construct Milford conservation education center gift fund is
30 hereby abolished.
31 [(p) In addition to the other purposes for which expenditures
32 may be made by the above agency from the parks fee fund for fiscal
33 year 1997, expenditures may be made by the above agency from
34 the following capital improvement account or accounts of the parks
35 fee fund during fiscal year 1997 for the following capital improve-
36 ment project or projects, subject to the expenditure limitations pre-
37 scribed therefor:
38 [Construct boat slips at Prairie Dog state park......................... $50,000
39 [Provided, That all expenditures from each such capital improvement account shall
40 be in addition to any expenditure limitation imposed on the parks fee fund for fiscal

42 Sec. 25. Appeals to exceed limitations. Upon written application to
43 the governor and approval of the state finance council, expenditures from

1 special revenue funds may exceed the amounts specified in this act.
2 Sec. 26. Savings. Any unencumbered balance as of June 30, 1997, in
3 any special revenue fund, or account thereof, which is not otherwise spe-
4 cifically appropriated or limited by this or other appropriation act of the
5 1997 regular session of the legislature, is hereby appropriated for the
6 fiscal year ending June 30, 1998, for the same use and purpose as the
7 same was heretofore appropriated.
8 Sec. 27. Any correctional institutions building fund appropriation
9 heretofore appropriated to any state agency named in this or other ap-
10 propriation act of the 1997 regular session of the legislature, and having
11 an unencumbered balance as of June 30, 1997, in excess of $100 is hereby
12 reappropriated for the fiscal year ending June 30, 1998, for the same uses
13 and purposes as originally appropriated unless specific provision is made
14 for lapsing such appropriation.
15 Sec. 28. Any Kansas educational building fund appropriation here-
16 tofore appropriated to any institution named in this or other appropriation
17 act of the 1997 regular session of the legislature and having an unencum-
18 bered balance as of June 30, 1997, in excess of $100 is hereby reappro-
19 priated for the fiscal year ending June 30, 1998, for the same use and
20 purpose as originally appropriated, unless specific provision is made for
21 lapsing such appropriation.
22 Sec. 29. Any state institutions building fund appropriation heretofore
23 appropriated to any state agency named in this or other appropriation act
24 of the 1997 regular session of the legislature and having an unencumbered
25 balance as of June 30, 1997, in excess of $100 is hereby reappropriated
26 for the fiscal year ending June 30, 1998, for the same use and purpose as
27 originally appropriated, unless specific provision is made for lapsing such
28 appropriation.
29 Sec. 30. Any Kansas special capital improvements fund appropriation
30 heretofore appropriated to any state agency named in this or other ap-
31 propriation act of the 1997 regular session of the legislature, and having
32 an unencumbered balance as of June 30, 1997, in excess of $100 is hereby
33 reappropriated for the fiscal year ending June 30, 1998, for the same use
34 and purpose as originally appropriated unless specific provision is made
35 for lapsing such appropriation.
36 Sec. 31. This act shall take effect and be in force from and after its
37 publication in the Kansas register.
